PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING THIS WEBSITE OR PURCHASING
These Terms & Conditions apply to all digital products sold by Kandie's Digital Studio, a trade name of Kandie's Scents, LLC (the Company), including digital downloads, PDFs, e-books, workbooks, guides, planners, checklists, and Canva templates.
By purchasing, downloading, accessing, or using any digital product, you agree to these Terms & Conditions.
1. Digital Products
Digital products include, without limitation: e-books, workbooks, guides, planners, checklists, trackers, and worksheets; printable files and PDF downloads; editable Canva templates and Canva links; and any supporting files or resources delivered digitally.
2. License: Personal and Business Use Only
Your purchase grants a limited, non-exclusive, non-transferable, non-sublicensable license to use the digital product for personal use and internal use within your own business (for example, using templates for your own marketing or using trackers to run your business). You may print the files for your own use and you may fill them out digitally for your own use. You do not own the product. You are purchasing a license to use it.
3. Prohibited Uses
You may not:
• Resell, redistribute, share, gift, or transfer the digital product or any part of it.
• Share or publish Canva links or editable templates with anyone who did not purchase.
• Upload files to shared drives, groups, memberships, forums, or marketplaces for others to access.
• Claim the product as your own, remove copyright notices, or rebrand it.
• Create derivative templates for resale, even if modified.
• Use the product to create competing digital products, templates, or printables for sale.
Commercial use is allowed only for your own business use of the finished content, such as using a social media template to create posts for your brand or using a label template for your products. You may not sell the template itself.
4. Intellectual Property
All digital products and all related content are the property of the Company and are protected by copyright, trademark, and other intellectual property laws. No rights are transferred to you except the limited license stated in these Terms & Conditions.
5. Delivery and Access
Digital products are delivered electronically through download links, Canva links, email delivery, or account access depending on the platform used at checkout. You are responsible for entering a valid email address at checkout, maintaining access to the email address and any account used to purchase, and ensuring your device and software can open the files.
6. Returns, Refunds, and Exchanges
Due to the nature of digital products, all sales are final once access is delivered. the Company does not offer refunds or exchanges for digital products.
Limited exceptions may be granted at the Company's discretion: duplicate purchases of the same product; verified delivery failure that cannot be resolved after reasonable troubleshooting; or product unavailable after purchase but before delivery. If an exception applies, the Company may provide replacement access or a refund of the purchase price.
7. Pricing and Promotions
Prices may change at any time. the Company does not provide refunds or price adjustments due to promotions, discounts, or price changes after purchase.
8. Educational Use and No Guarantees
All information, templates, and resources are provided for educational and informational purposes only. the Company does not guarantee results, income, business outcomes, or earnings. Your results depend on your effort, experience, market, and other factors.
9. Disclaimer of Warranties
Digital products are provided "as is" and "as available." the Company makes no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
10. Limitation of Liability
To the maximum extent permitted by law, the Company is not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of your purchase, access, or use of digital products, including loss of profits, loss of data, or business interruption.
11. Third-Party Platforms and Services
Some products may be accessed through third-party services (including Canva, Stripe, and PayPal). the Company is not responsible for third-party outages, account issues, platform limitations, or service interruptions. Your use of third-party services is governed by their terms.
12. Chargebacks and Payment Disputes
Unauthorized chargebacks or payment disputes may result in loss of access to digital products and restrictions on future purchases. the Company may provide order confirmation, access confirmation, and delivery records to payment processors.
13. User Submissions
If you submit feedback, testimonials, suggestions, or other materials to the Company, you grant the Company permission to use them for business purposes, including marketing, without compensation. If you prefer your name not be used, you can request anonymity.
14. Privacy
Your purchase and use of the Company's products are subject to the Company's Privacy Policy.
15. Indemnification
You agree to indemnify and hold harmless the Company and its owners, employees, and contractors from any claims, losses, liabilities, damages, and expenses arising from your misuse of the digital products or violation of these Terms & Conditions.
16. Governing Law and Venue
These Terms & Conditions are governed by the laws of the State of Tennessee. Any disputes will be handled in the state or federal courts located in Shelby County, Tennessee.
17. Updates to Terms
the Company may update these Terms & Conditions at any time by posting an updated version. Continued use of digital products after changes are posted constitutes acceptance of the updated terms.
