TERMS AND CONDITIONS

Effective Date: July 28, 2026

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THIS WEBSITE OR MAKING A PURCHASE

These Terms and Conditions govern your access to and use of the websites, checkout pages, payment links, online platforms, courses, programs, digital products, educational materials, coaching services, calls, memberships, and other products or services offered under the name Figure Dont Fold Enterprises.

Kash Figures Enterprises is a public-facing brand operated by Figaro Flow Enterprises [ Stan store, INSERT EXACT LEGAL SUFFIX, IF APPLICABLE], referred to throughout these Terms as the “Company,” “we,” “us,” or “our.”

By visiting our website, checking the acknowledgment box during checkout, submitting payment, creating an account, downloading materials, attending a class or call, or accessing any Company product or service, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.

If you do not agree with these Terms, do not use the website, complete a purchase, or access the Company’s products or services.

1. EDUCATIONAL AND PERSONAL-DEVELOPMENT PURPOSE

Kash Figures Enterprises provides educational information, resources, courses, digital products, coaching, and personal-development content focused on topics that may include financial literacy, financial habits, personal growth, goal setting, mindset transformation, manifestation practices, business education, and related subjects.

All information provided by the Company is offered for general educational and informational purposes only. It is not individualized legal, financial, tax, accounting, investment, mental-health, or other licensed professional advice.

The Company does not guarantee any particular financial result, credit result, funding approval, income level, business result, personal transformation, debt-related result, or other specific outcome. Results depend on numerous individual factors, including the purchaser’s circumstances, participation, effort, decisions, knowledge, skills, consistency, finances, and implementation.

References to mindset, manifestation, abundance, goal setting, or personal development are educational concepts and do not constitute promises or guarantees that a particular event or financial result will occur.

2. PAYMENT AND AUTHORIZATION

You agree to pay the full advertised price for every product or service you purchase, together with any applicable taxes, processing charges, payment-plan amounts, or other clearly disclosed fees.

By submitting payment information, you represent that:

  • You are authorized to use the payment method provided.

  • The payment information is accurate and complete.

  • You authorize the Company and its payment processors to charge the applicable amount.

  • You understand the product or service you are purchasing.

  • You have reviewed and accepted these Terms, including the No-Refund Policy.

Failure to use, access, download, attend, complete, or benefit from a purchased product or service does not eliminate your payment obligation.

Prices, promotions, bonuses, and product offerings may be changed or discontinued at any time. The Company does not provide retroactive discounts, price adjustments, or refunds because a product is later offered at a lower price.

3. DIGITAL DELIVERY

Digital products may include courses, recordings, classes, templates, guides, workbooks, documents, downloads, links, portal access, private-community access, educational resources, or other electronically delivered materials.

A digital product is considered delivered when any of the following occurs:

  • A download link is provided.

  • Login credentials or portal access are issued.

  • The purchaser is added to a class, membership, group, or community.

  • Materials are emailed or otherwise electronically transmitted.

  • A recording, replay, document, or resource is made available.

  • Access instructions are sent to the email address or contact information supplied by the purchaser.

You are responsible for providing an accurate email address and checking your inbox, spam, junk, promotions, and other email folders.

Technical difficulty on the purchaser’s device, failure to check email, loss of login credentials, lack of compatible software, scheduling conflicts, internet interruptions, or failure to access available materials does not make the purchase refundable.

You must contact figureskash@gmail.com for reasonable assistance with a legitimate access or delivery problem.

4. ALL SALES ARE FINAL — NO-REFUND POLICY

ALL SALES ARE FINAL.

Due to the immediate-access and nonreturnable nature of digital products, courses, educational materials, recordings, downloads, templates, memberships, classes, and other electronically delivered information, the Company maintains a strict no-refund policy.

Once information, access, materials, login credentials, links, downloads, recordings, or educational content have been delivered or made available, they cannot be returned, unlearned, or recovered by the Company.

Therefore, the Company does not provide refunds, partial refunds, exchanges, credits, cancellations, or transfers because of:

  • A change of mind.

  • Failure to use or complete the purchased product.

  • Failure to attend a scheduled or live class.

  • Dissatisfaction after accessing the information.

  • Scheduling conflicts.

  • Personal, family, employment, financial, or technical circumstances.

  • Failure to achieve a desired result.

  • A misunderstanding that was not caused by an inaccurate written product description.

  • Purchasing the wrong product.

  • Failure to follow instructions or implement the material.

  • Removal from a program or community for violating these Terms.

  • A later promotion, discount, or price reduction.

The purchaser is responsible for reviewing the product description and these Terms before completing the purchase.

An exception may be considered only where required by applicable law or where the Company confirms that the purchased product was never delivered, access cannot reasonably be restored or replaced, and the purchaser has not otherwise received or accessed the purchased information.

Any approved exception is determined by the Company based on the specific circumstances and does not waive the No-Refund Policy for any other transaction.

