Terms & Conditions
The Container Agreement

This is a sacred container. Everything offered through KAIT DON — the 5D Framework workshops, the 5D Zine, coaching, and all future offers — is built on the principle that transformation requires integrity on both sides of the exchange. These terms exist not to create distance, but to protect the energetic clarity of this work and to clearly define the rights and responsibilities of all parties.
By purchasing, enrolling in, clicking “I Agree,” or otherwise engaging with any offer from KAIT DON, you are entering into a legally binding agreement and confirming that you have read, understood, and agreed to these terms in full.
1. Eligibility & Agreement to Terms
You must be at least 18 years of age to purchase or participate in any KAIT DON offer. By purchasing, you confirm that you are of legal age and have the legal capacity to enter into this agreement. If you are accessing content on behalf of a business or organization, you confirm that you have authority to bind that entity to these terms.
These Terms & Conditions constitute the entire agreement between you and KAIT DON and supersede any prior discussions, representations, or agreements. No verbal or informal agreements modify these terms unless confirmed in writing by KAIT DON.
2. Governing Law & Jurisdiction
These Terms & Conditions are governed by and construed in accordance with the laws of the State of Alaska, United States, without regard to conflict of law provisions. You agree that any legal action or proceeding related to your use of KAIT DON services shall be brought exclusively in a court of competent jurisdiction in Fairbanks, Alaska. You consent to the personal jurisdiction of such courts.
3. The Container: Availability & Communication
This work is real. I show up fully for it, and I ask the same of you. To protect the quality of this container, clear boundaries around time and access are non-negotiable.
Office Hours
I am available Tuesday–Thursday, 11:00 AM–7:00 PM AKST. I may work outside these hours, but I am not available for messaging, feedback, or calls unless prearranged.
I am generally unavailable Friday–Monday. If you require time during those days, please reach out at least 7 days in advance.
Messages sent after 7:00 PM or outside scheduled days will be responded to during the next available business window, within 48 hours.
Communication Agreements
I primarily communicate via email for clarity and documentation. Email: kait@kaitdon.com.
Quick check-ins are available to ongoing clients but should remain concise and purposeful.
Excessive, repetitive, or hostile messaging will result in a pause of support and may require a reset conversation before services resume.
KAIT DON does not provide emergency or crisis support. If you are in crisis, please contact a licensed mental health professional or emergency services.
4. Nature of Services & Important Disclaimers
What This Work Is
The 5D Framework is an integration method rooted in lived expertise, energetic awareness, and the belief that you already hold what you need. My role is to hold space and offer tools. It is not my role to fix, rescue, or carry your transformation.
What I Am Not
KAIT DON does not provide therapy, counseling, medical advice, legal advice, financial advice, or any licensed professional services.
I am not a licensed therapist, psychologist, physician, attorney, or financial advisor. Nothing shared through KAIT DON — including workshops, written materials, coaching conversations, social media content, or the 5D Zine — constitutes or replaces professional advice in these areas.
All content is provided for educational and personal development purposes only. You are fully responsible for your own decisions, wellbeing, and results. Results are not guaranteed. Any outcomes described or referenced are illustrative, not promises of what you will experience.
Mental Health Acknowledgment
This work may involve decolonization, identity exploration, unmasking, and examining internalized systems. This can bring up difficult emotions or memories. You acknowledge that you are responsible for your own mental health support throughout this process and that you will seek professional help if needed. KAIT DON is not liable for emotional responses to this work.
5. Digital Products & Workshops
5D Framework Workshops & Waitlist
Workshop content is educational and experiential. Each dimension builds toward your own integration, at your own pace.
Waitlist enrollment is not a guarantee of a specific cohort date or placement. Enrollment order, alignment, and capacity determine placement.
If a waitlisted cohort does not open within 12 months of your enrollment, you may request a credit toward a future offer. No cash refunds will be issued for waitlist positions.
Workshop materials, slides, recordings, and handouts are proprietary and for personal use only.
5D Zine & Digital Products
The 5D Zine and all digital materials are delivered as personal-use resources only and are not for redistribution, resale, or reproduction.
Digital products are delivered via email or platform link. You are responsible for ensuring compatibility with your device or platform. No refunds will be issued for compatibility challenges.
In the event of a technical delivery failure on our end, we will make reasonable efforts to re-deliver the product within 5 business days.
6. Intellectual Property
The 5D Framework, the 5D Zine, the 9 Gates framework, The Unmasking & Self-Led Integration Method™, and all associated content, frameworks, language, visuals, and materials developed through KAIT DON are original intellectual property of Kait Donnelly / KAIT DON, protected under United States copyright law.
Upon full payment, you receive a limited, non-exclusive, non-transferable personal-use license to content created for or delivered to you.
You may not resell, redistribute, publish, teach from, sub-license, or create derivative works from any KAIT DON materials without explicit written permission.
Screenshots, screen recordings, or reproductions of live or recorded workshop content are strictly prohibited without prior written consent.
You may not use any KAIT DON content — in whole or in part — to train, fine-tune, or otherwise develop artificial intelligence or machine learning models.
You may not scrape, crawl, or systematically extract content from KAIT DON websites, platforms, or materials.
KAIT DON retains the right to showcase work, testimonials, and client results for promotional purposes unless otherwise agreed in writing.
Violations of this section may result in immediate termination of access, legal action, and/or financial damages. KAIT DON reserves the right to pursue all available legal remedies for infringement.
7. Payment & Energy Exchange
Every exchange in this container is intentional. Payment is part of the energetic agreement, not an afterthought.
All payments are collected via Stan Store, Stripe, PayPal, or other approved platforms. No services begin without full payment or a written, approved payment plan.
