By purchasing a service, the Client (“Client,” “you”) confirms that they have read, understood, and agreed to the terms below.

Contact: alex@creativecallen.com

1. NATURE OF SERVICES

Creative Callen provides creative consulting, brand strategy, content strategy, social media strategy, digital presence reviews, audits, and related advisory services.

Services are based on professional opinion, creative direction, strategic observation, and outside-perspective evaluation.

Unless specifically stated in the purchased service, Creative Callen does not provide:

  • Guaranteed business results

  • Guaranteed revenue, sales, followers, reach, engagement, or growth

  • Paid advertising management

  • Internal analytics or data-science services

  • Financial, legal, accounting, or investment advice

Any recommendations provided are strategic guidance. The Client remains responsible for business decisions, implementation, and outcomes.

2. DIGITAL PRESENCE AUDIT

The Digital Presence Audit is a customized creative and strategic review of the Client’s public-facing brand and digital presence.

Current investment: $950, unless otherwise stated at checkout.

The purpose of the audit is to provide an outside perspective on how the Client’s business, brand, content, offers, and online platforms are currently being communicated and experienced.

Depending on the Client’s business and submitted materials, the audit may review areas such as:

  • Social media profiles and platform presence

  • Profile, bio, and first-impression clarity

  • Brand positioning

  • Messaging and brand voice

  • Visual consistency and creative direction

  • Content themes and overall content ecosystem

  • Alignment between content and current offers

  • Website or landing-page presence, when applicable

  • Customer journey and digital touchpoints

  • Platform purpose and alignment

  • Missed opportunities, gaps, and areas of confusion

  • Strategic priorities

  • Personalized content or campaign recommendations

  • Recommended next steps

The exact recommendations provided will vary based on the Client’s business, needs, and current digital presence.

The Digital Presence Audit does not include:

  • Social media management

  • Posting or scheduling

  • Content production

  • Photography or videography

  • Graphic design

  • Copywriting implementation

  • Website design or development

  • Funnel building

  • Email marketing setup

  • Paid advertising

  • Internal analytics reporting

  • Competitor benchmarking unless specifically agreed upon

  • Ongoing implementation support

  • Unlimited revisions or ongoing consulting

3. AUDIT PROCESS + CLIENT MATERIALS

After purchase, the Client may be asked to provide information and materials including, but not limited to:

  • Social media links

  • Website or landing-page links

  • Current offers or services

  • Brand information

  • Business goals

  • Current challenges

  • Relevant documents or supporting materials

The Client is responsible for providing complete and accurate information.

The audit timeline does not begin until Creative Callen has received all required materials and information needed to begin the work.

If Client materials are delayed or incomplete, the delivery timeline may also be delayed.

4. DELIVERY TIMELINE

The Digital Presence Audit will generally be completed within 10 business days after:

  1. Payment has been completed, and

  2. All required Client materials have been received.

Business days do not include weekends or federal holidays.

Unexpected circumstances may occasionally require a reasonable extension. If this happens, Creative Callen will communicate with the Client as soon as reasonably possible.

5. AUDIT REVIEW CALL

The Digital Presence Audit includes one 1:1 Audit Review Call unless otherwise stated at checkout.

During this call, Creative Callen will walk the Client through the audit, explain key findings and recommendations, and answer reasonable questions related to the audit.

The scheduling link for the review call will be provided once the audit is complete.

The Client is responsible for scheduling the call within 30 days of receiving the completed audit, unless otherwise agreed in writing.

The review call is intended to discuss the completed audit and does not include additional strategy development, implementation work, or an expanded scope beyond the purchased service.

6. SCHEDULING, RESCHEDULING + NO-SHOWS

For any included call, the Client is responsible for scheduling and attending at the agreed time.

Calls may be rescheduled with at least 24 hours’ notice.

Calls canceled or rescheduled with less than 24 hours’ notice, or missed without notice, may be forfeited at Creative Callen’s discretion.

If Creative Callen needs to reschedule a call, a replacement time will be provided.

7. PAYMENT

Payment is due in full at checkout unless another payment arrangement is expressly offered.

Creative Callen is not required to begin work until payment has been successfully received.

The Client is responsible for ensuring payment information is accurate and authorized.

