Amendments to Terms
Collies With Yen reserves the right to update, modify, or amend these Terms & Conditions at any time without prior notice. Continued access to or use of any course, product, or service after changes have been made constitutes acceptance of the revised Terms.
Important Notice on Unauthorized Use:
All digital products, training materials, videos, downloads, transcriptions, and content provided by Collies With Yen Sdn Bhd are licensed exclusively for your personal use and individual learning. You are strictly prohibited from duplicating, sharing, redistributing, transferring, selling, or otherwise providing any purchased content to third parties. You may not copy, transcribe, reproduce, or modify any content (in full or in part) to "make it your own," sell, or use it in any unauthorized context.
This prohibition applies to all users, with an especially firm restriction for dog training professionals or dog training professionals in-training, who are explicitly prohibited from copying, mimicking, repackaging, or otherwise using any content, methodologies, techniques, or materials from Collies With Yen Sdn Bhd in their professional services, products, or offerings. Any violation will result in immediate termination of your access to all content without warning, refund, or compensation, and will lead to legal action, including monetary damages and penalties.
Copyright & Content Protection:
All course materials are protected under copyright. You may not recreate, repurpose, record, or upload any lesson, exercise, script, demonstration, or explanation from this course in any format, including but not limited to video, audio, written posts, livestreams, or social media content.
Any attempt to reproduce, distribute, or publish course content (including “reinterpretations” or recreations of lessons) is strictly prohibited and will be treated as copyright infringement.
Violation of this clause will result in immediate removal of access to all courses and products without notice or refund. Further legal action will be taken if necessary.
Social Media Access Notice:
Purchasing any digital product from Collies With Yen Sdn Bhd does not entitle you to continued access or interaction via any social media platform. Access to social media content is not included in your purchase agreement. Collies With Yen Sdn Bhd reserves the right to block or restrict your access to its social media platforms at its sole discretion. Such actions are entirely separate from your purchase or your access to purchased digital products, and no refunds or compensation will be provided based on changes to your social media access.
Private Facebook Community Access:
The private Facebook group community hosted by Collies With Yen Sdn Bhd is intended exclusively for dog guardians who are not professionally involved in the dog training industry. Dog training professionals and individuals affiliated with the dog training industry are explicitly not entitled to join or participate in this community. This policy ensures that community members can openly discuss personal training challenges and experiences without professional oversight or unsolicited advice. If it is determined that a member is a dog training professional, their access will be revoked immediately without prior notice, refund, or compensation. Collies With Yen Sdn Bhd reserves the sole right to determine membership eligibility.
Results and Guarantee Disclaimer:
Results from using any products, resources, or training methods provided by Collies With Yen Sdn Bhd are not guaranteed. Your success depends entirely on your individual effort, consistency, implementation, and unique circumstances, including your dog's specific temperament, health, training history, and environment. Collies With Yen Sdn Bhd makes no representations, warranties, or guarantees regarding specific outcomes or improvements. By purchasing or using these resources, you acknowledge and accept that results will vary significantly from person to person and dog to dog, and no specific outcome can be assured.
Refund Policy:
Due to the digital nature of the products, all sales are final. Collies With Yen Sdn Bhd does not offer refunds or compensation for any reason once a purchase has been completed.
Lifetime Access Definition:
The term "Lifetime Access" means your access will be maintained for as long as the digital product remains hosted on our platforms. In the event of circumstances beyond our control, including but not limited to the creator's demise or platform failure, the Company cannot be held responsible, and no refunds or compensation will be provided.
Payment and Pricing:
You agree to pay for all products purchased from Collies With Yen Sdn Bhd and acknowledge responsibility for timely payment. Product prices may change at any time without prior notice, and no price protection or refunds will be provided in the event of a reduction or promotional offering.
Indemnity:
You agree to indemnify and hold harmless Collies With Yen Sdn Bhd, its directors, employees, and agents from all liabilities, claims, damages, and expenses, including attorney's fees, arising from your breach of these Terms and Conditions, violation of laws, or misuse of the Site or content provided.
Right to Refuse Service & Cancellation:
Collies With Yen Sdn Bhd reserves the right to refuse service to any prospective client, or to discontinue services with an existing client, at any time for any reason. If the Company chooses to exercise this right and terminate a client relationship for convenience (where no material breach of terms has occurred), the Company will issue a full ($100%) refund of the purchase price paid for that specific service, course, or digital product. Upon issuance of the full refund, access to all associated digital platforms, courses, and materials will be deactivated immediately, and neither party shall have further obligations or liability to the other.
