日本にお住まいの購入者には、この日本語版の規約が適用されます。日本国外にお住まいの購入者には、英語版(Terms & Conditions)が適用されます。
本サイトの利用、または商品の購入の前に、本規約をよくお読みください。haruscuisine.com、および HARU's Cuisine が運営する関連サイト・ストア(以下「本サイト」)へのアクセス、または購入手続きの完了をもって、本規約に同意したものとみなします。同意いただけない場合は、本サイトのご利用および購入をお控えください。
第1条(適用範囲)
本規約は、本サイト、ならびに HARU's Cuisine(以下「当方」)が提供するレシピ、コース、動画、PDF、教材、コーチング・コンサルティングサービス、その他の商品・サービス(以下あわせて「本コンテンツ」)に適用されます。
第2条(利用許諾と個人利用)
1. 購入者には、購入により、本コンテンツを個人的・非営利・家庭内の目的でのみ利用できる、非独占的で、譲渡および再許諾のできない利用権を与えます。
2. 購入者は、本コンテンツを、自分自身の個人的な利用のために、閲覧・ダウンロード・印刷できます。
3. 購入により、本コンテンツの権利が購入者に移転することはありません。
第3条(知的財産権)
1. 本サイトおよび本コンテンツに含まれるレシピ、文章、写真、動画、音声、イラスト、デザイン、名称、ロゴ、その他一切の素材の権利は、当方または正当な権利者に帰属し、著作権法その他の法令により保護されています。
2. 購入者は、スクリーンショットや画面録画を含め、当方の事前の書面による許可なく、本コンテンツを複製、転載、再投稿、アップロード、送信、配布してはいけません。
3. 購入者が作った料理の写真は、個人のSNSに投稿できます。その際は、@harus_cuisine をクレジットとして記載してください。レシピの文章、分量、手順は、掲載しないでください。
第4条(禁止事項)
購入者は、当方の事前の書面による許可なく、次の行為をしてはいけません。
1. 本コンテンツ、またはアクセス権・ログイン情報の、販売、転売、貸与、再許諾、第三者との共有
2. SNS、ブログ、グループ、コミュニティ、クラウド共有サービス等への、本コンテンツのアップロードおよび再配布
3. 飲食店、カフェ、ケータリング、ポップアップ、商品化、有料クラスなど、商用目的での、本コンテンツやレシピの利用
4. 本コンテンツを、全部または一部を改変して、自分のレシピ、講座、書籍、教材として発表すること
5. 本コンテンツを、AIの学習に利用すること、またはスクレイピングやデータベース化を行うこと
6. 法令または他者の権利に違反する行為
第5条(商用ライセンス)
事業目的でレシピや資料を利用したい場合は、事前に harus.cuisine@gmail.com までご連絡ください。個別の相談とライセンス契約を結びます。
第6条(違反があった場合の対応)
1. 購入者が第3条または第4条に違反した場合、当方は、法令で認められる範囲で、次の対応をとることがあります。
・違反行為の中止と、投稿・掲載物の削除の要求
・返金なしでの、本コンテンツへのアクセスの停止または取消し
・プラットフォームやサービス提供者への、削除申請
・弁護士費用など合理的な範囲の費用を含む、損害賠償の請求、およびその他の法的措置
2. 当方は、違法、攻撃的、名誉毀損、権利侵害など、法令・第三者の権利・本規約に反すると合理的に判断する内容やアカウントを、削除または停止できます。
3. 本サイトの内容により、ご自身の権利が侵害されていると思われる方は、harus.cuisine@gmail.com まで、次の情報を添えてご連絡ください。お名前と連絡先、権利の内容、侵害の内容とURL、関連する登録情報など。
第7条(お支払い・デジタルコンテンツ・返金)
1. 購入者は、購入する商品の代金を支払い、有効な支払い方法を提供するものとします。
2. 価格は、変更されることがあります。値下げやキャンペーンによる、差額の返金や価格保証はありません。
3. 本コンテンツはデジタルコンテンツであり、提供後すぐに複製が可能なため、購入後の返金・キャンセルはできません。ご利用にならなかった場合や、ご満足いただけなかった場合も同様です。
4. 次の場合は、返金または再提供をします。
・同じ商品が二重に決済された場合
・ファイルが破損している、または閲覧できず、当方でも解消できない場合
・購入後に商品が提供できなくなった場合、または技術的な問題で、提供が不当に遅れた場合
ご連絡は、購入後【7】日以内にお願いします。
5. 本条は、購入者の居住国の強行法規により認められる権利を制限しません。
第8条(コンサルティングのご予約)
1. 本条は、HARU's Cuisine のコンサルティング・コーチング(以下「コンサルティング」)を予約された方に適用されます。
2. コンサルティングは、レシピやコースとは別に予約・お支払いいただくものです。それらの購入には含まれません。
3. 日程調整は、購入者ご自身で行ってください。予約後の返金はできません。
4. キャンセル・日程変更は、セッションの48時間前までに、harus.cuisine@gmail.com へメールしてください。件名は「CONSULTATION CANCELLATION – [日時]」としてください。
5. 無断欠席、またはセッションの48時間前を過ぎてからのキャンセル・変更は、そのセッションの権利が失効します。返金や振替はできません。
6. 当方の都合でキャンセル・変更する場合は、別の日時をご提案するか、返金します。
7. コンサルティングは、一般的な助言とアイデアを提供するものです。事業の収益や売上を含め、特定の結果は保証しません。
8. コンサルティングで共有するレシピ、資料、助言は、購入者ご自身の利用に限ります。当方の書面による許可なく、録画、再配布、販売はできません。
第9条(安全・アレルギー)
1. 調理には、火傷、切り傷、転倒、アレルギー反応などのリスクが伴います。
2. 基本的な安全・衛生管理、機材の適切な使用、原材料のアレルゲンの確認は、購入者の責任で行ってください。植物性の食材でも、アレルゲンを含む場合があります。
3. 発酵、保存、加熱を伴うレシピは、衛生管理と保存条件に、購入者の責任で注意してください。
