FIT ACADEMY TERMS & CONDITIONS

By purchasing, accessing, downloading, participating in, or utilizing any product, service, coaching, consultation, training, membership, community, digital product, resource, event, or offering provided by FIT Academy, you acknowledge that you have read, understood, and agreed to the following Terms & Conditions.
1. ALL SALES ARE FINAL
Due to the digital nature of FIT Academy products, services, memberships, coaching, consultations, training materials, downloadable resources, educational content, and community access, all sales are final.
No refunds, returns, exchanges, cancellations, credits, or chargebacks will be granted once a purchase has been completed and/or access has been provided.
By completing your purchase, you expressly agree to this policy.
2. EDUCATIONAL PURPOSES ONLY
FIT Academy provides educational information, mentorship, coaching, resources, training, and business-related content for informational and educational purposes only.
FIT Academy does not provide legal, financial, tax, accounting, investment, lending, credit repair, medical, or professional advice.
You acknowledge that all decisions and actions taken based on information provided by FIT Academy are solely your responsibility.
3. NO GUARANTEE OF RESULTS
FIT Academy makes no guarantees regarding earnings, income, sales, business growth, funding approvals, credit approvals, financial outcomes, or any specific results.
Any testimonials, case studies, success stories, screenshots, examples, income disclosures, or member results shared by FIT Academy, Nairobi Brown, affiliates, moderators, administrators, or members are provided for illustrative purposes only and are not guarantees of future performance.
Individual results will vary based on effort, experience, skill, implementation, market conditions, and numerous other factors beyond FIT Academy’s control.
4. INTELLECTUAL PROPERTY
All FIT Academy content, materials, branding, logos, videos, documents, downloads, templates, graphics, systems, frameworks, training materials, community content, resources, and educational materials are the exclusive property of FIT Academy and are protected by applicable copyright and intellectual property laws.
You may not:
• Copy, reproduce, distribute, share, republish, upload, modify, sell, license, or transfer any FIT Academy content.
• Share login credentials or provide unauthorized access to third parties.
• Resell or claim ownership of FIT Academy materials.
Unauthorized use may result in immediate termination of access and legal action where applicable.
5. ACCOUNT ACCESS
Purchases are intended for individual use unless otherwise stated.
FIT Academy reserves the right to suspend, revoke, or terminate access without refund if account sharing, unauthorized distribution, misuse, or violations of these Terms & Conditions are suspected.
6. COMMUNITY STANDARDS
Members participating in FIT Academy communities, coaching programs, events, memberships, or support groups agree to conduct themselves professionally and respectfully.
The following are prohibited:
• Harassment, bullying, discrimination, threats, or abusive behavior.
• Spam, unsolicited promotions, or misleading information.
• Recruiting, soliciting, or directing FIT Academy members to outside programs, services, offers, communities, or opportunities.
• Disruptive, harmful, or unlawful conduct.
FIT Academy reserves the right to remove any member at its sole discretion without notice or refund.
7. AFFILIATE DISCLOSURE
FIT Academy may offer affiliate opportunities from time to time.
Affiliate participation does not guarantee earnings, commissions, sales, or results of any kind.
Affiliates operate as independent individuals and are solely responsible for their marketing practices, advertising activities, legal compliance, disclosures, business operations, and representations.
FIT Academy is not responsible for the actions or statements of independent affiliates.
8. NO EMPLOYMENT OR PARTNERSHIP RELATIONSHIP
Nothing contained within FIT Academy, its products, services, memberships, affiliate opportunities, coaching, training, or communities shall be interpreted as creating an employment relationship, partnership, joint venture, agency relationship, or fiduciary relationship between FIT Academy, Nairobi Brown, affiliates, members, customers, contractors, or participants.
All participants operate independently and are solely responsible for their own actions and business activities.
9. PAYMENT DISPUTES & CHARGEBACKS
By completing a purchase, you agree not to initiate fraudulent chargebacks, payment disputes, payment reversals, or unauthorized claims after receiving access to products, services, memberships, coaching, consultations, content, or resources.
FIT Academy reserves the right to provide supporting documentation including but not limited to:
• Purchase records
• Login records
• Access activity logs
• Community participation records
• Communications and support records
• Onboarding records
• Training completion records
Any customer initiating a payment dispute may have immediate access revoked while the matter is reviewed.
10. LIMITATION OF LIABILITY
To the fullest extent permitted by law, FIT Academy, Nairobi Brown, its owners, administrators, moderators, coaches, contractors, affiliates, representatives, partners, employees, agents, successors, and assigns shall not be liable for any direct, indirect, incidental, consequential, punitive, special, financial, business, personal, or other damages arising from:
• Use of any FIT Academy product, service, coaching, consultation, membership, event, training, or resource.
• Business, financial, marketing, or personal decisions made by customers.
• Loss of profits, income, revenue, business opportunities, platform access, funding approvals, credit approvals, or expected results.
• Actions, statements, recommendations, or conduct of members, affiliates, contractors, moderators, administrators, or third parties.
Participation in FIT Academy is entirely voluntary and undertaken at your own risk.
11. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless FIT Academy, Nairobi Brown, its owners, affiliates, administrators, moderators, coaches, contractors, representatives, employees, agents, and partners from and against any claims, liabilities, damages, losses, costs, expenses, or legal fees arising from:
• Your use of FIT Academy products or services.
• Your violation of these Terms & Conditions.
• Your actions, conduct, business activities, or representations.
• Any dispute involving your participation in FIT Academy.
12. MODIFICATIONS
FIT Academy reserves the right to update, modify, replace, discontinue, suspend, or change any product, service, membership, training, pricing, bonus, feature, community component, or policy at any time without prior notice.
13. PAYMENT PLANS
FIT Academy may offer payment plan options for select products, services, memberships, coaching programs, consultations, and digital products.
By selecting a payment plan, you agree to complete all scheduled payments associated with your purchase.
A payment plan is not a subscription that may be canceled at any time. It is a commitment to pay the full agreed-upon purchase price over the designated payment schedule.
Failure to make scheduled payments does not relieve you of your obligation to pay the remaining balance owed.
FIT Academy reserves the right to:
• Suspend or revoke access to products, services, memberships, coaching, communities, bonuses, and resources associated with the purchase.
• Restrict future purchases.
• Pursue collection of outstanding balances to the extent permitted by law.
Customers utilizing third-party financing providers, including but not limited to Klarna, Afterpay, Affirm, Zip, or similar services, remain subject to the terms and conditions of those providers. Any payment obligations, disputes, collections, fees, or repayment arrangements related to third-party financing are solely between the customer and the financing provider.
No refunds, credits, cancellations, or forgiveness of remaining payment obligations will be granted due to failure to complete a payment plan.
By selecting a payment plan or financing option, you acknowledge and agree to these terms.
14. ACCEPTANCE OF TERMS
By purchasing, accessing, or using any FIT Academy product, service, membership, coaching program, consultation, community, resource, or offering, you acknowledge that you have read, understood, and agreed to be bound by these Terms & Conditions in their entirety.
