TERMS & CONDITIONS
Please ensure you read all of the following terms and conditions.
These Terms and Conditions form part of your agreement with The Cosmic Collective (Chyna Desveaux – Sole Trader), and your booking of treatment and or consultation; this will constitute acceptance of these Terms and Conditions when you become a client. For these terms and conditions, Chyna Desveaux will constitute as (The Practitioner) and you (The Client).
The Practitioner promises you:
Excellent customer care, treating you (The Client) with dignity and respect
To provide a safe and comforting setting to receive your treatment
Client information will be kept strictly private and confidential
To treat you with the best therapies and of the highest quality to suit and benefit your needs
The Practitioner has the right to cancel any appointment after the consultation if the
The practitioner feels it is in the Client's and Practitioner's best interest for the treatment not to go ahead.
Clients promise to The Cosmic Collective
You are required to arrive on time for each treatment, you understand for late arrivals the treatment time will be reduced or, if necessary, cancelled.
You understand and agree that it is your responsibility to inform the Practitioner of any conditions or changes to your health, now and ongoing, which may affect/and or contraindicate you from having a treatment.
You understand and agree to inform the practitioner if you are on any SSRI (antidepressants / antipsychotic) medication and / or are pregnant, so the Practitioner can make necessary adjustments, where required.
You understand it is important to disclose medication and medical information due to contradictions that may occur with treatments.
If your Practitioner requires further medical information from another practitioner, you must provide such details, for your safety.
Your Practitioner cannot be held liable in any way for undeclared or unknown medical conditions.
You understand that this therapy is not a substitute for medical advice and / or treatment
Client's Responsibilities
Pre-Treatment Requirements: The Client agrees to follow all pre-treatment instructions provided by the Practitioner. Failure to do so may result in the cancellation or rescheduling of the appointment, and the Client may be liable for any associated costs.
Post-Treatment Care: The Client agrees to adhere to all post-treatment care instructions provided by the Practitioner to ensure the best possible outcome and reduce the risk of adverse effects.
Payment
Payment for single treatments must be made in full, before the beginning of each session.
Preferred forms of payment are: by internet bank transfer or cash, paid directly to the Practitioner.
Payment terms for workplace treatments and events will be 30 days from the date of invoice.
Cancellation and Refunds
48 hours’ notice of cancellation or postponement is required for all appointments.
Notice of less than 48 hours will incur full payment of the Treatment fee.
Unforeseen events will be considered on the day, in the form of a rescheduled appointment / giftcard.
Once purchased, your Treatments are non-refundable and non-transferable.
Lateness Policy
If the client is late to their treatment; their treatment cannot be extended and will end at the original end time.
If the Practitioner is late, additional time will be added to the treatment or subsequent treatments.
Liability
This Liability section applies only to the extent permitted by law. For the avoidance of doubt, the Practitioner does not exclude or limit any liability for (a) personal injury (b) fraudulent misrepresentation.
The Practitioner and/or The Cosmic Collective (the “brand”) does not accept liability (except as set out below) for any errors and omissions and reserves the right to change information, specifications, and descriptions of listed packages and services. The Practitioner and/or the Company will use reasonable effort to correct errors and omissions as quickly as practicably possible after being notified of them.
The Practitioner will only be liable for direct loss up to a maximum total of the price of the treatments purchased by the Client, in respect of any claim.
The Practitioner shall not be liable for any loss or injury attributable to:
the Client’s fault (including but not limited to the ‘Client promise to The Cosmic Collective’ page 1 of these terms & conditions)
a third party unconnected with the provision of services provided by your Practitioner; or events which your Practitioner, nor her suppliers or agents could have foreseen or forestalled, even if they had taken reasonable care.
The Practitioner is not liable for loss or damage to your property whilst attending home visits.
The Practitioner is not liable if you ignore her recommendation, at any time, to seek medical advice.
General, Privacy, and Consent
You must be 18+ in order to purchase any of the products and services advertised.
You are responsible for keeping all your contact information and marketing preferences up to date with the Practitioner.
The Practitioner will only do what you ask him/her to do, or what you have given him/her permission to do with any personal or sensitive information held about you unless the Practitioner feels there is a risk to you and/or your safety.
