Anchored to Rise, LLC Terms and Conditions

Effective date: September 12, 2026

These Terms and Conditions (the “Terms”) are an agreement between you and Anchored to Rise, LLC, which offers products, content, and services through Jess Kachelman and the brands Sensitive Women Rising and @jesskachelman (“Anchored to Rise,” “Jess Kachelman,” “Sensitive Women Rising,” “SWR,” “we,” “us,” or “our”). They apply to your access to and use of our websites, social-media accounts, Stan Store, checkout pages, email sign-up forms, digital products, courses, workshops, memberships, communities, group programs, downloads, recordings, templates, prompts, and related services (collectively, the “Services”).

By visiting, purchasing, enrolling, subscribing, joining a waitlist, downloading a resource, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use or purchase the Services.

1. Eligibility

You must be at least 18 years old and legally able to enter into a binding agreement to purchase or enroll. By using the Services, you represent that you meet these requirements and that the information you provide is accurate and current.

2. Educational Purpose and Scope

Anchored to Rise, LLC provides nonclinical education, personal-development information, reflection tools, and practical resources through Jess Kachelman, Sensitive Women Rising, and @jesskachelman. Some Services may discuss sensitivity, emotional intelligence, relationships, friendship, boundaries, self-trust, stress, burnout, content creation, or business.

The Services are not psychotherapy, counseling, medical care, mental-health treatment, diagnosis, legal advice, financial advice, or another licensed professional service. They are not a substitute for individualized care from a qualified professional. Nothing in the Services creates a therapist-client, physician-patient, attorney-client, fiduciary, or similar professional relationship.

Do not use the Services to diagnose or treat a health or mental-health condition. If you are experiencing a medical or mental-health emergency, contact emergency services or an appropriate licensed professional.

You remain responsible for your own choices, actions, relationships, business decisions, and well-being. You should use your judgment and seek qualified professional support when appropriate.

3. No Guarantee of Results

We aim to provide thoughtful and useful educational material, but individual experiences and results vary. We do not guarantee a particular emotional, relational, personal, audience, revenue, business, or financial outcome. Testimonials, examples, audience-growth figures, case studies, and past results illustrate individual experiences and do not promise that you will achieve the same result.

4. Offer Descriptions

The description, price, schedule, delivery method, access period, included materials, refund terms, and other details displayed on an offer’s checkout or sales page become part of these Terms for that purchase.

We make reasonable efforts to describe each Service accurately. Minor updates to titles, examples, formatting, platforms, lesson order, or delivery details may occur when they do not materially reduce the value of the Service.

If an offer-specific term conflicts with these general Terms, the offer-specific term controls for that purchase.

5. Purchases and Payment

Prices are shown in the currency displayed at checkout. You authorize our payment processor to charge the payment method you provide for the stated purchase price, applicable taxes, and any recurring or installment payments disclosed at checkout.

You are responsible for providing complete billing information and for keeping your payment method current. We may suspend access when a payment fails, is reversed, or remains overdue.

Payment processing is handled by third-party providers such as Stan, Stripe, or PayPal. Their terms and privacy practices also apply to their services. We do not control their systems and do not receive your complete payment-card information.

6. Taxes

You are responsible for taxes, duties, or similar charges associated with your purchase unless applicable law requires us or our payment processor to collect them. Any tax collected at checkout is based on the information available to the payment processor, including your location and the type of product or service purchased.

7. Digital Delivery and Access

Digital products and access instructions are delivered to the email address provided at checkout or sign-up. You are responsible for entering the correct email address, checking spam or promotional folders, and contacting us promptly if access does not arrive.

Unless an offer states otherwise, your purchase provides one individual, revocable, nontransferable license to access and use the materials for personal purposes. “Lifetime access” means access for as long as we continue to host and offer that product in its current or substantially similar form. It does not mean the lifetime of the purchaser or guarantee that a third-party platform will operate indefinitely. If we permanently retire a lifetime-access product, we will make reasonable efforts to provide advance notice or a reasonable opportunity to download available materials.

You are responsible for having a compatible device, internet connection, email account, and any software clearly identified as necessary for access.

8. Refunds

The refund policy stated on the applicable sales page or checkout page controls your purchase. Some digital products may be final sale because access is delivered immediately. Other offers may include a specifically described refund promise or request period.

When no separate refund policy is stated, purchases of immediately accessible digital products, downloads, recordings, courses, workshops, and resources are final sale and nonrefundable, except where required by law.