4. お子様や、調理に不慣れな方が調理する場合は、常に見守ってください。18歳未満の方が利用する場合は、保護者が調理を見守り、その安全と行動について責任を負うものとします。
第10条(結果の非保証)
1. 仕上がりは、購入者の技術、食材、機材、環境などにより異なります。味、食感、保存性、事業の収益など、特定の結果は保証しません。
2. 当方は、本コンテンツを正確で最新の内容にするよう、合理的な努力をしますが、誤りがないこと、中断なく提供されることは保証しません。
3. 購入者は、情報の活用方法について、自らが責任を負うものとします。
第11条(免責・責任の制限)
1. 法令で認められる最大限の範囲で、本サイトと本コンテンツは、現状有姿で提供します。明示・黙示を問わず、いかなる保証もしません。
2. 当方に故意または重過失がある場合を除き、法令で認められる範囲で、当方は、特別損害、間接損害、逸失利益(収益・データ・信用の損失を含む)について責任を負いません。
3. 当方に故意または重過失がある場合を除き、当方が購入者に対して損害賠償責任を負う場合の総額は、該当する商品に購入者が支払った代金の額を上限とします。
4. 本規約のいかなる規定も、詐欺、故意、重過失による責任など、法令上免除できない責任や、消費者契約法その他の強行法規により認められる購入者の権利を制限しません。
5. Stan、Stripe、通信事業者、購入者の端末やソフトウェアなど、第三者のサービスに起因する問題について、当方は責任を負いません。これらの問題は、購入者とその提供者との間の契約によります。
6. 当方は、データやファイルの保護について、商業上合理的な努力をしますが、絶対に安全なシステムはありません。
第12条(補償)
法令で認められる範囲で、購入者は、本規約への違反、法令や第三者の権利の侵害、または本サイトに関連して投稿・共有した内容に起因する、請求、損害、費用(合理的な弁護士費用を含む)から、当方を免責するものとします。
第13条(コンテンツの更新・変更、規約の改定)
1. 当方は、予告なく、本コンテンツや本サイトを、更新・変更・削除できます。
2. 購入者が利用できるのは、購入時点で提供されていた版の本コンテンツです。当方が別途示した場合を除きます。
3. 当方は、本規約を改定し、改定後の規約を掲載できます。改定は、掲載した時点から効力を生じますが、購入済みの商品には影響しません。
第14条(個人情報・連絡)
1. 当方は、購入者の個人情報を、商品の提供、連絡、サポートの目的でのみ利用します。法令に基づき開示が必要と誠実に判断した場合、または本規約の執行に必要な場合を除き、第三者に開示しません。決済情報は、決済事業者(Stan、Stripe等)が管理します。詳細は、プライバシーポリシーをご確認ください。
2. 購入または登録により、購入に関するお知らせをメールで受け取ることに同意したものとみなします。マーケティング目的のメールは、いつでも配信停止できます。
第15条(ご意見・ご提案)
購入者が当方に送ったご意見やご提案は、当方が、対価や義務なく、自由に利用できるものとします。
第16条(準拠法・管轄)
1. 本規約は、日本法に準拠し、日本法に従って解釈されます。
2. 本コンテンツに関して紛争が生じた場合は、大阪地方裁判所を第一審の付加的合意管轄裁判所とします。ただし、法令により購入者の住所地の裁判所に管轄が認められている場合は、その定めによります。
3. 本条は、購入者の居住国の法令で認められる消費者としての権利を制限しません。
4. 本規約のいずれかの規定が、違法または執行不能とされた場合でも、その他の規定は有効に存続します。
5. 本規約は、当方、その関連会社、およびライセンス提供者の利益のためのものであり、それぞれが本規約を行使できます。

Please read these Terms carefully before using this website or purchasing any product. By accessing haruscuisine.com or any related site or store operated by HARU's Cuisine (the "Site"), or by completing a purchase, you agree to these Terms. If you do not agree, please do not use the Site or make a purchase.
1. SCOPE
These Terms apply to the Site and to all recipes, courses, videos, PDFs, training materials, coaching or consultation services, and other products or services offered by HARU's Cuisine ("Company", "we", "us") (together, the "Content").
2. LICENSE AND PERSONAL USE
- Upon purchase, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Content for your own personal, non-commercial, home use only.
- You may view, download, and print the Content for your own personal use.
- You do not acquire ownership of the Content.
3. INTELLECTUAL PROPERTY
- All recipes, text, photos, videos, audio, artwork, designs, trade names, logos, and other materials on the Site and in the Content are owned by the Company or its licensors and are protected by copyright and other laws.
