Academy purchases, access and participation

Version 1.1 | Effective from 1 October 2026

Registered office: 26 Thingwall Road, Irby, Wirral, England, CH61 3UE

About these Terms and your contract

1A. These Terms govern purchases of Elevate Digital Academy made on or after 1 October 2026. ELEVATE WITH OLIVIA LTD ("Elevate", "we", "us" or "our") supplies the Academy. "You" means the purchaser or authorised learner. The "Academy" means the digital training, resources and associated services included in your purchase.

1B. Please read these Terms and the description of your purchase before ordering. By selecting the acceptance checkbox at checkout and placing your order, you agree to these Terms. You do not need to sign or return a separate document. We will provide a copy of the applicable Terms with your order confirmation.

1C. Your contract is with Elevate, including where you arrive through an affiliate referral link. It is formed when your payment, or agreed first instalment, is authorised and we send your order confirmation. Access is then arranged through the onboarding process described below.

1D. The sales description and other information about your purchase that forms part of the contract remain binding. These Terms do not retrospectively cancel or vary a previous purchase agreement or licence. Any change to an earlier agreement must have a valid contractual or legal basis.

1E. A "consumer" is an individual acting wholly or mainly outside their trade, business, craft or profession. Where consumer protections apply, nothing in these Terms removes them. The fact that the Academy teaches business skills does not itself determine your legal status.

Your purchase and payment

2A. The content, resources, access arrangements and support included are those described before you purchase. Separately sold mentoring, consultations, audits or other programmes are included only if expressly stated in your package.

2B. The price, currency, applicable taxes and any compulsory charges will be shown before you pay. The price agreed at checkout applies to your purchase. Later offers or price changes do not change that price. Any promotional conditions must be stated before purchase.

2C. Academy access is purchased for a one-off price, payable in full or through an available instalment arrangement. An instalment arrangement spreads that purchase price; it is not a monthly membership that can simply be stopped at any time. This does not affect a valid cancellation, refund or other legal remedy.

2D. Available payment methods and any third-party credit or instalment terms are displayed at checkout. Any separate arrangement with a payment provider remains subject to that provider's terms and applicable law. We will cooperate with the provider where an agreed or legally required refund affects your payments.

2E. You are responsible for your internet connection and any optional software or services you choose to purchase. Any additional cost that is compulsory to receive the package we sell must be disclosed before purchase.

2F. Learners under the age of 18 may access and complete the Academy training. However, any affiliate agreements, payment accounts, banking arrangements or third-party services requiring the account holder to be aged 18 or over must be opened, agreed to and actively managed by a parent or legal guardian with their full knowledge and consent.

Onboarding and account access

3A. After purchase, follow the instructions in your confirmation email to request access to the Academy community and complete the onboarding form. Provide accurate information that allows us to match your purchase, email address and community account.

3B. Our onboarding process includes identity verification. The information required and the reason for requesting it are explained before purchase and when it is collected. We request only information reasonably necessary for verification. Contact us if you cannot provide the requested document or your details differ so that we can discuss suitable verification arrangements.

3C. We normally verify the payment through our checkout records. Customers purchasing through the current Elevate checkout do not routinely need to forward a receipt. We may request proportionate additional evidence if we cannot match a purchase or identify a specific concern.

3D. Access is subject to completion of the necessary onboarding checks. The expected approval time is stated in the purchase information and confirmation email. If information is missing, we will explain what is needed. If we cannot supply the access you have purchased, we will explain the position and provide any refund or remedy due by law.

3E. Your account is personal to you. Keep sign-in details secure and tell us promptly if you suspect unauthorised use. You must not share, sell, lend or transfer your account or allow another person to access the paid Academy through it.

Lifetime access and Academy changes

4A. "Lifetime access" means access to the Academy's included digital training and resources for the operating life of Elevate Digital Academy. It does not refer to the lifetime of the purchaser. A change of hosting platform does not, by itself, end your access entitlement.