To request a refund under an offer-specific policy, contact us within the stated period and satisfy any clearly disclosed eligibility requirements. Missing the deadline, changing your mind, not using the materials, lacking time, or failing to complete the Service does not create a refund right unless the offer-specific policy or applicable law says otherwise.

Nothing in these Terms limits a refund, cancellation, withdrawal, or consumer-protection right that cannot legally be waived.

9. Memberships, Subscriptions, and Payment Plans

If you purchase a recurring membership or subscription, you authorize automatic charges at the price and frequency shown at checkout until you cancel. You may cancel future renewals using the method provided in your account or by contacting us. Cancellation takes effect at the end of the current paid billing period unless applicable law requires otherwise. Fees already charged are not prorated or refunded unless the offer-specific policy or applicable law provides otherwise.

A payment plan is a commitment to pay the full purchase price in installments, not a month-to-month subscription. Leaving a program, losing access because of a conduct violation, or choosing not to participate does not cancel remaining installments unless the offer-specific terms or applicable law say otherwise.

Any renewal, minimum commitment, fixed term, and cancellation method will be disclosed at checkout. We will provide notices required by applicable law.

10. Live Sessions, Communities, and Group Programs

Some Services may include live calls, discussion spaces, comments, messaging groups, or peer interaction. Participation is voluntary. You control what you share and should not disclose information you would not want other participants to know.

We ask participants to treat personal stories shared by others as confidential. However, we cannot guarantee that another participant will maintain confidentiality. Anchored to Rise, LLC and Jess Kachelman are not responsible for another participant’s statements, conduct, advice, screenshots, recordings, or disclosures.

You may not record, photograph, screenshot, copy, or distribute another participant’s image, voice, story, message, or identifying information without that person’s clear permission. We will disclose in advance if an official session is recorded and how that recording may be used.

We may remove content or restrict or end participation when reasonably necessary to protect participants, enforce these Terms, or maintain the purpose of the community. Prohibited conduct includes harassment, threats, discrimination, impersonation, solicitation without permission, spam, unlawful activity, sharing confidential information, and infringement of intellectual-property or privacy rights.

11. Intellectual Property

All Services and materials provided by Anchored to Rise, LLC through Jess Kachelman, Sensitive Women Rising, or @jesskachelman, including text, videos, audio, workbooks, prompts, methods, frameworks, graphics, downloads, templates, scripts, branding, and course materials, are owned by or licensed to Anchored to Rise, LLC and are protected by intellectual-property laws.

This includes original materials and names used by Jess Kachelman, Sensitive Women Rising, or @jesskachelman, including Connected, But Still Uncertain: The Friendship Discernment Method, the Friendship Discernment Map, the Protective Cycle, RISE, and related exercises and scripts, whether or not a particular name is registered as a trademark.

Your purchase does not transfer ownership. Unless we give you written permission, you may not reproduce, upload, publish, sell, sublicense, teach from, distribute, translate, adapt, share, or create a competing or derivative product from the materials. You may not share login information or provide purchased materials to another person, group, client, customer, membership, or organization.

You may download or print materials only for your own individual use when that function is provided. Brief quotations for commentary or review must comply with applicable law and include appropriate attribution.

12. Content You Submit

You retain ownership of original content you submit. You give us a limited license to store, process, display, and use that content only as reasonably necessary to provide, moderate, improve, or support the Service.

You represent that you have the right to submit your content and that it does not violate another person’s rights or the law. Do not submit confidential information belonging to someone else.

We will not use your private message, story, image, or identifying information as a public testimonial or marketing asset without separate permission. If you voluntarily submit a testimonial for promotional use, any permission and attribution terms presented with that request will apply.

13. Artificial Intelligence Tools and Prompts

Some Services may include optional prompts or instructions for use with third-party artificial intelligence tools. AI output may be incomplete, inaccurate, biased, or inappropriate. Review output carefully and do not treat it as professional advice or as a reliable determination of another person’s intentions, diagnosis, or character.

Do not enter private, confidential, medical, financial, or identifying information about yourself or another person into an AI service unless you understand and accept that service’s terms and privacy practices. Your use of a third-party AI service is governed by that provider’s terms.

14. Third-Party Platforms and Links

The Services may rely on or link to third-party platforms, including Stan, Stripe, PayPal, Zoom, Telegram, Google, Canva, social-media platforms, and email providers. We are not responsible for a third party’s content, availability, security, policies, changes, or conduct.

