Terms & Conditions

These Terms of Use ("Terms") govern your access to and use of this website, all related websites operated by Hack or Wack LLC, and all content, products, and services offered through them (collectively, the "Site"). By accessing or using the Site, purchasing any product, or joining any email or waitlist, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Company

The Site is owned and operated by Hack or Wack LLC ("Company," "we," "us," or "our"), 2108 N St Ste N, Sacramento, CA 95816. You can reach us at hello@hackorwack.com.

2. Who may use the Site

The Site is intended for adults. You must be at least 18 years old to purchase a product, and at least 13 years old to submit anything to us or subscribe to our emails. Our content is directed at parents and other adults, not at children. If you are under 18, you may use the Site only with the involvement of a parent or guardian.

3. Intellectual property

All content on the Site — including but not limited to text, graphics, videos, guides, course materials, logos, and design — is the property of Company and is protected by copyright, trademark, and other intellectual property laws. You may view, download, and print content for your own personal, non-commercial use, and you may share links to our pages and social posts. You may not otherwise copy, reproduce, distribute, republish, sell, or create derivative works from any content on the Site, use it to train machine learning models, or remove attribution, without our prior written consent.

If you believe content on the Site infringes your intellectual property rights, please notify us at hello@hackorwack.com with enough detail to identify the work and the material in question.

4. Third-party brands and trademarks

We comment on products made and sold by other companies. Brand, retailer, and product names shown or mentioned on the Site are the trademarks of their respective owners and are used for identification, commentary, criticism, and review. We are not affiliated with, sponsored by, endorsed by, or speaking on behalf of any brand or retailer we discuss, unless we say so explicitly and disclose the relationship. Logos appearing in any portfolio, credits, or press section indicate past professional work only and do not imply any current relationship or endorsement.

5. Our content is opinion, not product testing

Our investigations show what we personally found on store racks and in products we bought or were sent. They reflect our own observations, measurements, and opinions on that day, in that store, with that item. They are not laboratory testing, independent verification, or any form of product safety certification. We do not test products for chemical content, flammability, durability, or compliance with any standard. Sizing, cut, fabric, and availability vary by store, batch, region, and over time, and a product we show may differ from the one you buy.

We work to be accurate and fair. If you believe we have stated something inaccurately, email hello@hackorwack.com and we will review it promptly and correct or remove it where correction is warranted.

6. Not professional advice

All content provided by Company — including course materials, guides, videos, social media posts, and any statements made by guest experts featured in our content — reflects personal opinions and experiences, and is intended for general informational and educational purposes only. It is not intended as, and should not be relied upon as, medical, dermatological, psychological, developmental, child-safety, legal, or other professional advice.

Company is not a licensed physician, dermatologist, occupational therapist, psychologist, or other medical or mental health professional. Any experts featured in our content speak in their individual professional capacity and their inclusion does not constitute a formal diagnosis, treatment plan, or professional relationship with you or your child. Always consult your child's pediatrician, a qualified healthcare provider, or the product manufacturer before making decisions based on content from the Site.

Results, experiences, and outcomes described by Company or by other customers are individual and are not guaranteed. What worked for one family or one child's situation may not apply to yours.

7. Affiliate links and paid relationships

We take part in the Amazon Associates programme and earn from qualifying purchases made through our shop links. We also share discount codes and accept paid partnerships from time to time. We may earn a commission or other benefit when you buy through those links or use those codes, at no additional cost to you. These relationships are disclosed wherever the links or codes appear, in accordance with the FTC's Endorsement Guides, and are set out in full in our Partnership & Endorsement Disclosure. No brand can pay for a favorable investigation, preview one before publication, or prevent one.

8. Content you send us

If you send us a message, photograph, tip, or suggestion, you keep ownership of it. You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, and publish it in our content and marketing, including on social media, with or without your name, unless you tell us otherwise in writing at the time you send it. You confirm that you have the right to send us what you send. Please do not send us photographs of children other than your own, and please do not send us anything confidential.

9. Acceptable use

  • Do not use the Site unlawfully, or to harass, threaten, or defame anyone, including the brands and people we discuss.

  • Do not attempt to gain unauthorized access to the Site, disrupt it, or scrape it by automated means without our written permission.

  • Do not share course logins, resell access, or use our materials to teach or build a competing course.

  • Do not use our name, marks, or content in a way that suggests we endorse you, your products, or your services.

We may suspend or terminate your access to the Site or to any product, without refund, if you breach these Terms.

10. Third-party links

The Site links to other websites, shops, and platforms that we do not control. We are not responsible for their content, products, terms, or privacy practices, and including a link is not a guarantee of anything you find there.

11. Privacy

Our Privacy Policy explains what personal information we collect and how we use it, and forms part of these Terms. By subscribing to our emails you consent to receive them; you can unsubscribe at any time using the link in any message.

12. No warranties

The Site and all products are provided "as is" and "as available," without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Company does not warrant that the Site or any product will be error-free, uninterrupted, or meet your specific requirements.

13. No earnings or outcome guarantees

Company makes no guarantees regarding any specific results, savings, or outcomes from using our products, guides, or courses. Any examples of results shared by Company or other customers are illustrative only and not a promise of similar results for you.

14. Payment and refunds

Prices are shown at checkout in US dollars and you are responsible for any applicable taxes. Purchases of digital products are final and no refunds are issued once a purchase is completed, except where a refund is required by law. Please review all product descriptions carefully before purchasing.

Consumers in the European Union and the United Kingdom have a statutory right to cancel a purchase within 14 days. That right can be waived for digital content only where the customer expressly consents to immediate delivery and acknowledges the loss of the cancellation right at the point of purchase. Where the right applies and has not been validly waived, it overrides the paragraph above.

Presale purchases made before the course's official launch grant early access at the price and terms shown at checkout; course content becomes available starting September 30, 2026. Purchasing during the presale does not entitle you to immediate access, and the no-refund policy above applies to presale purchases the same as any other purchase.

15. Limitation of liability

To the fullest extent permitted by law, Company shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or in connection with your use of the Site or any product, including but not limited to damages for loss of profits, data, or other intangible losses. Company's total liability for any claim relating to the Site or a product will not exceed the greater of the amount you paid Company in the twelve months before the claim, or US$100. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, and some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

16. Indemnification

You agree to indemnify and hold harmless Company, its owners, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Site or violation of these Terms.

17. Dispute Resolution: Arbitration and Class Action Waiver

Any dispute arising out of or relating to these Terms, the Site, or any product will be resolved through binding individual arbitration rather than in court, except that either party may bring an individual claim in small claims court where eligible. You and Company each waive any right to participate in a class action, class arbitration, or representative action against the other. This section does not apply to the extent it would eliminate a consumer protection right that cannot lawfully be waived in your country of residence, including statutory rights available to consumers in the European Union and United Kingdom.

18. Governing law and venue

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Sacramento County, California.

19. General

If any provision of these Terms is found unenforceable, the remaining provisions stay in full force. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a sale or reorganization of the business. These Terms, together with our Privacy Policy, Disclaimers, Partnership Disclosure, and Course Terms, are the entire agreement between you and Company regarding the Site.

20. Changes to these Terms

Company reserves the right to update or modify these Terms at any time. The effective date above will change, and continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