8. CANCELLATIONS + REFUNDS

Because the Digital Presence Audit is a customized, time-based professional service, refunds are limited.

If the Client requests cancellation before Creative Callen has begun reviewing or working on the Client’s materials, Creative Callen may, at its discretion, approve a cancellation and refund, less any non-refundable payment-processing fees where legally permitted.

Once Creative Callen has begun the audit, all sales are final and non-refundable.

No refund will be provided because the Client:

  • Changes their mind

  • Chooses not to implement the recommendations

  • Does not receive a particular business result

  • Fails to provide materials on time

  • Does not schedule or attend the included review call

  • Disagrees with a professional or creative recommendation

Nothing in this Agreement is intended to waive any rights that cannot legally be waived.

9. PAYMENT DISPUTES + CHARGEBACKS

If the Client has a concern regarding payment or services received, the Client agrees to contact Creative Callen first at alex@creativecallen.com so the issue may be addressed in good faith.

Nothing in this Agreement prevents a Client from exercising rights available to them under applicable law or through their payment provider.

The Client understands that marketing, branding, social media, and business results depend on numerous factors outside Creative Callen’s control.

Recommendations represent strategic guidance and professional opinion only.

11. CLIENT RESPONSIBILITY + IMPLEMENTATION

The Client is solely responsible for deciding whether and how to implement recommendations provided.

Creative Callen is not responsible for:

  • Actions taken or not taken by the Client

  • Changes made to social media platforms

Unless a separate implementation service is purchased, the Client is responsible for executing all recommendations.

12. INTELLECTUAL PROPERTY

Creative Callen retains ownership of its original frameworks, methods, systems, templates, concepts, educational materials, and strategic processes.

Upon full payment, the Client is granted a personal, non-transferable license to use the final audit, recommendations, and related materials internally for their own business.

The Client may not:

  • Resell the audit

  • Redistribute Creative Callen’s materials

  • Teach or package Creative Callen’s proprietary frameworks as their own

  • Sell copies of the audit or related materials

  • Claim Creative Callen’s original frameworks as their own intellectual property

The Client retains ownership of their own pre-existing brand assets, content, trademarks, and materials.

13. CONFIDENTIALITY

Both parties agree to treat non-public business information shared during the engagement as confidential.

Creative Callen will not intentionally disclose confidential Client information to third parties except where reasonably necessary to provide the service, comply with law, or use authorized business tools and service providers.

This provision does not apply to information that is already public or becomes public through no breach of this Agreement.

14. PORTFOLIO + TESTIMONIAL USE

Creative Callen will not publicly share confidential Client information.

If Creative Callen wishes to publicly feature Client work, testimonials, results, screenshots, or the completed audit for marketing or portfolio purposes, permission will be requested unless the material has already been made publicly available by the Client.

Creative Callen is not responsible for outages, data loss, technical errors, security incidents, or policy changes caused by third-party platforms outside Creative Callen’s reasonable control.

16. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Creative Callen’s total liability arising from the purchased service will not exceed the total amount paid by the Client for that specific service.

Creative Callen will not be liable for indirect, incidental, special, consequential, or lost-profit damages arising from the Client’s use of the services or implementation of recommendations.

17. INDEPENDENT CLIENT RELATIONSHIP

Nothing in this Agreement creates an employment relationship, partnership, joint venture, fiduciary relationship, or agency relationship between Creative Callen and the Client.

Creative Callen is acting as an independent creative consultant.

18. SCOPE CHANGES + ADDITIONAL SERVICES

The Digital Presence Audit includes only the services described at checkout and in this Agreement.

Any additional strategy, consulting, creative direction, content creation, implementation, management, or other services requested by the Client may require a separate agreement and additional fee.

Creative Callen may offer additional services following the audit, but the Client is under no obligation to purchase them.

19. GOVERNING LAW

This Agreement will be governed by the laws of the State of California, without regard to conflict-of-law principles.

20. ENTIRE AGREEMENT

This Agreement, together with the applicable checkout page and any written scope specifically provided for the purchased service, represents the agreement between Creative Callen and the Client regarding that service.

If there is a conflict between this Agreement and a specifically written service scope provided at checkout, the more specific service description will control with respect to that service.
