Terms & Conditions

Terms and Conditions

Effective Date: September 6, 2026

Please read these Terms and Conditions carefully before using KheistonBoone.com, purchasing a digital product, enrolling in a course or program, booking a service, or accessing any content offered by The Excel Group, doing business as Kheiston Boone (collectively, “Company,” “we,” “us,” or “our”).

By visiting our website, completing a purchase, checking an acceptance box, downloading a product, or accessing any product or service, you agree to these Terms and Conditions and our Privacy Policy. If you do not agree, do not use the website or purchase or access our products or services.

1. Scope of These Terms

These Terms apply to KheistonBoone.com, our checkout and course platforms, and every current or future digital product, educational resource, program, or service created, sold, licensed, or provided by Kheiston Boone or The Excel Group, including but not limited to:

â—Ź Pitch It Templates;

â—Ź Pitch, Track, Paid;

â—Ź email, direct-message, negotiation, follow-up, and outreach templates;

â—Ź courses, trainings, workshops, masterclasses, guides, workbooks, checklists, trackers, scripts, prompts, videos, audio recordings, and downloadable files;

â—Ź coaching, consulting, implementation, and done-for-you services when offered; and

â—Ź any updates, bonuses, or supplemental materials provided with a purchase.

Together, these are referred to as the “Products and Services.” Additional terms shown on a sales page, checkout page, order form, or service agreement are incorporated into these Terms. If there is a direct conflict, the product-specific written terms control for that purchase.

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding agreement to purchase or use the Products and Services. By purchasing, you represent that the information you provide is accurate and that you are authorized to use the selected payment method.

3. Educational Purpose Only

Our Products and Services are provided for educational and informational purposes. They do not constitute legal, financial, tax, accounting, employment, or other professional advice. You are responsible for deciding whether and how to apply the information to your own business and circumstances and should consult a qualified professional when appropriate.

Templates, scripts, examples, suggested rates, negotiation language, and outreach strategies must be reviewed and customized before use. You are solely responsible for the accuracy, legality, and suitability of any communication, agreement, offer, pricing decision, or business action you make.

4. No Earnings, Deal, or Results Guarantee

We do not promise or guarantee that you will secure brand partnerships, receive responses, earn a particular amount of income, grow your audience, obtain specific business results, or achieve success within any period of time.

Any revenue figures, campaign results, testimonials, case studies, or examples shared by us are illustrative only and are not promises of what you will achieve. Results vary based on factors including your experience, audience, content quality, niche, consistency, pricing, market conditions, effort, decision-making, and circumstances outside our control. You accept full responsibility for your business decisions, actions, expenses, and results.

5. Purchases and Payment

You agree to pay the price and any applicable taxes displayed at checkout. Prices, bonuses, promotions, and product availability may change at any time. We do not provide price adjustments or refunds because a product is later discounted or offered as part of a promotion.

Payments are processed by third-party providers, which may include ThriveCart, Stripe, PayPal, or another platform. Your use of those services is also subject to their terms and privacy practices. We are not responsible for interruptions, processing delays, declines, or other issues caused by a third-party provider.

6. Payment Plans

If you select a payment plan, you authorize all scheduled payments shown at checkout. A payment plan is a commitment to pay the full purchase price; it is not a subscription that may be canceled simply because you no longer wish to participate.

You are responsible for keeping a valid payment method on file. If a payment fails, we may retry the payment, suspend access, withhold services or deliverables, and use lawful collection methods until the balance is paid. Suspending access does not eliminate the remaining balance.

If a separate checkout page expressly describes an offer as a recurring subscription or membership, its disclosed renewal and cancellation terms will apply instead.

7. All Sales Are Final; No Refunds

Because our digital products provide immediate access to proprietary information and downloadable materials, all sales are final and non-refundable, except where a refund is required by law or where these Terms expressly state otherwise.

This no-refund policy applies to digital downloads, templates, courses, trainings, programs, coaching, consulting, booked calls, payment plans, and done-for-you services. Your decision not to use a purchase, a change in your schedule or circumstances, or dissatisfaction based on personal preference does not create a right to a refund or release you from a payment plan.

