1. Acceptance of Terms
By accessing or using any services provided by Divine Rising, LLC DBA Nasir Adderley (“Company,” “we,” “us,” or “our”), including our website, digital products, mentorship programs, physical merchandise, content, livestreams, or community platforms, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, please do not use our services.
2. Services Provided
Divine Rising, LLC DBA Nasir Adderley offers:
- Mentorship programs (subject to the Private Mentorship Agreement below)
- Digital products (eBooks, guides, templates, etc.)
- Physical and print-on-demand merchandise (fulfilled via Fourthwall)
- Affiliate product recommendations
- Gaming, entertainment, livestreams, and related content
We may update, modify, or discontinue any service at our sole discretion.
3. Third-Party Fulfillment (Fourthwall)
Physical merchandise is fulfilled by the third-party platform Fourthwall. All purchases are subject to Fourthwall’s Terms of Service and Privacy Policy. We are not responsible for shipping delays, customs fees, lost packages, or carrier issues.
4. Eligibility
You must be at least 18 years old to purchase products or services. Users under 18 require written consent from a parent or legal guardian, who must also complete all intake forms.
5. User Responsibilities
You agree to:
- Provide accurate and complete information
- Use our services legally and respectfully
- Keep account credentials confidential
- Not record, reproduce, or share proprietary content without permission
- Report issues promptly
Violation may result in immediate suspension or termination of access without refund.
6. Health & Wellness Disclaimer
Our mentorship programs, products, and content are for educational and general wellness purposes only and do not constitute medical, therapeutic, or professional advice. Consult a qualified healthcare provider before beginning any fitness or wellness program. No specific results are guaranteed.
7. AI-Generated Content Disclaimer
Some content may be generated or assisted by artificial intelligence and is provided “as is.” We do not guarantee its accuracy, completeness, or suitability for any particular purpose.
8. Intellectual Property
All content — including text, images, videos, livestreams, music, artwork, AI-generated materials, voice recordings, mentorship programs, and digital products — is the exclusive property of Divine Rising, LLC DBA Nasir Adderley.
- Content is licensed for personal, non-commercial use only.
- You may not reproduce, distribute, modify, sell, or commercially exploit any content without our prior written consent.
- All rights not expressly granted are reserved.
9. AI Voice & Likeness Protection
You are strictly prohibited from using any of our content (recordings, voice samples, images, video, etc.) to train, clone, synthesize, or imitate the creator’s voice, likeness, name, or persona using AI or similar technology. This includes deepfakes and synthetic media. Violations may result in legal action.
10. Live Streams & Content Use
- Livestreams and related content are for personal, non-commercial viewing only.
- Recording, reposting, clipping, or redistributing livestreams (or any portion thereof) without express written permission is prohibited.
- We retain all rights to create, edit, and publish highlights or clips.
11. Community Guidelines & Conduct
Harassment, hate speech, bullying, discrimination, spam, trolling, or sharing illegal/inappropriate content is strictly prohibited. We reserve the right to remove content, mute, block, or ban users without refund for violations.
12. Payment & Refund Policy
- All payments are in USD.
- Payment is due in full before access to digital products, mentorship programs, or subscriptions.
- No refunds on digital products, subscriptions, livestream access, or mentorship programs once services have commenced (except as noted in the Private Mentorship Agreement).
- Physical merchandise: Refunds for defective or incorrect items within 30 days, subject to Fourthwall’s policies.
- Phone consultations: Non-refundable.
13. Private Mentorship Agreement (Additional Terms)
This section applies to clients enrolled in personal mentorship programs.
Services: Mentorship programs focused on goal setting, accountability support, and evidence-based strategies conducted via Zoom or other agreed platforms.
Client Responsibilities:
- Active and honest participation
- Disclosure of relevant medical/mental health conditions
- 24-hour notice for cancellations/reschedules
- Sessions in a private, distraction-free environment with stable internet
Payment & Refunds:
- Full payment required before mentorship begins
- Full refund available if canceled within 48 hours of purchase and before any mentorship sessions begin
- No refunds after services commence
- Unused session credits expire 12 months after the agreement ends
Termination: Either party may terminate with 30 days’ written notice. You remain responsible for fees for services already rendered.
Confidentiality: Sessions are confidential (but not legally privileged). Recording or distribution without consent is prohibited.
Disclaimer: You confirm you are fit for physical activity and will consult a physician as needed. Mentorship is educational only.
14. Limitation of Liability
To the fullest extent permitted by law, Divine Rising, LLC DBA Nasir Adderley shall not be liable for indirect, incidental, consequential, or punitive damages. Our total liability shall not exceed the amount paid by you for the relevant product or service.
15. Indemnification
You agree to indemnify and hold harmless Divine Rising, LLC DBA Nasir Adderley, its owners, affiliates, and third-party providers (including Fourthwall) from any claims, damages, or losses arising from your use of our services or violation of these Terms.
16. Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control (e.g., natural disasters, technical failures, pandemics).
17. Changes to Terms
We may update these Terms at any time. The “Last Updated” date will be revised. Continued use of our services after changes constitutes acceptance of the new Terms.
18. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Wyoming. Any disputes shall be resolved exclusively in the state or federal courts located in Wyoming.
19. Severability & Entire Agreement
If any provision is held unenforceable, the remaining provisions remain in effect.
These Terms constitute the entire agreement between you and Divine Rising, LLC DBA Nasir Adderley.
