Introduction
Please read these Terms & Conditions carefully before accessing the Digital Caregiver online storefront or purchasing any products or services.
These Terms & Conditions govern your use of the Digital Caregiver online storefront at https://stan.store/digitalcaregiverkij and your purchase of personalized digital products offered by Digital Caregiver, a sole proprietorship operated by Sckeitha Jones in Texas.
By placing an order, you agree to these Terms & Conditions. If you do not agree, please do not place an order.
1. Website Content and Intellectual Property
All content, products, services, graphics, artwork, designs, photographs, text, and other materials made available through Digital Caregiver (the "Company") are owned by Digital Caregiver or used with permission from their respective owners, subject to applicable intellectual property laws.
Digital Caregiver grants visitors a limited, non-exclusive, non-transferable license to access and view website content for personal informational and purchasing purposes.
Customers who purchase personalized digital stickers receive a non-exclusive, non-transferable license to use their completed designs for personal purposes, including posting and displaying them on social media platforms such as TikTok.
Purchasing a digital product does not transfer ownership of Digital Caregiver's original artwork or intellectual property rights to the customer.
Customers may not resell, redistribute as standalone digital files, sublicense, or commercially reproduce Digital Caregiver's original designs without prior written permission.
Customer-provided photographs, images, names, and other materials remain the property of their respective owners. Digital Caregiver's rights to use those materials are addressed in Section 6.
All rights not expressly granted are reserved by Digital Caregiver, subject to applicable law and third-party rights.
2. Copyright and Ownership
Original content created and owned by Digital Caregiver, including text, graphics, digital artwork, designs, videos, and other creative materials, is protected by applicable copyright and intellectual property laws to the extent such protection is available.
Customers who purchase personalized digital products are granted permission to use their completed designs for personal purposes, including use on TikTok and other social media platforms, as outlined in Section 1.
Purchasing a digital product does not transfer ownership of Digital Caregiver's original artwork or intellectual property rights. Customer-provided materials remain the property of their respective owners.
Unauthorized resale, redistribution, or commercial reproduction of Digital Caregiver's legally protected original content is prohibited without prior written permission.
Nothing in these Terms claims exclusive copyright ownership over material that is not eligible for copyright protection under applicable law.
3. Trademarks and Third-Party Rights
Digital Caregiver respects the trademarks, copyrights, intellectual property rights, privacy rights, and publicity rights of others.
Business names, logos, trademarks, original artwork, and other protected materials displayed on the storefront belong to Digital Caregiver or their respective owners.
Customers requesting personalized digital stickers must own or have the necessary rights or permissions to use any photographs, names, logos, images, or other materials they submit.
Digital Caregiver will use customer-submitted photographs and personal images for the purpose of creating, revising, and delivering the requested personalized products, unless additional permission is obtained or another use is permitted or required by law.
Digital Caregiver reserves the right to decline or cancel orders involving materials that may violate intellectual property rights, privacy rights, applicable laws, or these Terms & Conditions.
If you believe content displayed or sold by Digital Caregiver infringes upon your intellectual property rights, please contact digitalcaregiverkij@gmail.com.
Please include your name, contact information, a description of the protected material, the location of the allegedly infringing content, and relevant supporting information.
4. Accuracy of Website Information
Digital Caregiver makes reasonable efforts to ensure that product descriptions, pricing, and other information displayed on its online storefront are accurate and up to date.
However, occasional errors, omissions, or inaccuracies may occur. Digital Caregiver reserves the right to correct such errors and update storefront information as necessary.
If an error affects a customer's purchase, Digital Caregiver will make reasonable efforts to notify the customer and provide an appropriate resolution in accordance with applicable law.
Digital Caregiver does not guarantee that all storefront information will be free from errors at all times.

These communications will be sent to the email address provided during checkout.
Digital Caregiver may offer customers the opportunity to receive promotional emails, special offers, product announcements, and business updates. Marketing communications will be sent in accordance with applicable consent and other legal requirements.
Customers may unsubscribe from promotional emails using the unsubscribe instructions provided in those messages.
Unsubscribing from promotional communications will not prevent customers from receiving necessary transactional emails related to their purchases.
6. Customer Submissions and Intellectual Property
By submitting photographs, images, names, text, design ideas, or other materials to Digital Caregiver for personalized digital products, customers confirm that they own or have obtained the necessary rights and permissions to use those materials.
Customers retain ownership of their original photographs, images, and other submitted materials. By submitting these materials, customers grant Digital Caregiver a limited, non-exclusive license to use, modify, and incorporate them for the purpose of creating, revising, and delivering their purchased personalized digital products.
Digital Caregiver retains any applicable intellectual property rights in its original artwork and creative contributions, subject to the rights of customers and third parties.
Upon purchase, customers receive a non-exclusive, non-transferable license to use their completed digital stickers for personal purposes, including use on TikTok and other social media platforms.
Customers may not resell, redistribute as standalone files, or commercially reproduce Digital Caregiver's protected original artwork without prior written permission.