If a technical issue caused by us prevents delivery or access, contact info@keystoneboom.com. We will use reasonable efforts to restore access, provide a replacement, or, when neither is reasonably possible, provide an appropriate remedy as determined by us and required by applicable law.

8. Digital Delivery and Access

Digital products may be delivered by email, download link, customer portal, course platform, or another electronic method. You are responsible for providing a correct email address, checking spam or promotions folders, downloading files within any stated access period, maintaining compatible technology, and safely storing your own copies.

We may update, reorganize, replace, or discontinue portions of a Product or Service when reasonably necessary. Unless a sales page expressly promises lifetime access, access lasts only for the period stated at purchase. “Lifetime access,” when expressly offered, means access for the commercial life of that specific product while we continue to own and operate it; it does not guarantee that any particular platform or product will exist indefinitely.

9. Limited Personal-Use License

All Products and Services, including their text, templates, scripts, videos, audio, downloads, graphics, branding, website code, HTML, CSS, JavaScript, prompts, systems, frameworks, and other materials (“Content”), are owned by or licensed to the Company and are protected by intellectual-property laws.

When you purchase a digital product, you receive a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use the Content for your own personal or internal business use only. Ownership is not transferred to you.

You may customize purchased pitch templates and scripts for your own outreach and business communications. You may not:

â—Ź share your login, download link, or files with another person;

â—Ź copy, reproduce, publish, upload, sell, license, sublicense, distribute, or give away the Content;

â—Ź use the Content to create a competing template pack, course, membership, coaching resource, prompt library, or other product or service;

â—Ź remove copyright, trademark, or ownership notices;

â—Ź upload the Content to a public database, shared drive, group, marketplace, file-sharing platform, or artificial-intelligence training dataset;

â—Ź allow clients, team members, students, friends, or contractors to use the Content unless the applicable product expressly includes a multi-user license; or

â—Ź claim the Content, systems, or frameworks as your own original work.

For clarity, purchasing Pitch It Templates allows you to personalize and send the templates on behalf of your own creator business. It does not permit you to resell, redistribute, teach, license, or provide the templates to others.

10. Unauthorized Use and Account Termination

We may suspend or terminate access without refund if we reasonably believe you have violated these Terms, shared access, infringed our intellectual property, engaged in fraud, harassed others, disrupted the learning environment, or used the Products and Services unlawfully.

Unauthorized copying or distribution may cause irreparable harm. We reserve all rights and remedies available under law, including injunctive relief and monetary damages.

11. Coaching, Consulting, and Scheduled Calls

If your purchase includes a call, you are responsible for booking it within the stated availability or program period. Calls and appointments are non-refundable.

To request a reschedule, email info@keystoneboom.com at least 48 hours before the scheduled start time and use the subject line “CALL RESCHEDULE REQUEST.” Requests made less than 48 hours in advance, late arrivals, and no-shows may result in forfeiture of the call. Any exception is at our discretion unless applicable law requires otherwise.

12. Done-for-You Services

When done-for-you or implementation services are purchased, the scope, timeline, revision limits, required client materials, communication process, and deliverables will be governed by the applicable sales page, order form, or separate service agreement.

You are responsible for providing accurate information, timely feedback, platform access, approvals, and other materials needed to complete the work. Delays by you may extend the delivery timeline. Unless agreed otherwise in writing, no result, revenue, response rate, partnership, or campaign outcome is guaranteed.

13. Community and User Conduct

If access to a group, community, live chat, or interactive program is included, you agree to communicate respectfully, protect the confidentiality of other participants, and refrain from harassment, discrimination, spam, solicitation, illegal conduct, and infringement.

Do not share another participant’s personal information, business information, questions, screenshots, or results outside the community without that person’s permission. We may remove content or revoke access for conduct that violates these standards.