- You may not copy, reproduce, republish, upload, post, transmit, or distribute the Content, including through screenshots or screen recordings, without our prior written permission.
- You may share photos of dishes you have cooked on your personal social media. Please credit @[account name]. Do not post the recipe text, ingredient quantities, or steps.
4. PROHIBITED USES
Without our prior written permission, you may not:
- Sell, resell, lend, sublicense, or share the Content or your access or login with others.
- Upload or redistribute the Content to social media, blogs, groups, communities, or cloud-sharing services.
- Use the Content or recipes commercially, including in a restaurant, café, catering service, pop-up, product line, or paid class.
- Present the Content, in whole or modified, as your own recipe, course, book, or teaching material.
- Use the Content to train AI systems, or scrape or compile it into a database.
- Violate any law or the rights of others.
5. COMMERCIAL LICENSING
If you wish to use any recipe or material for business purposes, please contact us first at harus.cuisine@gmail.com. We will arrange a separate consultation and license agreement.
6. ACTION FOR VIOLATIONS
If you breach Section 3 or 4, we may, at our discretion and as permitted by law:
- Ask you to stop and remove the material.
- Suspend or terminate your access without refund.
- Submit takedown notices to platforms and service providers.
- Seek damages, including reasonable legal costs, and other legal remedies.
We may also remove content or accounts that we reasonably consider unlawful, offensive, defamatory, or infringing on anyone's rights or these Terms.
If you believe your own rights are being infringed by material on the Site, please email us at harus.cuisine@gmail.com with your name and contact information, a description of your work, the location (URL) of the alleged infringement, and any relevant registration information.
7. PAYMENT, DIGITAL PRODUCTS, AND REFUNDS
- You agree to pay for all products you purchase and to provide a valid payment method.
- Prices may change at any time. We do not offer price protection or refunds for later price reductions or promotions.
- Because the Content is digital and can be copied immediately, ALL SALES ARE FINAL AND NON-REFUNDABLE, including if you do not use the Content or are not satisfied with it.
- Exceptions: we will refund or replace your purchase if (a) you were charged more than once for the same item, (b) the files are corrupted or inaccessible and we cannot fix this, or (c) the product is unavailable after purchase, or delivery is unreasonably delayed by a technical problem. Please contact us within [7] days of purchase.