Digital Caregiver will not publicly display, advertise, or use customers' personal photographs or completed personalized designs for promotional purposes without obtaining their permission.
Digital Caregiver reserves the right to decline requests involving materials that infringe upon the intellectual property, privacy, or other legal rights of third parties.
7. Data Security
Digital Caregiver takes reasonable measures to protect customer information, personal photographs, digital files, and other materials submitted through its storefront or provided for personalized digital product orders.
Digital Caregiver uses third-party service providers, including Stan Store and Stripe, to facilitate online transactions and payment processing. These providers maintain their own security practices and privacy policies.
While Digital Caregiver makes reasonable efforts to protect customer information, no online platform, electronic communication, or data storage system can be guaranteed to be completely secure.
Digital Caregiver will use customer-submitted information and materials for legitimate business purposes, including processing orders, creating personalized digital products, communicating with customers, and delivering completed purchases, except as otherwise permitted or required by law.
Digital Caregiver will take reasonable steps to address suspected unauthorized access to customer information and comply with applicable data protection and notification requirements.
8. Privacy
Digital Caregiver respects the privacy of its customers and is committed to handling personal information responsibly.
Personal information collected during the purchasing process, including names, email addresses, photographs, and other materials submitted for personalized digital products, will be used for legitimate business purposes, including processing payments, fulfilling orders, communicating with customers, and delivering completed digital products.
Digital Caregiver may share necessary customer information with third-party service providers, including Stan Store, Stripe, and other services used to process transactions and fulfill orders.
Digital Caregiver will not sell customers' personal information or use their personal photographs for advertising or promotional purposes without appropriate permission.
Customer information may also be disclosed when required by applicable law or when reasonably necessary to protect legal rights.
Additional information regarding the collection, use, storage, retention, and protection of personal information will be provided in Digital Caregiver's separate Privacy Policy.
By using the storefront or purchasing products, customers acknowledge that their personal information will be handled as described in the applicable Privacy Policy.
9. Disclaimer of Warranties
Digital Caregiver makes reasonable efforts to provide high-quality digital products and accurate information regarding its products and services.
Digital products, including personalized stickers, graphics, and other custom designs, will be provided in accordance with the descriptions and specifications agreed upon at the time of purchase.
While Digital Caregiver strives to ensure customer satisfaction, individual preferences regarding artistic style, appearance, colors, and design elements may vary. Digital Caregiver does not guarantee that every design will meet a customer's subjective expectations.
Digital Caregiver will make reasonable efforts to correct errors in completed products that do not conform to the agreed-upon design specifications.
Digital Caregiver does not guarantee uninterrupted access to its storefront or third-party platforms, including Stan Store, Stripe, TikTok, or other services used to process, deliver, or display digital products.
Digital Caregiver is not responsible for interruptions, technical failures, or changes to third-party platforms beyond its reasonable control.
Nothing in these Terms & Conditions excludes or limits any rights, remedies, warranties, or liabilities that cannot legally be excluded or limited under applicable law.
Customers are encouraged to review product descriptions and communicate their design preferences before purchasing personalized digital products.
10. Third-Party Services, Cancellations, and Refunds
Digital Caregiver uses third-party platforms and service providers, including Stan Store, Stripe, and other digital services, to process payments, manage customer orders, and deliver digital products.
Digital Caregiver is not responsible for technical interruptions, system outages, or service failures caused by third-party providers beyond its reasonable control. However, Digital Caregiver will make reasonable efforts to assist customers in resolving issues affecting their purchases.
Digital Caregiver reserves the right to decline or cancel orders involving inappropriate content, unauthorized use of copyrighted materials, violations of applicable laws, or requests that fall outside the scope of services offered.
Custom Digital Product Refund Policy
Because personalized digital stickers are created specifically for each customer, the following refund and cancellation terms apply:
Before Design Work Begins: Customers may request cancellation and a full refund before work on their personalized design has started.
After Design Work Begins: Orders generally become non-refundable once custom design work has started, except where otherwise required by law or these Terms & Conditions.
Design Revisions: Each custom sticker purchase includes one reasonable revision within the original agreed-upon design concept. Additional revisions or significant design changes may require an additional fee.
Incorrect or Defective Files: If a completed digital product contains an error attributable to Digital Caregiver or does not meet the agreed-upon specifications, Digital Caregiver will make reasonable efforts to correct the issue or provide an appropriate remedy.
Failure to Deliver: If Digital Caregiver cannot fulfill a paid order, the customer will receive a refund for the undelivered product.
Third-Party Platform Restrictions: Digital Caregiver cannot guarantee that a digital sticker will be accepted or displayed by TikTok or other third-party platforms, particularly when platform requirements or eligibility restrictions apply.

Nothing in this policy limits consumer rights or remedies that cannot legally be waived under applicable law.
11. Payments, Pricing, and Digital Product Delivery
By purchasing products or services from Digital Caregiver, customers agree to pay the full purchase price, including any applicable taxes and fees disclosed during checkout.
