By using this website, you signify your consent to these Terms of Use. If you do not agree to these Terms, please do not use the website.
1. General Information
Your access to and use of this website, as well as all related websites operated by Harry Allsop and Black Noir Marketing (which includes blacknoirmarketing.com, and the Harry Allsop Stan Store, among others) (collectively the “Site”), is subject to the following Terms and Conditions (“Terms of Use”) and all applicable laws. By accessing and browsing the Site, you accept, without limitation or qualification, these Terms and acknowledge that any other agreements between you and the Site are superseded and of no force or effect.
2. Ownership and Use of Content
You agree that the Site itself, as well as all content, videos, training materials, products, services and/or other materials, made available on the Site by us or other third parties, as well as the overall look and feel of all of the foregoing (collectively referred to as the “Content”), are maintained for your personal use and information by Harry Allsop / Black Noir Marketing (“the Company”) and are the property of the Company and/or its third-party providers.
You agree that such Content includes, without limitation, all proprietary videos, tutorials, written guides, PDFs, graphics, artwork, photographs, sound recordings, and text. Subject to your compliance with these Terms of Use, the Company grants you a limited, non-exclusive, non-transferable licence to access and use the Site solely for your personal, non-commercial use.
No Company Content may be copied, reproduced, republished, uploaded, posted, transmitted, distributed, or used for public or commercial purposes without written permission from the Company.
3. Intellectual Property
All Content contained in the Site is protected by copyright unless otherwise stated and remains the property of the Company or its suppliers. All trade names, trademarks, and images used in the Company Content are either owned by, or used with permission from, the Company.
Any unauthorised use of the Content may violate copyright, trademark, or other laws and is strictly prohibited.
If you believe that your intellectual property rights have been infringed, please contact harryvfx@icloud.com with full details, including your name, contact information, proof of ownership, and a description of the alleged violation.
4. Accuracy of Information
While the Company makes reasonable efforts to ensure that the information provided on the Site is accurate and up-to-date, it makes no guarantees or warranties as to its accuracy. The Company accepts no liability for any errors or omissions.
5. Communications
By registering with the Company and/or the Site, you consent to receive communications electronically, including notices, updates, and promotional materials relevant to your purchase or account.
6. Submissions and Feedback
If you send comments, suggestions, or creative ideas to the Company (such as notes, text, images, or designs), such submissions shall become the sole property of the Company and may be used without restriction, acknowledgement, or compensation.
7. Data and Security
The Company uses commercially reasonable efforts to secure your data. However, no online system is completely secure. You acknowledge that unauthorised access or data breaches, while unlikely, may occur, and you use the Site at your own risk.
Your personal information will be handled in accordance with our Privacy Policy, available on the Site.
8. Limitation of Liability
Under no circumstances shall the Company, or any party involved in creating or maintaining the Site, be liable for any direct, incidental, consequential, or indirect damages arising from your use of the Site or its Content.
All Content is provided “as is”, without warranty of any kind. You assume full responsibility for evaluating the suitability of materials or products purchased.
9. Third-Party Services
The Company is not responsible for issues caused by third-party providers (including payment processors such as Stripe, or hosting services). Any such issues will be governed by the agreement between you and that provider.
10. Refund Policy
Due to the digital nature of the products (including but not limited to downloadable tutorials, guides, and templates), all sales are final. Once a product has been purchased and delivered, no refunds or exchanges will be provided under any circumstances.
This also applies to 1-to-1 coaching calls, digital consultations, and private community memberships.
By purchasing, you agree to these terms and understand that digital and coaching services are deemed “used” once access has been granted.
Refunds will only be considered in the rare case of duplicate payment or technical delivery failure. In such cases, please contact harryvfx@icloud.com within 7 days of purchase.
11. Coaching Calls and Scheduling
If your purchase includes a 1-to-1 call, you are responsible for scheduling it using the provided booking system.
All calls are non-refundable.
If you wish to reschedule, you must email harryvfx@icloud.com at least 48 hours before your scheduled call. Failure to attend or cancel within this timeframe will result in the session being forfeited without refund.
12. Indemnification
You agree to indemnify and hold harmless the Company, its directors, employees, and agents from any claims, damages, or expenses arising out of your breach of these Terms, your misuse of the Site, or your violation of any third-party rights.
13. Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of England and Wales.
You agree to submit to the exclusive jurisdiction of the courts of England and Wales in respect of any disputes arising out of or related to these Terms.
14. Revisions
The Company reserves the right to update or amend these Terms of Use at any time without prior notice. Continued use of the Site following such changes constitutes your acceptance of the revised Terms.