Termination of Access:
Collies With Yen Sdn Bhd reserves the right to terminate or suspend your access to purchased materials or digital platforms immediately and without prior notice if any of the Terms are violated, including but not limited to unauthorized sharing of materials, intellectual property infringement, or engaging in abusive behavior toward Company personnel or other clients. In the event of termination for a material breach of these terms, no refunds or compensations will be issued.
Technical Issues and Downtime:
Collies With Yen Sdn Bhd shall not be held liable for temporary downtime, technical glitches, or interruptions in access that are beyond its direct control. No refunds or compensation will be provided for disruptions caused by technical or internet connectivity issues.
User Responsibility and Dog Welfare:
You acknowledge and accept full responsibility for ensuring your dog's welfare, safety, and comfort while using any training methods or resources provided. Collies With Yen Sdn Bhd shall not be held liable for any misuse, misinterpretation, or inappropriate application of training techniques. It is your sole responsibility to apply methods safely and humanely, taking into account your individual dog's needs and limitations.
Governing Law and Jurisdiction:
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of Malaysia. You agree that any dispute arising out of or relating to these Terms and Conditions or your use of products and services provided by Collies With Yen Sdn Bhd shall first be attempted to be resolved through amicable negotiation. If a resolution cannot be reached amicably, you expressly agree to submit exclusively to the jurisdiction of the courts of Malaysia for resolution. You acknowledge and agree that pursuing legal claims outside of Malaysia is explicitly prohibited by these Terms, and any attempt to do so will constitute a violation of this agreement.
Modification of Terms:
Collies With Yen Sdn Bhd reserves the right to modify or update these Terms and Conditions at any time without prior notice. You are responsible for regularly reviewing these Terms to stay informed of any updates or changes. Continued use of products and services signifies your acceptance of the updated Terms.
Product Delivery:
All products provided by Collies With Yen Sdn Bhd are entirely digital and no physical products will be shipped. This has been clearly indicated prior to purchase, and therefore refunds based on expecting physical delivery are not eligible.
Acknowledgments:
Collies With Yen Sdn Bhd openly acknowledges the valuable expertise of Yachi Hirai, Emma Gray, Carol Price, Nij Vyas, Gwyn Jones, and Kay Laurence in the field of border collie behavior and sheep herding, whose public works and teachings have greatly influenced and inspired our independent learning and methods. Collies With Yen Sdn Bhd explicitly clarifies that none of these experts have personally endorsed or directly contributed to our content. All materials provided are independently developed, original, and reflect only our own interpretations, applications, and experiences.
Herding Game Coaching — Additional Terms
These additional terms apply specifically to purchasers of Herding Game Coaching ("the Service") in addition to the general Terms and Conditions of Collies with Yen Sdn Bhd
1. Confidentiality of Feedback
All feedback, written notes, video commentary, and any other coaching material provided to you through the Service is intended solely for your personal use and the training of the one specific dog enrolled in your coaching slot.
You agree not to share, redistribute, publish, post, screenshot, transcribe, summarise, repurpose, or otherwise disclose any coaching feedback to any third party, including but not limited to other dog owners, dog trainers, online communities, social media platforms, students, or clients. This includes both direct sharing of materials and indirect sharing such as paraphrasing or rewriting our feedback in your own words.
Feedback is delivered under the express understanding that it is part of a private one-to-one coaching relationship and is not licensed for any other use.
2. Video Footage and Privacy
Any training footage you upload to YouTube as part of the Service must be set to Unlisted privacy status and remain Unlisted at all times during and after your coaching enrolment.
Videos uploaded as part of the Service must not be made Public, shared on social media, included in monetised content, embedded on public websites, or otherwise distributed beyond the private coaching workspace, unless you have written permission from us in advance.
This protects both the privacy of our coaching relationship and the integrity of the feedback you receive.
3. Use of Feedback in Professional Capacity
The Service is provided exclusively for coaching on your own dog. You may not enrol in the Service for the purpose of applying our feedback to clients' dogs, students' dogs, or any dogs other than the one specifically named in your intake.
Dog trainers, behaviourists, and other professionals are welcome to enrol for their own personal dogs but must not use the feedback received as the basis for advice given to their own clients or in any professional capacity.
4. Intellectual Property
All coaching feedback, written materials, methodologies, terminology, frameworks, and proprietary content shared through the Service remain the intellectual property of Collies with Yen Sdn. Bhd. You are granted a limited, non-transferable licence to use this material for your own training with the one dog enrolled in your coaching slot.
You may not reproduce, republish, teach, sell, or commercialise any part of the coaching content in any form.
5. Breach
Any breach of these terms may result in immediate termination of your coaching access without refund. We reserve the right to take further action where appropriate.
6. Acceptance
By purchasing access to the Service, you confirm that you have read, understood, and agreed to these additional terms in addition to our general Terms and Conditions.