4B. Live sessions, personal support and other services are provided in accordance with the package and duration described at the time of purchase. This clause does not reduce any specific support or access commitment made before you bought.

4C. We may refresh examples, update lessons, reorganise resources and make reasonable technical changes to keep the Academy useful and secure. Such changes will not remove the core content or benefits you purchased without an appropriate alternative, your agreement where required, or any remedy due by law.

4D. If the Academy permanently ceases operating, we will give reasonable notice where practicable and explain the arrangements for existing customers. We will consider reasonable alternatives for continued access to purchased digital materials. This is not a right to end the Academy arbitrarily to avoid our obligations, and your statutory rights remain unaffected.

Support, community and live sessions

5A. We will provide the support, community access and live training included in the offer you purchased. Contact channels, response times and availability are explained in the support information supplied with that offer. An automated or AI support tool being available at any time does not mean human support is available continuously.

5B. Where expressly included for customers purchasing through Olivia's link, one-to-one support means the support described in that offer. It does not include separately sold coaching calls, audits or mentoring unless the offer says so. Extra support independently promised by an affiliate is subject to the arrangements disclosed by that affiliate; this does not remove any responsibility Elevate has under law.

5C. Live-session topics or dates may need to change. We will give notice where reasonably possible and provide a suitable alternative or replacement where needed to meet what was promised. Information about recording and replay availability will be given before a session.

Learning, assessment and results

6A. The Academy provides education and practical guidance. You decide how to apply it and are responsible for your own business decisions, products and customer relationships. We do not guarantee earnings, sales, employment, business growth or recovery of the purchase price.

6B. Examples, testimonials and results describe particular experiences. Outcomes depend on factors including your implementation, offer, audience, circumstances and market conditions. This does not excuse us from supplying the training and services as described.

6C. Any optional CPD assessment or certificate pathway is subject to the completion and assessment requirements explained in that pathway. Purchasing access does not automatically award a certificate or professional licence. Any separate certificate charge must be disclosed before you choose to incur it.

6D. General discussion of legal, tax or financial topics is educational and is not personalised professional advice. Obtain appropriately qualified advice where your circumstances require it.

Intellectual property and permitted use

7A. Copyright and other intellectual-property rights in the Academy, its lessons, scripts, videos, branding, layouts and other protected materials belong to ELEVATE WITH OLIVIA LTD or its licensors. Your purchase gives you a personal, non-exclusive, non-transferable licence to access the supplied materials for your learning and permitted business use; it does not transfer ownership.

7B. Except where a separate resource licence expressly permits it, or the law allows it, you must not copy, record, distribute, upload, sell, sublicense, repackage or make the protected Academy materials available to others. You must not remove rights notices or present our protected content or branding as your own.

7C. You may apply the knowledge and general skills you learn to your own independently created business and products. This permission does not authorise copying the Academy or republishing its protected materials, including by using an AI tool to reproduce or repackage them.

7D. Where we have reasonable grounds to believe infringement has occurred, we may request removal, use platform reporting procedures and pursue available legal remedies. Depending on the circumstances, these may include an injunction, damages and costs awarded by a court. Any restriction of your Academy access will be handled under section 13.

Done-for-you products and separately licensed resources

8A. Certain templates, done-for-you products and other resources have their own commercial-use licences. The licence supplied with the specific item explains any permission to edit, rebrand, sell or distribute it. Those permissions apply to that item, not automatically to the Academy or other resources.

8B. Check the applicable licence before using a resource commercially. A label such as PLR, MRR or "done-for-you" does not by itself grant unrestricted rights. Do not pass on editable files, source files or resale permissions unless the specific licence allows this.

8C. Where you sell a permitted product, you are responsible for checking its accuracy, suitability, customer-facing description and your obligations to your customers. Resource permissions granted with your purchase will not be retrospectively withdrawn arbitrarily.

Optional affiliate participation

9A. Becoming an Elevate affiliate is optional and governed by a separate Affiliate Agreement. Academy purchase alone does not oblige you to promote Elevate or guarantee acceptance into, or earnings from, the affiliate programme.