Changes to Terms and Conditions
Amendments:
The Practitioner reserves the right to amend these Terms and Conditions at any time. Any changes will be communicated to the Client in writing and will be effective immediately upon delivery.
Information Gathering
When you book an appointment, The Practitioner will collect personal details such as your name, email and telephone numbers. This information is used to identify you and contact you about the appointments and services you have booked.
When you provide The Practitioner with your personal information through completing your consultation form, making a payment or contacting The Practitioner about their services, you are giving your consent to The Practitioner collecting that information and using it for that specific reason.
The Practitioner may use your personal information for a secondary reason, like marketing, unless you have stated in writing, you do not wish them to do so.
For legal protection, The Practitioner is required to hold the personal information you have given to them to provide you with treatments and the notes about those treatments for a minimum of eight years.
Eight years after your last treatment The Cosmic Collective will permanently delete all your personal information held.
Should you wish to withdraw your consent regarding your personal information please email the Practitioner with your request.
You have the right to review the personal information The Cosmic Collective stores about you and your sessions at any time.
You also have the right to request The Cosmic Collective to update or amend your data if it is incorrect.
To action any of these rights at any time please email Chyna Desveaux with your request.
Medications & Health Constrictions
Please inform your practitioner of any medications you are currently taking.
If you are currently taking antidepressants / SSRIs or heart medication, you must tell your practitioner, especially in the instance of use of ceremonial grade cacao or energy/healing work.
If you are pregnant, you must tell your practitioner.
Disclosure
Unless required to do so by law, The Cosmic Collective will not otherwise share, sell, or distribute any of the information you provide without your consent unless the Practitioner feels you are at risk and/or unsafe.
Dispute Resolution
Mediation and Arbitration: Any disputes arising out of or relating to this agreement shall be first subject to mediation, and if mediation is unsuccessful, then resolved through binding arbitration in accordance with the rules of the Arbitration Act 1996 (or applicable local legislation). The venue for arbitration shall be mutually agreed upon.
Indemnity
Client Indemnity: The Client agrees to indemnify and hold harmless the Practitioner from and against any and all claims, liabilities, damages, and expenses (including legal fees) arising out of the Client's breach of this agreement or any action brought by a third party as a result of the Client's actions.
Force Majeure
Force Majeure: Neither party shall be liable for any delay or failure to perform any obligations if such delay or failure is due to causes beyond their reasonable control, including but not limited to acts of God, war, government regulations, disaster, strikes, civil disorder, or any other emergency.
Severability
Severability: If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. Any invalid or unenforceable provision will be replaced by a valid, enforceable provision that most closely matches the intent of the original provision.
Governing Law and Jurisdiction
Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.
Jurisdiction: Any legal action or proceeding related to this agreement shall be brought exclusively in the courts of England and Wales.
Pictures & Videos
The practitioner may take pictures and videos during the sessions, for marketing purposes. They will ensure the client is made aware, if these are to be used on a public platform, and will always attempt to keep your identity hidden, where possible, but cannot guarantee. If you are not comfortable with photos or videos of your sessions, please make the practitioner aware, in writing.
Aftercare & Important Information
You as a client, understand that the sessions you plan to attend comprise of healing modalities that in no way substitute for medical interventions, both for physical health and mental health. You understand that this session is based on profound healing work on the spirit self with the intention of assisted healing & working with the Plant Medicine Ceremonial grade Cacao, Sound Transmission, Bodywork and Somatics.
You also understand that your Practitioner may make suggestions for self-care as well as appropriate referrals during/after the ceremony.
You acknowledge that open communication is advised & promoted between yourself and your Practitioner to enhance a mutual understanding and acceptance of the work provided during the treatment setting.
You further understand that there are numerous benefits possible through these sessions and specifically with Energy Healing/Soul Transmission healings, such as diminished pain sensation, increased relaxation, relief from anxiety, and an enhanced sense of well-being.
These effects may vary depending on each individual’s response patterns and are not guaranteed.
Although there are no known harmful effects from this type of intervention, you hold your Practitioner (Chyna Desveaux) harmless from any possible effects that may cause temporary physical or emotional discomfort and agree to take full responsibility for your self-care and personal development. You understand you are in control & responsible for your own body.
