PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING THIS WEBSITE OR PURCHASING

CUSTOMER SERVICE AGREEMENT

This Customer Service Agreement (the "Agreement") is entered into between the customer (hereinafter referred to as the "Customer") and Lori Kim Wunsch, operating as Down With Digital (hereinafter referred to as the "Provider"). This Agreement outlines the terms and conditions governing the provision of digital education and online services by the Provider to the Customer.

1. SERVICES

The Provider agrees to deliver digital marketing education services—including but not limited to online courses, masterclasses, templates, and done-for-you digital materials—as described in the course or product outline provided at the time of purchase. The Customer acknowledges that the Provider is solely responsible for the creation, delivery, and content of these services and products.

2. PAYMENT

The Customer agrees to pay the full fee as outlined at checkout or via payment plan, if offered, for access to the Provider’s digital services. All payments are non-refundable, and the Customer agrees to complete all payment plan installments, if applicable, even if they choose not to use the services.

3. INTELLECTUAL PROPERTY

All course materials, content, frameworks, templates, scripts, and intellectual property provided remain the exclusive property of the Provider. The Customer is granted personal use only and agrees not to reproduce, share, distribute, or sell any materials without written consent from the Provider.

4. DISCLAIMER AND LIMITATION OF LIABILITY

a. The Provider does not guarantee any specific results from the use of digital products or participation in educational services. Outcomes will vary based on individual implementation and effort.

b. The Provider makes no warranties, express or implied, regarding the performance or effectiveness of the services or digital products.

c. The Provider shall not be liable for any indirect, incidental, consequential, or punitive damages related to the use of the services or materials provided.

5. TERMINATION

The Provider reserves the right to revoke access to the services, course materials, or community platforms at any time if the Customer violates the terms of this Agreement, including misuse of intellectual property or failure to complete payment terms. No refunds shall be granted in such cases.

6. CONFIDENTIALITY

Both parties agree to maintain the confidentiality of all business, financial, or personal information shared throughout the course or within private communities and platforms. This includes, but is not limited to, proprietary systems, customer data, and login credentials.

7. GOVERNING LAW

This Agreement shall be governed by and interpreted in accordance with the laws of the Province of Manitoba, Canada, without regard to any conflict of laws principles. Any disputes arising shall be resolved in the appropriate jurisdiction within Canada.

8. REFUNDS

Due to the nature of our digital products and instant access delivery, all sales are final. By completing your purchase, you acknowledge and agree to our No Refund Policy.

Please ensure that you have read the product description thoroughly and are aware of what you are purchasing. If you have questions before purchasing, you are encouraged to contact us.

In rare instances where a technical issue prevents you from accessing the purchased product, please notify us within 48 hours at hello@downwithdigital.ca and we will make every reasonable effort to ensure access is restored.

No refunds or credits will be issued under any circumstances except where required by applicable Canadian consumer law.

9. ENTIRE AGREEMENT

This Agreement constitutes the full understanding between the Customer and the Provider. It supersedes all prior communications, written or verbal, concerning the subject matter. Any updates or amendments to this Agreement shall be made in writing and shared with the Customer.

By completing your purchase, you acknowledge that you have read, understood, and agree to the terms outlined in this Customer Service Agreement.