9B. New Academy purchases under these Terms do not grant Master Resell Rights to the Academy. If you are authorised to promote it as an affiliate, customers purchase through the approved referral and checkout process. You may not collect payment for Academy access through your own separate checkout or give others access through your account.

9C. Commission rates, link use, promotional requirements and affiliate payment arrangements are addressed in the Affiliate Agreement. They do not replace the rights customers have under these purchase Terms.

Cancellation rights and early digital access

10A. Where the statutory cancellation right applies, you may cancel within 14 days beginning the day after the contract is made, without giving a reason. The rules differ for digital content and services, as set out below.

10B. We may supply digital content during that period only with your express consent to early supply. If you also acknowledge that your cancellation right for that content will end when supply begins, and we provide the required contract confirmation, that right ends when supply begins. Accepting these Terms alone is not a substitute for those express choices.

10C. If you do not request early digital supply, supply will begin after the cancellation period. Any onboarding requirements still apply. Your right to a remedy for digital content that is faulty, misdescribed or otherwise fails legal standards remains.

10D. For services, requesting an early start does not automatically remove your cancellation right. If you cancel within the period after expressly requesting a service to begin, a proportionate charge may apply only where the legal conditions are met. The service cancellation right ends on full performance only where the required consent and acknowledgment were obtained.

10E. To cancel, send a clear statement to admin@elevatedigitalacademy.co.uk or our registered office. You may use the separate cancellation form made available before purchase, but any clear statement of cancellation is sufficient. Send your notice before the cancellation period expires. We will make any refund due within the statutory deadline, normally within 14 days of being told you are cancelling, using the original payment method unless otherwise agreed and without an administration fee.

Refunds, problems and payment disputes

11A. Unless a separate guarantee was included in your purchase, we do not offer a discretionary change-of-mind refund for digital content after it has been supplied and the relevant statutory cancellation right has validly ended. This does not limit section 10, service cancellation rights or any other legal remedy.

11B. Digital content must meet the standards required by law, including being as described, of satisfactory quality and fit for any particular purpose we have agreed. Services must be provided with reasonable care and skill. Depending on the problem and applicable law, you may be entitled to repair, replacement, repeat performance, a price reduction or a refund.

11C. Contact us with your order details and a description of any problem so that we can investigate and help. You do not have to waive legal rights, accept a credit instead of a refund that is due, or use our complaint process before exercising a right available through your bank or payment provider.

11D. A genuine chargeback request, complaint or payment dispute is not automatically a breach of these Terms. Fraudulent claims or knowingly false evidence may be investigated, and we may provide relevant transaction and access evidence to the payment provider. We will not impose an automatic penalty merely because you raise a dispute.

Community conduct and confidentiality

12A. Treat members, contributors and staff respectfully. Harassment, threats, discriminatory abuse, impersonation, fraud and unlawful activity are prohibited. Do not post malicious software or content that infringes another person's rights.

12B. Do not use the Academy community, its member list or unsolicited messages to members to sell, recruit for or promote your own or third-party offers without our prior written permission. This includes unsolicited coaching pitches, affiliate recruitment and attempts to divert members into external paid programmes.

12C. Do not scrape member information, share private messages or publish another member's personal information without a lawful basis. Respect confidential business or personal information disclosed during support or private sessions.

12D. These rules do not prevent an honest review, a genuine complaint, a lawful disclosure to an adviser or regulator, or reporting suspected wrongdoing. Permission to use a testimonial, screenshot or recording publicly must be obtained separately where required.

Enforcement, suspension and removal

13A. We may remove prohibited content, restrict community participation, suspend access or terminate this agreement where reasonably justified by a serious or repeated breach of these Terms. In deciding what action is appropriate, we will consider the nature of the breach, the evidence available, its effect on others and whether it can be remedied.