You understand when using Energy Medicine, the practitioner is not “diagnosing” or “treating” the physical body solely which is the domain of the medical field and other allied health care professionals but instead is connecting spirit-to-spirit with a client to assist the client in addressing imbalances within the client’s energy system, as well as exploring the energetic influence of thoughts, beliefs, and emotions and how they impact the client.
You understand there is a distinction between “healing” using Energy Medicine and the practice of medicine or any other licensed healthcare practice.
Any information presented in this session about Energy / Plant Medicine is not intended to represent that Energy / Plant Medicine is used to diagnose, cure, treat, or prevent any medical problem or psychological disorder nor is Energy / Plant Medicine intended as a substitute for seeking professional health care advice and services. We do not provide any medical services and strongly advises that you seek professional advice as appropriate before making any health decisions.
During Ceremony & Aftercare
You understand with all healing there may be a purge (physically, mentally, energetically) during and after the ceremony/session.
You understand it can be normal to have a healing crisis following a healing session and that if this occurs, it is a clearing occurring and part of the healing process.
What is a healing crisis?
A healing crisis is a temporary worsening of symptoms after energy work. See this as a detox of the system bringing things to the surface to clear.
In a healing crisis, symptoms briefly worsen before beginning to improve.
You understand that if you at all feel unsafe, you are to contact a GP. If in crisis and out of hours, you are to take yourself or ask someone you trust to take you to A&E.
You understand the following symptoms you may experience during & after a healing session can vary, including but not limited to, the following common symptoms:
Emotions may surface; both lighter or challenging emotions - allow them to surface & clear and seek support, if required.
You may require solitude or feel a pull towards spending time with others
Tiredness/fatigue / increased need to sleep
Less or more energy
Lightheadedness
Cold-like symptoms
Abdominal disturbances/Stomach upsets/ pins & needles
Pain and sensations in different parts of the body
The emergence of unhealthy old mental-emotional patterns - its really important to honor
these and stop these patterns in their tracks and replace them with new patterns.
Life changes- relationships, career, location etc
It is not necessary for everyone to experience all of these side effects so do not be alarmed if you do not experience any of those listed above.
Please be comforted to know, that each individual is different and healing happens in a way that is right for them - there is no right or wrong way. If you have any queries about what you are experiencing after a healing session please contact your practitioner.
You understand that it is your responsibility to follow the aftercare protocol and guidance given to you from the practitioner as this is helpful for integrating your healing process.
Aftercare guidelines
Please be mindful of incorporating the below aftercare as much as you can, as it will really help to crystalline your activation and clearing.
Please drink a lot of water & stay hydrated
Be mindful of what you are listening to / watching/reading
Be mindful of what food you are consuming, and keep it high-vibrational natural foods
Avoid drugs/alcohol for as long as possible (a minimum of 1 week)
Be around high vibrational places and people (if you can) defiantly no clubs/ bars for two
days after the ceremony/sessions
Journal/note down your thoughts, feelings, meditations & dreams
Meditate & ground daily
You understand that if you do not agree with anything in this agreement the practitioner kindly asks you to respond within 48 hours of receiving this information (as soon as possible if received in a shorter time frame), stating what parts of these terms and conditions you do not agree with, otherwise, the healing practitioner will assume all is well.
You understand what the treatment sessions that you have enquired/booked involve and you understand that these treatments are not intended as a substitute for medical or psychological care.
You understand that Chyna Desveaux does not diagnose medical conditions, nor does she, prescribe medicines, nor interfere with the treatment of a licensed medical professional. You understand that you should consult a healthcare professional for any physical or psychological ailment you have.
You understand that the practitioner will be placing hands on me during the sessions for energy and somatic bodywork unless you inform the practitioner of a no-touch approach.
You understand that the practitioner may take pictures & videos during your sessions for promotional / marketing purposes.
You understand that if you do not physically sign these terms and conditions, but have received them via email if the practitioner has not heard from you before the treatment about any disagreements with anything outlined in these terms, the practitioner will take this as an automatic confirmation of your agreement to these terms.
Consent to Treatment
Informed Consent
By booking this service, the Client acknowledges that they have been informed about the nature of the treatments, potential risks, and benefits. The Client consents to receive the treatment under these terms and conditions.
