TERMS & CONDITIONS

Effective upon purchase. Applies to all products and programs offered by LBK Lash Inc.

 

1. AGREEMENT TO TERMS

By completing a purchase through LBK Lash Inc's Stan Store ("Store"), you ("Buyer") agree to be bound by these Terms and Conditions ("Terms"). These Terms apply to all products, digital courses, programs, and services offered through the Store by LBK Lash Inc, a Florida corporation.

 

All material terms, deliverables, and program details have been clearly and conspicuously disclosed in the applicable sales page prior to purchase, in compliance with the Florida Deceptive and Unfair Trade Practices Act (FDUTPA), Florida Statutes Sections 501.201 through 501.213, and the Federal Trade Commission Act.

 

For the Jumpstart Mentorship + Lab, a separate Client Agreement will be provided and must be signed prior to the commencement of services. These Terms govern the purchase transaction; the Client Agreement governs program delivery. In the event of conflict, the Client Agreement controls.

 

PART A — THE EDUCATORS LAB

 

2. WHAT YOU ARE PURCHASING

The Educators Lab is a self-paced online course and digital education platform. Upon purchase you receive lifetime access to the course curriculum, digital templates, resources, and materials included within the platform. The Educators Lab does not include one-on-one coaching or live calls unless explicitly stated in the specific offer purchased.

3. ALL SALES ARE FINAL

ALL SALES OF THE EDUCATORS LAB ARE FINAL AND NON-REFUNDABLE. Due to the immediate digital nature of this product and instant access upon purchase, no refunds will be issued for any reason, including change of mind, failure to use the program, or dissatisfaction with results. By completing your purchase you confirm you have reviewed the program description and understand what is included.

4. EARNINGS DISCLAIMER (FTC COMPLIANT)

The Educators Lab is an educational resource. LBK Lash Inc complies with the FTC Act (15 U.S.C. Section 45) and FTC Guides Concerning Endorsements and Testimonials (16 CFR Part 255, updated July 26, 2023).

THE TYPICAL RESULT FOR EDUCATORS LAB PARTICIPANTS IS: The typical Educators Lab student creates their first program, ebook, and online course within 30 to 60 days of completing the program. Individual revenue results vary and are not guaranteed. Results depend entirely on Buyer's effort, execution, market conditions, and individual circumstances. The Company makes no guarantees of specific income, revenue, or business outcomes.

5. INTELLECTUAL PROPERTY

All course content, videos, materials, and resources are the intellectual property of LBK Lash Inc. Buyer receives a limited personal license for own business education use only. Buyer may not reproduce, distribute, sell, share, or use materials to create competing products. Violation results in immediate access termination.

6. CHARGEBACKS PROHIBITED

Buyer agrees not to initiate any chargeback or payment dispute. Chargebacks will be contested. Buyer will be liable for the full purchase amount plus all fees incurred by LBK Lash Inc.

 

PART B — JUMPSTART MENTORSHIP + LAB

 

7. WHAT YOU ARE PURCHASING

The Jumpstart Mentorship + Lab is a three (3) month private mentorship program. By completing payment you are reserving your spot. Full program details and deliverables are governed by the Jumpstart Client Agreement, which will be provided prior to your first session.

8. CLIENT AGREEMENT REQUIRED BEFORE SERVICES BEGIN

IMPORTANT: Purchase of Jumpstart does not constitute commencement of services. Before any coaching calls or program services begin, Buyer must review and sign the Jumpstart Client Agreement during the onboarding call. Failure to sign within [NUMBER] days of purchase will result in forfeiture of enrollment without refund.

9. ALL SALES ARE FINAL

ALL SALES OF THE JUMPSTART MENTORSHIP ARE FINAL AND NON-REFUNDABLE. No refunds after purchase for any reason. Payment plan participants remain responsible for all installments regardless of participation level.

10. PAYMENT PLANS

Buyers selecting the payment plan authorize LBK Lash Inc to charge the payment method on file for all scheduled installments. Failed payments result in program access suspension until resolved. Suspension does not extend the Program term.

11. EARNINGS DISCLAIMER (FTC COMPLIANT)

LBK Lash Inc complies with the FTC Act and FTC Endorsement Guides. ANY INCOME FIGURES OR SUCCESS EXAMPLES IN COMPANY MARKETING ARE INDIVIDUAL RESULTS ONLY AND NOT TYPICAL OR GUARANTEED. THE TYPICAL RESULT IS: The typical Jumpstart participant launches their first training within 90 days of completing the program. Individual revenue results vary and are not guaranteed. Results depend entirely by Buyer's individual effort and circumstances.

12. CHARGEBACKS PROHIBITED

Buyer agrees not to initiate any chargeback or payment dispute. Chargebacks will be contested and Buyer will be liable for the full program investment plus all fees. Program access will be permanently revoked upon initiation of a chargeback.

 

PART C — GENERAL TERMS

 

13. FLORIDA CONSUMER PROTECTION (FDUTPA)

All Company practices governing purchases through this Store are intended to comply with the Florida Deceptive and Unfair Trade Practices Act (FDUTPA), Florida Statutes Sections 501.201 through 501.213. All material terms have been clearly and conspicuously disclosed. Nothing in these Terms limits any remedies that cannot be waived under FDUTPA or applicable Florida consumer protection statutes.

14. INTELLECTUAL PROPERTY (ALL PRODUCTS)

All content and materials provided through any LBK Lash Inc product or program are protected by copyright and intellectual property law. Unauthorized reproduction, distribution, or commercial use of any materials is strictly prohibited.

15. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LBK LASH INC'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF ANY PURCHASE SHALL NOT EXCEED THE TOTAL AMOUNT PAID FOR THAT PRODUCT. LBK LASH INC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. Nothing in this limitation is intended to limit remedies that cannot be waived under FDUTPA.

16. DISPUTE RESOLUTION & BINDING ARBITRATION

Any dispute arising from a purchase through this Store shall first be addressed by contacting info@lbklash.com. If unresolved within thirty (30) days, disputes shall be resolved through binding arbitration administered by the AAA under its Commercial Arbitration Rules in Orange County, Florida. The arbitrator shall have authority to award any remedy available at law or equity. The arbitrator's decision is final and binding.

 

Any disputes about the interpretation or enforceability of these Terms, including arbitrability, shall be decided by the arbitrator. If any portion of this arbitration provision is unenforceable, the remaining portions remain in effect.

 

BUYER EXPRESSLY WAIVES ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST LBK LASH INC.

17. GOVERNING LAW

These Terms are governed by the laws of the State of Florida. Any proceedings not subject to arbitration shall be brought in courts in Orange County, Florida.

18. CONTRACTING ENTITY

All purchases are made with LBK Lash Inc, a Florida corporation. Buyer acknowledges they are contracting with the corporate entity, not with any individual officer, employee, or shareholder in their personal capacity.