13B. We may act immediately, without a prior warning or discussion, where reasonably necessary to stop serious misconduct or protect members, staff, confidential information, intellectual property or system security. Examples include threats, serious harassment, fraud, deliberate distribution or resale of protected Academy content, deliberate account sharing, unlawful disclosure of member information and serious or repeated unauthorised solicitation of members.

13C. Where there are reasonable grounds to suspect serious misconduct, we may impose a temporary protective restriction while we investigate. A suspicion alone does not automatically establish a breach. We will review the restriction and restore access if it is no longer justified. A sufficiently serious breach may result in immediate permanent removal without a prior warning or opportunity to repeat the conduct.

13D. For a breach that can reasonably be put right and does not require immediate removal, we will normally give a warning and a reasonable opportunity to remedy it. Continued or repeated breaches after a warning may lead to permanent removal. We are not obliged to issue repeated warnings before taking proportionate action.

13E. We will give a brief reason for a suspension or termination, at the time or as soon afterwards as reasonably practicable. We do not have to disclose the identities of complainants, another person's private information, confidential security measures or material whose disclosure would prejudice a legitimate investigation, except where required by law. We may withhold or limit details where legally required or reasonably necessary to protect those interests.

13F. You may ask us to review a decision by emailing our contact address with relevant information. You do not have a right to insist that access continues during a justified suspension or after lawful termination. Following lawful termination, you must stop accessing the Academy and must not evade a restriction by using another account or identity. Any separately granted resource licence remains governed by its own terms.

13G. Termination for breach does not itself create a right to a discretionary refund, but we will honour any statutory entitlement. We may retain sums or seek recovery of evidenced losses only where lawful and proportionate; no automatic penalty or blanket forfeiture applies. Legal enforcement of intellectual-property rights remains available under section 7. Honest reviews, genuine complaints and the lawful exercise of consumer rights are not grounds for removal.

Privacy and recordings

14A. Our separate Privacy Policy explains how we collect, use, share and retain personal information. It is made available with these Terms and at relevant collection points, including onboarding. You may also request a copy using our contact email.

14B. Accepting these Terms is not blanket consent to marketing, public use of your image or every use of your personal information. Where consent is required, we will request it separately. Information about recordings and their intended audience will be provided before relevant live sessions.

Availability and responsibility

15A. We will take reasonable steps to provide the Academy as promised, maintain access and address faults. You need a suitable internet connection, an email account and a compatible device capable of using the hosting platform and viewing the supplied formats. Any unusual technical restrictions must be disclosed before purchase.

15B. Third-party platforms have their own account and acceptable-use terms. Their involvement does not remove our responsibility for fulfilling our contract with you. If an outage, platform change or event outside our reasonable control affects delivery, we will explain material disruption where practicable and take reasonable steps to limit its impact.

15C. We are responsible for loss or damage for which we are legally liable, including foreseeable loss caused by our breach or failure to use reasonable care and skill. We do not exclude liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or anything that cannot lawfully be excluded. Statutory remedies remain available.

Changes to these Terms

16A. A later version normally applies to purchases made after its stated effective date. It does not automatically reduce rights already obtained under an earlier purchase.

16B. Necessary changes affecting an existing contract may be made to comply with law or to address reasonable security or technical requirements, provided they are fair and do not undermine the substance of your purchase. We will explain material changes in advance where practicable, obtain agreement where required and provide any right to cancel or other remedy required by law.

Complaints and governing law

17A. Send complaints to admin@elevatedigitalacademy.co.uk with enough information to identify your purchase and the issue. We will investigate fairly and explain our response. This does not prevent you from obtaining independent advice, contacting a regulator or using a court or other remedy available to you.

17B. These Terms are governed by the law of England and Wales. If you are a consumer, this does not remove mandatory protections available under the law of your country of residence or any right to bring proceedings in courts available to you under that law.

17C. If a provision is found unenforceable, the remaining provisions continue so far as legally possible. Delay in enforcing a right does not itself waive that right. Any transfer of our contract to another provider must preserve your contractual and statutory protections. These Terms do not create a partnership or employment relationship.
