PLEASE READ CAREFULLY BEFORE PURCHASING OR USING ANY NCNG PRODUCT OR SERVICE

By purchasing, accessing, or using any product, course, program, coaching service, or content offered by No Champagne No Gain (“NCNG,” “Company,” “we,” “us”), you agree to be bound by these Terms & Conditions.

If you do not agree, do not purchase or use NCNG products or services.

1. Scope of Services (Important)

All NCNG products, programs, courses, and coaching services are educational and supportive in nature only.

  • NCNG does not provide medical advice

  • NCNG does not diagnose, treat, or rehabilitate injuries

  • NCNG does not replace your surgeon, physician, or physical therapist

All training, movement, mindset strategies, and educational content are intended to support athletes who are already operating within the guidelines set by their licensed medical providers.

You are solely responsible for following the recommendations and restrictions provided by your surgeon, physical therapist, or healthcare professional.

2. Assumption of Risk

By purchasing or using NCNG products or services, you acknowledge and agree that:

  • Physical activity carries inherent risks

  • You voluntarily assume full responsibility for your participation

  • You confirm that you have medical clearance where required

NCNG is not responsible for any injury, setback, complication, or outcome resulting from your use of the content.

3. No Guarantees

NCNG makes no guarantees regarding recovery timelines, physical outcomes, performance results, or emotional or mental improvements.

Every athlete and recovery journey is different. Results depend on many factors outside of NCNG’s control.

4. Digital Products – Ownership & Use

When you purchase a digital product (ebook, course, guide, program, or downloadable material):

  • You receive lifetime access unless otherwise stated

  • The product is owned outright by you for personal use

  • You may not copy, share, resell, distribute, or reproduce the content

All content remains the intellectual property of No Champagne No Gain.

Unauthorized use, distribution, or reproduction is strictly prohibited.

5. Coaching & Support – Time-Limited

Any coaching, messaging support, group access, or calls included with a product or offer are:

  • Limited in duration, as specified at the time of purchase

  • Not ongoing or indefinite

  • Not medical or therapeutic in nature

Once the stated support period ends, NCNG has no obligation to continue providing coaching or access.

6. Calls, Scheduling & Missed Appointments (If Applicable)

If your purchase includes live calls or 1:1 sessions:

  • You are responsible for scheduling

  • All calls are non-refundable

  • Cancellations must be made at least 48 hours in advance

  • No-shows or late cancellations result in forfeiture of the call

7. Payments, Refunds & Chargebacks

  • All prices are listed in USD

  • All sales are final

  • Due to the digital nature of NCNG products, no refunds are offered

  • Initiating a chargeback violates these Terms

If technical issues prevent delivery, NCNG may offer replacement access at its discretion.

8. Limitation of Liability

To the fullest extent permitted by law:

NCNG shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from:

  • Use or misuse of NCNG content

  • Participation in training or movement

  • Reliance on educational materials

  • Coaching or communication provided

All products and services are provided “as is”.

9. Indemnification

You agree to indemnify and hold harmless No Champagne No Gain, its owners, contractors, and affiliates from any claims, damages, or legal fees arising from:

  • Your participation

  • Your failure to follow medical guidance

  • Your misuse of NCNG content

  • Your breach of these Terms

10. Intellectual Property

All NCNG materials—including videos, text, graphics, downloads, and branding—are protected intellectual property.

Nothing in these Terms grants you rights beyond personal use.

11. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles.

Any disputes shall be resolved exclusively in the state or federal courts located in Colorado.

12. Changes to Terms

NCNG reserves the right to update these Terms at any time. Continued use of products or services constitutes acceptance of the revised Terms.