5. PERSONAL-USE LICENSE

Purchasing a Company product does not transfer ownership of the product or its intellectual-property rights to you.

The Company grants you a limited, revocable, nonexclusive, nontransferable, and nonsublicensable license to access and use the purchased materials for your own individual, personal, and noncommercial educational use.

Your purchase covers one individual purchaser unless the written product description expressly states that group, team, classroom, organizational, or commercial use is included.

6. NO SHARING, COPYING, DISTRIBUTION, OR RESALE

Company information, courses, recordings, documents, templates, methods, resources, and educational materials may not be sold, shared, transferred, reproduced, taught, published, distributed, or commercially used without the Company’s prior written consent.

You may not:

  • Share your login, access link, password, download, recording, or membership access with another person.

  • Allow another person to view or use materials purchased for your individual use.

  • Copy, photograph, screenshot, screen-record, audio-record, reproduce, or duplicate protected materials for distribution.

  • Upload Company content to social media, websites, cloud folders, shared drives, messaging groups, artificial-intelligence systems, file-sharing services, or other public or private platforms.

  • Email, text, transmit, or distribute Company materials to another person.

  • Sell, resell, rent, sublicense, assign, gift, or transfer Company content or access.

  • Repackage, rewrite, rename, rebrand, imitate, or present Company materials as your own.

  • Use Company materials to create a competing course, class, coaching program, membership, digital product, template, guide, service, or commercial offering.

  • Teach, train, coach, or advise others using proprietary Company materials for compensation or commercial benefit.

  • Remove copyright notices, business names, trademarks, watermarks, branding, or ownership information.

  • Record live classes, coaching calls, community discussions, workshops, or private sessions without express written permission.

No Company material may be shared or sold without express written authorization from the Company.

Unauthorized access, sharing, copying, distribution, reproduction, or resale may result in immediate termination of access without a refund. The Company also reserves the right to pursue all remedies available under applicable intellectual-property, contract, and other laws.

7. INTELLECTUAL PROPERTY

The Site and all Company content—including written materials, videos, audio, graphics, logos, brand names, photographs, designs, downloads, templates, documents, course structures, presentations, methods, frameworks, worksheets, recordings, training materials, website content, and other resources—are owned by or licensed to the Company.

Except for the limited personal-use license expressly granted in these Terms, no ownership interest or intellectual-property right is transferred to the purchaser.

“Kash Figures Enterprises,” its logos, branding, program names, and associated designs may not be used in connection with another business, product, or service without prior written permission.

To report a suspected copyright or intellectual-property violation, contact figureskash@gmail.com and include your name, contact information, a description of the protected work, the location of the alleged violation, and supporting information.

8. LIVE CLASSES, COACHING CALLS, AND APPOINTMENTS

When a purchase includes a scheduled class, consultation, coaching call, meeting, or private session, the purchaser is responsible for scheduling and attending it at the correct date and time.

All appointments and bookings are nonrefundable.

To request a reschedule, email figureskash@gmail.com with the subject line:

CALL RESCHEDULING REQUEST — [DATE AND TIME OF APPOINTMENT]

The request must be received at least 48 hours before the scheduled appointment unless a different policy is stated in the written product description.

Rescheduling is subject to availability and is not guaranteed. Failure to attend, arriving too late to complete the session, or requesting a change within 48 hours may result in forfeiture of the appointment without a refund.

The Company may reschedule an appointment due to illness, emergency, technical difficulty, or another reasonable circumstance. When the Company initiates the change, a replacement date or comparable remedy will be provided.

9. MEMBERSHIPS AND RECURRING PAYMENTS

When a product includes recurring billing, your payment method may be charged at the frequency and amount disclosed at checkout until the membership or subscription is canceled.

Cancellation stops future renewals but does not create a refund for payments already processed or access already provided.

Cancellation requests must be submitted before the next billing date using the cancellation method provided at checkout or by emailing figureskash@gmail.com.

Unless otherwise stated in writing, unused time, partial billing periods, and previously delivered membership access are not refundable.

10. USER CONDUCT

You agree not to use the Site, products, services, communities, or Company content to:

  • Violate any applicable law.

  • Infringe another person’s rights.

  • Harass, threaten, impersonate, defame, or abuse another person.

  • Distribute malicious software or attempt unauthorized access.

  • Misrepresent your identity or payment authorization.

  • Interfere with classes, communities, websites, platforms, or other users.

  • Collect another participant’s personal information without permission.

  • Engage in unauthorized commercial solicitation.

  • Share confidential discussions or private participant information.

  • Circumvent access controls or security protections.

The Company may suspend or terminate access when it reasonably believes these Terms have been violated. Termination for a violation does not entitle the purchaser to a refund.

11. PRIVACY AND CUSTOMER INFORMATION

The Company does not sell customer personal information.

Customer information may be collected, processed, or disclosed when reasonably necessary to:

  • Process payments.

  • Deliver purchased products or services.

