These Terms & Conditions apply to products, services and bookings offered by Alex Smith Digital and Onsite Content through this website.
By purchasing a product or service, downloading a resource, or booking an appointment through this website, you acknowledge that you have read and agreed to the relevant terms below.
ALEX SMITH DIGITAL - DIGITAL PRODUCTS & SERVICES
All products, resources, templates, guides, eBooks, downloads and personalised services provided by Alex Smith Digital are intended for educational and informational purposes only.
Results will vary depending on factors including effort, consistency, skills, experience, audience and implementation.
No guarantee is made regarding income, sales, business growth or any other specific result from using these products, resources or services.
DIGITAL PRODUCT REFUNDS
Due to the digital nature of our products, all digital product purchases are final once the product has been supplied, accessed or downloaded.
We do not provide refunds, exchanges or credits for change of mind, including if you:
decide you no longer want or need the product;
purchase the wrong product;
do not use or complete the product;
expected different results; or
change your mind after receiving access to the digital content.
Please carefully read the product description and ensure the product is suitable for you before purchasing.
Once you have been provided access to or downloaded the digital product, you will not be entitled to a change of mind refund.
This policy does not exclude or limit any rights or remedies you may have under the Australian Consumer Law, including where a product or service fails to meet an applicable consumer guarantee.
PERSONALISED SERVICES
Personalised services, including 1:1 Product Clarity Sessions and custom video feedback, are created specifically for the individual purchasing the service.
Cancellation, rescheduling and refund availability may depend on whether work has commenced or the service has already been provided.
Nothing in these Terms excludes any rights or remedies that cannot legally be excluded under Australian Consumer Law.
ONSITE CONTENT - CALENDAR BOOKINGS
Calendar bookings made through this website are for an initial consultation or discussion with Onsite Content.
Submitting a booking does not constitute acceptance of a project, guarantee availability for future content services or create an ongoing client relationship.
Please provide accurate contact and business information when making your booking.
If you can no longer attend your scheduled appointment, please provide as much notice as reasonably possible so the appointment can be rescheduled.
If we decide to work together following the consultation, additional project details, pricing, deliverables and relevant terms may be provided separately before paid work begins.
ONSITE CONTENT SERVICES
Any content creation or social media services agreed upon following an initial consultation may be subject to a separate client agreement.
This may cover matters including scope of work, deliverables, payment terms, cancellations and rescheduling, filming permissions, content usage rights, site access and safety, revisions and other project specific requirements.
Booking an initial consultation does not automatically commit you to purchasing an Onsite Content service.
INTELLECTUAL PROPERTY
Unless otherwise stated, content, digital products, resources, templates, videos, branding and materials created by Alex Smith remain the intellectual property of Alex Smith Digital and Onsite Content.
They may not be copied, shared, resold, redistributed, reproduced or used commercially without prior written permission.
Intellectual property and usage rights relating specifically to content created for Onsite Content clients will be addressed in the relevant client agreement where applicable.
PERSONAL RESPONSIBILITY
Information provided by Alex Smith Digital and Onsite Content is based on personal experience, education and general business knowledge and is provided for general educational and informational purposes.
It should not be considered financial, legal, accounting or other professional advice.
You are responsible for your own decisions, actions and implementation.
PRICING
Prices may change at any time.
Future discounts, promotions or changes in pricing do not automatically entitle previous customers to a refund or partial refund.
AUSTRALIAN CONSUMER LAW
Nothing in these Terms & Conditions is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.