We may provide a reasonable alternative when a third-party change materially interferes with a paid Service, but we cannot guarantee uninterrupted access to any third-party platform.

15. Email Communications and Marketing

We may send transactional or relationship emails needed to deliver a purchase or requested resource, provide access, communicate program information, address security or billing issues, or notify you of material changes.

When a form clearly states that signing up, joining, purchasing, or enrolling includes marketing emails from Jess Kachelman and Sensitive Women Rising, your submission indicates your request or consent to receive those communications as permitted by applicable law. Marketing emails will identify the sender and include a way to unsubscribe. You may unsubscribe from marketing at any time, but you may still receive nonmarketing messages necessary to deliver or administer an active purchase, membership, or account.

16. Privacy

Our collection and use of personal information are also governed by our Privacy Policy and by the privacy policies of the platforms you choose to use. Please do not submit more personal information than is reasonably necessary to receive the Service.

17. Acceptable Use

You may not use the Services to violate the law, infringe another person’s rights, interfere with the Services, bypass access controls, introduce malicious code, scrape or harvest information, misrepresent your identity, or use the materials to train an artificial intelligence model without written permission.

18. Availability, Changes, and Cancellation by Us

We may perform maintenance, correct errors, update content, change platforms, or temporarily interrupt access. If we cancel a paid Service before providing the material portion promised, we will offer an appropriate replacement, credit, or refund based on what was delivered and as required by law.

We may discontinue free resources, waitlists, bonuses, community features, or unsupported platforms at any time. We may also modify these Terms prospectively as described below.

19. Disclaimers

To the fullest extent permitted by law, the Services are provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, title, and noninfringement. We do not warrant that the Services will be uninterrupted, error-free, completely secure, or suitable for every person or situation.

Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, these exclusions apply only to the extent permitted by law.

20. Limitation of Liability

To the fullest extent permitted by law, Anchored to Rise, LLC, Jess Kachelman, and their contractors and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, opportunities, goodwill, or business interruption arising from or related to the Services.

To the fullest extent permitted by law, our total liability for a claim relating to a paid Service will not exceed the amount you paid us for the specific Service giving rise to the claim during the twelve months before the event that created the claim. For a free Service, our total liability will not exceed $100.

These limitations do not apply where prohibited by law or to liability that cannot legally be limited.

21. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Anchored to Rise, LLC, Jess Kachelman, and their contractors and service providers from third-party claims, damages, or reasonable costs arising from your unlawful use of the Services, your violation of these Terms, your infringement of another person’s rights, or content you submit. This section does not require you to indemnify anyone for their own unlawful conduct.

22. Termination

You may stop using the Services at any time, subject to any payment-plan or fixed-term commitment. We may suspend or terminate access if you materially violate these Terms, fail to pay, misuse the materials, threaten safety, or disrupt a Service or community.

Sections that by their nature should continue after termination will survive, including payment obligations, intellectual property, disclaimers, limitations of liability, dispute provisions, and other accrued rights.

23. Governing Law and Disputes

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles. Before filing a formal claim, you and Anchored to Rise, LLC agree to make a good-faith effort to resolve the dispute informally by written notice describing the issue and requested resolution.

If the dispute is not resolved informally, the parties consent to the state or federal courts with jurisdiction where Anchored to Rise, LLC maintains its principal place of business in Georgia, except where applicable consumer law gives you the right to bring a claim elsewhere.

Nothing in these Terms prevents either party from bringing an eligible claim in small-claims court or seeking urgent injunctive relief. Nothing waives a consumer right or remedy that cannot legally be waived.

24. Changes to These Terms

We may update these Terms to reflect changes in the Services, platforms, or law. The effective date at the top will show when the Terms were last revised. Material changes will apply prospectively, and we will provide notice when required by law. The version accepted at the time of purchase will continue to govern that purchase to the extent required by law.

25. General Provisions

These Terms, the applicable offer page, checkout disclosures, refund policy, and Privacy Policy form the agreement between you and Anchored to Rise, LLC regarding the Services offered through Jess Kachelman, Sensitive Women Rising, or @jesskachelman. If a court finds part of these Terms unenforceable, the remaining provisions will continue in effect, and the affected provision will be enforced to the maximum extent permitted by law.

Our failure to enforce a provision is not a waiver. You may not transfer your rights or obligations under these Terms without our written permission. We may transfer these Terms as part of a reorganization, sale, or transfer of the business, subject to applicable law.