  • Maintain accounts and customer records.

  • Operate the website, email system, course platform, or membership.

  • Prevent fraud or unauthorized transactions.

  • Work with service providers performing services for the Company.

  • Comply with legal requirements, court orders, or valid government requests.

  • Enforce these Terms.

  • Protect the rights, property, safety, and security of the Company, its customers, or others.

  • Carry out another purpose with the customer’s consent.

Payment information may be processed directly by third-party payment providers. The Company does not control the separate privacy or security practices of those providers.

12. ELECTRONIC COMMUNICATIONS

By providing your contact information, registering, or making a purchase, you consent to receive transaction-related communications electronically, including purchase confirmations, receipts, access instructions, account notices, scheduling information, policy updates, and service communications.

Marketing communications may be discontinued through the unsubscribe method provided in the communication, where applicable. Transactional or legally required communications may still be sent.

13. THIRD-PARTY PLATFORMS

The Company may use third-party services such as Stripe, Google, email providers, website hosts, course platforms, social-media platforms, video-conferencing services, payment services, community platforms, or software providers.

The Company is not responsible for interruptions, processing delays, account restrictions, security events, outages, technical problems, or policy decisions caused by a third-party service.

Problems involving a third-party provider may also be governed by the purchaser’s agreement with that provider.

14. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, the Site, products, services, and content are provided on an “as is” and “as available” basis.

The Company does not warrant that:

  • The Site or content will always be available or uninterrupted.

  • Every error or defect will be corrected.

  • The Site or content will be free from viruses or harmful components.

  • The content will satisfy every purchaser’s personal needs.

  • A purchaser will obtain a particular financial, personal, credit, funding, business, legal, or income result.

  • Third-party websites, platforms, processors, or services will operate without interruption.

You are responsible for evaluating whether the information is appropriate for your circumstances and for obtaining professional advice when needed.

15. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, the Company and its owners, officers, employees, contractors, representatives, affiliates, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, reliance, or punitive damages arising from or connected with:

  • Your use or inability to use the Site, content, products, or services.

  • Decisions or actions taken based on educational information.

  • Lost profits, income, business opportunities, data, goodwill, or anticipated savings.

  • Third-party services, platforms, websites, payment processors, or software.

  • Unauthorized access to information despite reasonable security measures.

  • Failure to achieve a desired result.

To the fullest extent permitted by law, the Company’s total liability concerning a particular purchase will not exceed the amount actually paid to the Company for the product or service giving rise to the claim.

Nothing in these Terms excludes liability that cannot legally be excluded.

16. INDEMNIFICATION

You agree to indemnify and hold harmless the Company and its owners, officers, employees, contractors, representatives, affiliates, and agents from claims, losses, liabilities, damages, judgments, penalties, expenses, and reasonable attorney’s fees arising from:

  • Your violation of these Terms.

  • Your unlawful or unauthorized use of Company content.

  • Your violation of another person’s rights.

  • Materials or information you upload, post, submit, or distribute.

  • Your conduct involving the Site, Company services, or other users.

The Company reserves the right to control the defense of a claim for which indemnification is sought, and you agree to provide reasonable cooperation.

17. TERMINATION OF ACCESS

The Company may restrict, suspend, or terminate access to the Site, content, classes, communities, memberships, products, or services if it reasonably determines that a purchaser has:

  • Violated these Terms.

  • Shared or resold protected content.

  • Engaged in threatening, disruptive, fraudulent, or unlawful conduct.

  • Attempted unauthorized access.

  • Failed to make an agreed payment.

  • Misused a Company platform or community.

Termination for a violation does not entitle the purchaser to a refund.

Provisions relating to payments, refunds, intellectual property, confidentiality, limitations of liability, indemnification, dispute resolution, and governing law survive termination.

18. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Any legal proceeding arising from these Terms or the Company’s products or services shall be brought in the appropriate state or federal court located in Pinellas County, Florida, unless applicable law requires otherwise.

Before filing a legal proceeding, the parties agree to make a reasonable good-faith effort to resolve the issue through written communication.

19. SEVERABILITY

If any portion of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted or severed if necessary. The remaining provisions will continue in full force and effect.

20. NO WAIVER

A failure by the Company to enforce any provision on one occasion does not waive the Company’s right to enforce that provision or another provision later.

21. ENTIRE AGREEMENT

These Terms, together with any written product description, checkout disclosure, privacy policy, payment-plan agreement, or service-specific agreement presented at the time of purchase, constitute the entire agreement between the purchaser and the Company concerning the purchase.

If a service-specific written agreement directly conflicts with these general Terms, the service-specific agreement will control only regarding that particular service.

22. CHANGES TO THESE TERMS

The Company may update these Terms periodically. Updated Terms will be posted with a revised effective date.

The Terms in effect when a purchase is completed will generally govern that purchase, except where an update is required by law, relates to ongoing platform security, or applies to continued or renewed services.