Stripe is recommended for best reliability. PayPal may delay access or deduct processing fees.
You are responsible for any applicable processing fees, taxes, or currency conversion charges.
All prices are listed in USD unless otherwise stated.
Payment plans, where offered, must be completed in full. Failure to complete a payment plan will result in suspension of access to services and materials until the balance is resolved.
8. Refund Policy
ALL SALES ARE FINAL.
Due to the energetic, time-sensitive, and digital nature of this work, no refunds, exchanges, or cancellations will be granted unless explicitly stated in a specific offer’s terms or confirmed in writing by KAIT DON.
Any refund offered is at the sole discretion of KAIT DON and will be considered on a case-by-case basis, not as a standing policy.
Disrespectful communication, last-minute cancellations, and buyer’s remorse do not qualify for refund consideration.
If KAIT DON cancels a paid offer without rescheduling, you will receive a full credit or refund for that specific offer.
Chargebacks
Initiating a chargeback or payment dispute without first contacting KAIT DON at kait@kaitdon.com and allowing a 10-business-day resolution window will immediately revoke access to all materials and services and may result in a permanent ban from future offers. KAIT DON will dispute any unjust chargebacks to the fullest extent allowed by the payment processor and applicable law, and reserves the right to seek recovery of any associated fees or costs.
9. Session Agreements
When you book time with me, you’re not just booking a calendar slot. You’re entering a container. Show up like it matters to you, because it does.
All sessions must be booked at least 48 hours in advance through the designated booking system.
Cancellations made with less than 24 hours’ notice will not be rescheduled or refunded.
No-shows forfeit the session in full with no credit or reschedule.
You are expected to show up on time, fully present, and in integrity with the commitment you made to yourself.
Sessions may not be recorded by the client without prior written consent from KAIT DON.
10. Revisions & Feedback (Social Media & Content Services)
You will receive drafts with a 48-hour review window before posting or delivery.
You are entitled to one round of revisions per deliverable unless otherwise stated in your service agreement.
Additional edits beyond the included round will be invoiced at the current hourly rate.
Failure to provide feedback within the 48-hour window may result in the deliverable being marked complete.
11. Name, Likeness & Testimonials
By engaging with KAIT DON services and providing feedback, reviews, or testimonials (whether verbally, via email, or in writing), you grant KAIT DON a non-exclusive, royalty-free, perpetual license to use your first name, general location, and the content of your testimonial for promotional purposes across platforms including but not limited to social media, website, and marketing materials.
Last names, photos, or identifying details will not be used without separate explicit written consent. You may revoke this license at any time by contacting kait@kaitdon.com; revocation will apply to future use and does not require removal of previously published materials.
12. Container Integrity & Mutual Respect
This work is energetic. The container only works if both of us are in it with integrity.
Disrespect, entitlement, manipulation, harassment, threats, or boundary-pushing toward KAIT DON or other participants will not be tolerated.
KAIT DON reserves the right to pause or close the container at any time for conduct violations, with no refund issued.
You may terminate our agreement with 30 days’ written notice to kait@kaitdon.com. No refunds will be issued for unused time unless separately negotiated in writing.
KAIT DON may also close a container early if it is determined to no longer be in alignment, with notice provided as soon as reasonably practicable.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KAIT DON, ITS OWNER, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE ANY KAIT DON SERVICES OR MATERIALS.
KAIT DON’s total liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid by you for the specific service or product giving rise to the claim. This limitation applies even if KAIT DON has been advised of the possibility of such damages.
14. Indemnification
You agree to indemnify, defend, and hold harmless KAIT DON, its owner Kait Donnelly, contractors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with: (a) your access to or use of KAIT DON services or materials; (b) your violation of these Terms & Conditions; (c) your violation of any third-party rights; or (d) any claim that your conduct caused damage to a third party.
15. Force Majeure
KAIT DON shall not be held liable for any failure or delay in performance of services arising from circumstances beyond reasonable control, including but not limited to: illness, injury, family emergency, natural disaster, government action, internet or platform outages, cyber incidents, acts of God, or other unforeseeable events (“Force Majeure Events”). In the event of a Force Majeure Event, KAIT DON will provide notice as soon as reasonably practicable and will work in good faith to reschedule or adjust services. No refunds will be issued for Force Majeure Events unless KAIT DON is unable to reschedule within a reasonable timeframe, in which case a credit will be offered.
16. Privacy & Data
KAIT DON collects and uses your personal information (name, email, payment information) solely for the purpose of delivering services, communicating with you, and improving offerings. Your data will not be sold to third parties. Payment data is processed and stored by third-party processors (Stripe, PayPal, Stan Store) subject to their own privacy policies. By engaging with KAIT DON, you consent to the collection and use of your information as described.
17. Dispute Resolution
We agree to try to resolve any disagreements with direct, respectful communication first. Please contact kait@kaitdon.com before initiating any formal dispute process.
If direct resolution is not possible within 30 days, the parties agree to attempt resolution through good-faith mediation before pursuing arbitration or litigation. Any legal action shall be governed by the laws of the State of Alaska and filed in Fairbanks, Alaska.
Nothing in this section prevents KAIT DON from seeking injunctive or other equitable relief for intellectual property violations or conduct that may cause irreparable harm.
18. Severability
If any provision of these Terms & Conditions is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions. The remaining terms will continue in full force and effect.
19. Modifications to Terms
KAIT DON reserves the right to update or modify these Terms & Conditions at any time. Changes will be posted with an updated “Last Updated” date. Your continued engagement with KAIT DON services after any modification constitutes your acceptance of the updated terms. It is your responsibility to review these terms periodically.