14. Testimonials and User Submissions

If you voluntarily submit a testimonial, review, success story, photo, video, comment, or other content, you represent that it is truthful, reflects your genuine experience, and does not infringe another person’s rights.

We will request or rely on your permission before using identifiable testimonial content in our marketing. Any use will remain subject to applicable disclosure and advertising requirements. Product feedback and non-confidential suggestions may be used to improve our Products and Services without compensation, but you retain ownership of your original submission unless otherwise agreed in writing.

15. Email Communications

By purchasing, creating an account, or requesting information, you agree to receive transactional communications related to your order, account, access, appointments, and purchased Products and Services. Marketing emails will be sent only as permitted by applicable law, and you may unsubscribe from promotional messages using the link provided. Unsubscribing from marketing emails does not stop necessary transactional communications.

16. Privacy and Security

Your use of our website and Products and Services is also subject to our Privacy Policy. We use reasonable safeguards, but no website, storage system, payment platform, email system, or online transmission can be guaranteed completely secure. You use online services at your own risk and are responsible for protecting your passwords and account credentials.

17. Third-Party Platforms, Tools, and Links

Our Products and Services may reference or rely on third-party websites, platforms, software, social networks, payment processors, artificial-intelligence tools, email providers, or brand marketplaces. We do not control and are not responsible for their availability, accuracy, security, policies, decisions, algorithm changes, account actions, fees, or performance.

Links or references do not constitute an endorsement or guarantee. You are responsible for reviewing and complying with the terms, advertising rules, intellectual-property rules, disclosure obligations, and privacy requirements that apply to your use of any third-party service.

18. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE, CONTENT, AND PRODUCTS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE WEBSITE OR PRODUCTS AND SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, COMPATIBLE WITH EVERY DEVICE OR PLATFORM, OR FREE FROM HARMFUL COMPONENTS, OR THAT EVERY ERROR WILL BE CORRECTED.

Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

19. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, RELIANCE, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITY, GOODWILL, OR USE; OR CLAIMS ARISING FROM YOUR BUSINESS DECISIONS, OUTREACH, NEGOTIATIONS, AGREEMENTS, CONTENT, PLATFORM ACCOUNT, OR USE OR INABILITY TO USE THE PRODUCTS AND SERVICES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO A PRODUCT OR SERVICE WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID TO US FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

20. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless the Company and its owners, officers, employees, contractors, agents, and affiliates from claims, liabilities, damages, judgments, losses, and reasonable costs and attorneys’ fees arising out of or related to your breach of these Terms, unlawful conduct, infringement of another party’s rights, misuse of the Products and Services, or communications and business activities created or conducted using our Content.

We may assume control of the defense of a claim subject to indemnification, and you agree to provide reasonable cooperation.

21. Chargebacks and Payment Disputes

Before initiating a chargeback or payment dispute, contact info@keystoneboom.com so we can review any delivery or billing issue. Filing a chargeback does not cancel a valid payment obligation or override these Terms. We may provide the payment processor with relevant records, including checkout acceptance, access logs, download records, communications, and these Terms, and may suspend access while a dispute is pending.

This section does not limit any non-waivable rights you have under applicable law or your cardholder agreement.

22. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Subject to any rights that cannot lawfully be waived, any legal action arising out of or relating to these Terms or the Products and Services must be brought in the state or federal courts located in Denton County, Texas, and you consent to their personal jurisdiction and venue.

23. Severability and Waiver

If any provision of these Terms is held unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of our right to enforce it later.

24. Assignment

You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign these Terms as part of a merger, acquisition, reorganization, sale of assets, or transfer of the applicable business or product.

25. Changes to These Terms

We may revise these Terms from time to time by posting an updated version. Changes apply prospectively once posted. The terms accepted when you made a purchase will continue to govern that transaction unless a change is required by law or you agree to updated terms.

26. Entire Agreement

These Terms, the Privacy Policy, and any applicable checkout terms, order form, sales page, or signed service agreement constitute the entire agreement between you and the Company regarding the Products and Services and supersede prior discussions or representations on the same subject.