All payments must be completed before work begins on personalized digital products. Payments are processed through authorized third-party payment providers, including Stripe.
Digital Caregiver reserves the right to adjust product prices, introduce promotional offers, or discontinue products at any time. Price changes will not affect orders that have already been purchased and confirmed.
Each personalized digital sticker purchase includes one custom design and one reasonable revision within the original agreed-upon design concept. Additional revisions, significant design changes, or additional design requests may require separate payment.
Completed digital products will be delivered electronically in the format specified in the product description, generally as a high-quality PNG file with a transparent background.
Estimated turnaround times will be communicated at the time of purchase. Delivery timelines begin once payment has been received and all necessary design information and reference materials have been provided.
If technical difficulties prevent successful delivery, Digital Caregiver will make reasonable efforts to resolve the issue and provide the purchased product.
All cancellations, refunds, and remedies for undelivered or defective products will be handled in accordance with Section 10 of these Terms & Conditions and applicable law.
Digital Caregiver does not guarantee that personalized digital products will be accepted by third-party platforms, including TikTok, where eligibility requirements, technical specifications, or platform policies may apply.
12. Limitation of Liability
To the fullest extent permitted by applicable law, Digital Caregiver shall not be liable for indirect, incidental, special, punitive, or consequential damages arising from the use of its storefront, digital products, or services, including lost profits, business interruptions, or loss of data.
Digital Caregiver is not responsible for technical difficulties, service interruptions, or changes to third-party platforms, including Stan Store, Stripe, TikTok, or other external services, that are beyond its reasonable control.
Digital Caregiver will make reasonable efforts to fulfill customer orders, deliver purchased digital products, and address errors or technical issues within its control.
Nothing in this section limits Digital Caregiver's obligations to provide refunds, corrections, or other remedies as described in Sections 10 and 11.
Nothing in these Terms & Conditions excludes or limits liability that cannot legally be excluded or restricted under applicable law.
13. Customer Communication and Design Approvals
Customers purchasing personalized digital products from Digital Caregiver are responsible for providing accurate contact information, design instructions, and any necessary reference photographs or materials.
Digital Caregiver may contact customers using the email address provided during checkout to request additional information, clarify design details, provide updates, or obtain approval of completed designs.
Customers are encouraged to respond promptly to requests for additional information to avoid delays in processing their orders.
Estimated production and delivery timelines begin once payment has been received and all required design information and materials have been provided.
Each personalized digital sticker includes one reasonable revision within the original agreed-upon design concept. Additional revisions or substantial design changes may require an additional fee.
If a customer does not respond to requests for necessary information or design approval, the order may be placed on hold until communication resumes.
Any cancellation or refund requests will be handled in accordance with Section 10 of these Terms & Conditions and applicable law.

14. Customer Responsibility and Indemnification
Customers agree that any photographs, images, logos, artwork, text, or other materials they provide to Digital Caregiver for use in personalized digital products are either owned by them or used with appropriate permission.
Customers are responsible for ensuring that their submitted materials do not violate applicable laws or infringe upon the copyrights, trademarks, privacy rights, publicity rights, or other legal rights of third parties.
To the extent permitted by applicable law, customers agree to indemnify and hold harmless Digital Caregiver from third-party claims, damages, liabilities, and reasonable legal expenses arising directly from:
Materials submitted by the customer that infringe upon another person's intellectual property or other legal rights.
The customer's unauthorized use of photographs, logos, artwork, or other protected materials.
The customer's unlawful use or redistribution of completed digital products.
The customer's material violation of these Terms & Conditions that results in a third-party claim.
This obligation does not apply to the extent a claim or loss results from Digital Caregiver's own negligence, misconduct, or unauthorized use of customer materials.
Digital Caregiver reserves the right to decline design requests involving materials that appear to violate applicable laws or the rights of others.
Nothing in this section limits any rights or protections that cannot legally be waived under applicable law.
15. Governing Law and Severability
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the State of Texas, without regard to its conflict-of-law principles, except where applicable law requires otherwise.
Any legal dispute arising from these Terms & Conditions shall be handled by a court of competent jurisdiction, subject to applicable laws governing jurisdiction and venue.
If any provision of these Terms & Conditions is determined to be unlawful, invalid, or unenforceable, that provision shall be considered severable, and the remaining provisions shall continue in full force and effect to the extent permitted by law.
16. Changes to Terms and Conditions
Digital Caregiver reserves the right to update or modify these Terms & Conditions as necessary to reflect changes in business operations, products, services, or applicable laws.
Any updates will be posted on the Digital Caregiver online storefront, along with the effective date of the revised Terms & Conditions.
Updated Terms & Conditions will generally apply to purchases made on or after their effective date. Orders placed before an update will remain subject to the terms in effect at the time of purchase, unless otherwise agreed upon by the customer or required by applicable law.
Customers are encouraged to review these Terms & Conditions before making a purchase.
Continued use of Digital Caregiver's storefront or services after updated terms become effective may constitute acceptance of those changes where permitted by applicable law.
