Terms and Conditions
Last updated: 25 August 2026
These Terms and Conditions ("Terms") apply to products, programs and services purchased from Brianna Donato ("we", "us" or "our"), including through our Stan Store.
By purchasing a product or service, you agree to these Terms. If your purchase is also subject to a separate coaching or service agreement, that agreement will also apply and will take precedence to the extent of any inconsistency relating to that service.
Nothing in these Terms excludes or limits any rights or remedies that cannot lawfully be excluded, including rights under the Australian Consumer Law.
1. Products and Services
The inclusions of each product, program or service are those described on the relevant sales or checkout page at the time of purchase.
Digital and self-paced programs provide access only to the inclusions expressly stated. Unless specifically included, purchasing a self-paced program does not include 1:1 coaching, personalised advice or feedback, private messaging support, or individual program modifications.
Where a purchase includes individual coaching or other personalised services, additional terms or a separate coaching agreement may apply.
2. Educational and Coaching Scope
Our products and services provide education, coaching and practical tools relating to areas including performance, behaviour, self-awareness and nervous system regulation.
They are not medical, psychological, psychiatric or other healthcare services and do not constitute diagnosis, treatment or therapy. They are not a substitute for advice or treatment from an appropriately qualified healthcare professional and are not emergency or crisis services.
You remain responsible for your own decisions, participation and implementation and for obtaining appropriate professional or medical support where necessary.
3. Results
Individual results vary and no particular sporting, performance, behavioural, personal or other outcome is guaranteed.
Testimonials, examples and previous client outcomes are illustrative only and do not guarantee that you will achieve the same results.
4. Intellectual Property and Personal Use
All course materials, videos, recordings, frameworks, methodologies, workbooks, templates, documents, resources and other content supplied by us remain our intellectual property or that of our licensors.
Your purchase grants you a limited, personal, non-exclusive and non-transferable right to use the purchased materials for your own personal use.
You must not copy, reproduce, distribute, share, sell, sublicense, commercially exploit or provide another person with access to paid content without our written permission. Course logins and paid resources must not be shared.
5. Digital Program Access
Access periods are as described when you purchase the relevant product.
Where a product is expressly sold with "lifetime access", this means access for the operational lifetime of that product while it continues to be offered and maintained by us.
We may reasonably update or improve program materials over time.
Access may be suspended or terminated where you materially breach these Terms, including by unlawfully sharing or distributing our content.
6. Prices and Payments
You agree to pay the price displayed or expressly agreed at the time of purchase.
Prices may change and we may offer promotions or discounts from time to time. A subsequent price reduction or promotional offer does not entitle an earlier purchaser to a refund or price adjustment unless expressly stated or required by law.
Where you select a payment plan, you agree to make all instalments according to the payment schedule accepted at purchase. Access may be suspended where a payment legitimately due remains unpaid, subject to applicable law and any separate agreement.
7. Refunds and Consumer Rights
We do not provide refunds solely because you change your mind, decide not to use or complete a product or program, or later find the product available at a different price.
This does not exclude or restrict any rights or remedies available under the Australian Consumer Law or other applicable laws.
Where a product or service fails to meet an applicable consumer guarantee, you may be entitled to a remedy as provided by law.
Any additional refund or cancellation terms expressly offered for a particular product or service will apply alongside these statutory rights.
8. Calls and Coaching Services
Where your purchase includes a scheduled call, you are responsible for booking and attending it.
Unless different terms are provided for the relevant service, cancellations or requests to reschedule should be made at least 48 hours before the scheduled call. Calls cancelled with less than 48 hours' notice or missed without notice may be treated as used, subject to applicable law.
Ongoing or personalised coaching services may also be governed by a separate coaching agreement.
9. Minors
Where a participant is under 18, involvement and consent from a parent or legal guardian may be required.
Where a parent or legal guardian purchases a product or service for a minor, they agree to these Terms in connection with that purchase and are responsible for the minor's participation.
Additional consent or documentation may be required before a minor participates in individual coaching.
10. Third-Party Platforms
Our products and services may use third-party providers such as Stan, Stripe, Skool, Zoom, scheduling software or communication platforms.
We are not responsible for outages or failures caused solely by third-party providers outside our reasonable control. If such an issue materially prevents delivery of something you purchased, we will take reasonable steps to assist and provide any remedy required by applicable law.
11. Privacy and Communications
Personal information will be handled in accordance with applicable privacy laws and our Privacy Policy, where applicable.
By purchasing, you consent to receiving communications reasonably necessary to administer your purchase, including receipts, access instructions and service updates.
Any marketing communications will be managed in accordance with applicable law and available unsubscribe options.
12. Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential losses arising from your use of our products or services where such liability may lawfully be excluded.
Nothing in these Terms excludes or restricts liability, consumer guarantees or other rights that cannot lawfully be excluded.
Participation in sport, exercise and physical activity can involve inherent risks. You remain responsible for making decisions appropriate to your circumstances and obtaining medical or other professional clearance where appropriate.
13. Acceptable Use and Termination
You must not misuse our products, unlawfully distribute our intellectual property, share paid access with unauthorised users, harass other community members, or use our services unlawfully.
We may reasonably suspend or terminate access where you materially breach these Terms, fail to make payments legitimately due, or create a material safety, legal or operational risk.
Where reasonable, we will provide an opportunity to remedy a breach before permanently terminating paid access.
14. Governing Law
These Terms are governed by the laws of Queensland, Australia and applicable Commonwealth laws.
Subject to any rights available to you under applicable consumer laws, you submit to the jurisdiction of the courts of Queensland and courts entitled to hear appeals from them.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
15. Changes and Contact
We may update these Terms from time to time. The Terms applying to a purchase will generally be those accepted at the time of purchase unless a change is required by law or subsequently agreed with you.
Material changes will not retrospectively remove rights relating to an existing purchase.