- This Section does not limit any rights you have under mandatory consumer protection laws of your country or region.
8. CONSULTATION BOOKINGS
- This Section applies to anyone who books a consultation or coaching session with HARU's Cuisine (a "Consultation").
- Consultations are booked and paid for separately. They are not included with the purchase of recipes or courses.
- You are responsible for scheduling your Consultation. All bookings are non-refundable.
- To cancel or reschedule, email harus.cuisine@gmail.com with the subject "CONSULTATION CANCELLATION – [date & time]" at least 48 hours before your session.
- If you do not attend, or you cancel or reschedule less than 48 hours before your session, the session is forfeited and no refund or credit is given.
- If we need to cancel or reschedule a Consultation, we will offer you another time or a refund.
- Consultations offer general guidance and ideas. We do not guarantee any particular result, including business income or sales.
- The recipes, materials, and advice shared in a Consultation are for your own use. They may not be recorded, redistributed, or resold without our written permission.
9. KITCHEN SAFETY AND ALLERGIES
- Cooking involves inherent risks, including burns, cuts, slips, falls, and allergic reactions.
- You are responsible for following basic kitchen safety and food hygiene practices, using equipment properly, and checking all ingredients for allergens. Plant-based ingredients may still contain allergens.
- For fermented, preserved, or heat-processed recipes, you are responsible for proper hygiene and storage.
- Children and inexperienced cooks must be supervised at all times. If a minor (under 18) uses the Content, a parent or guardian must supervise their cooking and accept responsibility for their safety and actions.
10. NO GUARANTEE OF RESULTS
- Results vary depending on your skill, ingredients, equipment, and environment. We do not guarantee any particular result, including taste, texture, shelf life, or business income.
- We make reasonable efforts to keep the Content accurate and up to date, but we do not warrant that it is error-free or uninterrupted.
- You accept full responsibility for how you apply the information.
11. DISCLAIMER AND LIMITATION OF LIABILITY
- To the maximum extent permitted by law, the Site and Content are provided "as is" without warranties of any kind, express or implied.
- To the maximum extent permitted by law, the Company is not liable for any special, incidental, indirect, punitive, or consequential damages, or for loss of profits, revenue, data, or goodwill, arising from your use of the Site or Content.
- To the extent permitted by law, our total liability to you for any claim is limited to the amount you paid for the relevant product.
- Nothing in these Terms excludes liability that cannot be excluded by law, including liability for our fraud, gross negligence, or willful misconduct, or any rights you have under mandatory consumer protection laws. Some jurisdictions do not allow certain exclusions, so some of the above may not apply to you.
- We are not responsible for problems caused by third-party websites or services (for example, Stan, Stripe, your internet provider, or your devices and software). Any such problem is governed by your agreement with that provider.
- We use commercially reasonable efforts to protect our data and files, but no system is completely secure.
12. INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold the Company harmless from claims, damages, and expenses (including reasonable legal fees) arising from your breach of these Terms, your violation of law or third-party rights, or content you post or share in connection with the Site.
13. CONTENT UPDATES AND CHANGES
- We may update, modify, or remove Content or the Site at any time without prior notice.
- You are licensed to use the version of the Content available at the time of your purchase, unless we state otherwise.
- We may revise these Terms by posting an updated version. Changes apply from the date of posting and do not affect purchases already made.
14. PRIVACY AND COMMUNICATIONS
- We use your personal information only to deliver products, communicate with you, and provide support. We do not disclose it to third parties, except where we believe in good faith that disclosure is required by law or necessary to enforce these Terms. Payment information is handled by our payment providers (such as Stan and Stripe). Please see our Privacy Policy.
- By registering or purchasing, you agree to receive notices about your purchase by email. You can opt out of marketing emails at any time.
15. FEEDBACK
If you send us comments or suggestions about the Site or Content, we may use them freely, without obligation or compensation to you.
16. GOVERNING LAW AND DISPUTES
- These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules.
- To the extent permitted by law, disputes will be resolved in the courts of Ontario, Canada.
- If you are a consumer, this does not remove any mandatory rights or protections you have in your country of residence.
- If any provision is found unlawful or unenforceable, the remaining provisions stay in effect.
- These Terms benefit the Company and its affiliates and licensors, each of whom may enforce them.
