By using this website or Stan Store, or by purchasing any products, you agree to be bound by these Terms and Conditions. If you do not agree, do not use the site or purchase from it.
Your access to and use of this website, Stan Store, and all related websites operated by S&W Marketing LLC, doing business as Wendy Robinson and The Modern Nomad Family, 101 Rainbow Drive, #8591, Livingston, TX 77399 (collectively the "Site"), is subject to the following terms and conditions ("Terms of Use") and all applicable laws. By accessing and browsing the Site, you accept, without limitation or qualification, these Terms of Use and acknowledge that any other agreements between you and the Site are superseded and have no force or effect.
OWNERSHIP OF SITE AND CONTENT
You agree that the Site, as well as all content, videos, training materials, prompts, products, services, digital downloads, and other materials made available on or through the Site by S&W Marketing LLC or third parties, including the look and feel of all of the foregoing (collectively, the "Content"), are maintained for your personal use and information and are the property of S&W Marketing LLC and/or its third party providers.
Content includes, without limitation, proprietary videos, audio, templates, PDF documents, HTML, CSS, Javascript, graphics, voice and sound recordings, artwork, photos, documents, text, and all other materials included in or delivered through the Site, excluding only materials you provide.
Subject to your compliance with these Terms of Use, S&W Marketing LLC grants you a limited license, which is non-exclusive, non-transferable, and non-sublicensable, to access, view, and use the Site and Content solely for your personal, non-commercial purposes, or as expressly allowed in the specific product license you purchase. No Content may be copied, reproduced, republished, uploaded, posted, transmitted, distributed, used for public or commercial purposes, or downloaded in any way unless written permission is expressly granted by S&W Marketing LLC.
INTELLECTUAL PROPERTY
All Content contained in or delivered through the Site is copyrighted unless otherwise noted and is the property of S&W Marketing LLC. Use of Content by you is strictly prohibited unless specifically permitted by these Terms of Use. Unauthorized use of Content may violate copyright, trademark, and other proprietary rights, as well as privacy and publicity laws.
DATA PROCESSING AND PRIVACY
Customer information, including names, email addresses, payment information, and purchase history, is collected, processed, and stored by Stan Store in accordance with Stan Store's Privacy Policy and Terms of Service. By making a purchase through this Site or Stan Store, you acknowledge and agree to Stan Store's data handling practices and terms.
S&W Marketing LLC does not directly store payment card information or sensitive personal data. For questions about how your information is handled, please refer to Stan Store's Privacy Policy.
ACCURACY OF INFORMATION
While S&W Marketing LLC uses reasonable efforts to include accurate and up-to-date information on the Site, S&W Marketing LLC makes no warranties or representations as to the accuracy, completeness, or reliability of the information. S&W Marketing LLC assumes no liability or responsibility for any errors or omissions in the content of the Site or in any products, modules, or materials.
EARNINGS DISCLAIMER
S&W Marketing LLC does not warrant or make any representations or guarantees that you will earn any money using the Site, Content, the Boss Suite, or any of the 20 digital income streams taught. You accept full responsibility for evaluating your own earning potential, business, and results. Your earning potential depends on your own products, skills, ideas, techniques, execution, time, consistency, finances, knowledge, and experience. Results vary widely from person to person. S&W Marketing LLC cannot and does not guarantee your success, income level, or any specific results.
WARRANTIES AND LIMITATION OF LIABILITY
All Content, products, and services on the Site are provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. To the fullest extent permitted by law, S&W Marketing LLC shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising out of your access to or use of the Site, products, or Content.
DIGITAL PRODUCTS, SERVICES, AND REFUNDS
All Sales Are Final: You agree to pay for all products and services purchased through the Site or Stan Store. Due to the nature of digital content and immediate access to proprietary training materials, S&W Marketing LLC maintains a strict No-Refund Policy for all digital products, prompts, programs, memberships, and services. This policy applies regardless of whether a coaching session has been attended or forfeited due to a No-Show. This no-refund policy applies to the maximum extent permitted by applicable law. Nothing in these terms affects your statutory rights where prohibited by law.
Technical Issues & Delivery: If a technical problem on our end prevents or delays delivery of your product, your sole remedy is a replacement of the digital file or a restoration of access to the product. Technical delivery issues must be reported within 48 hours of purchase to iamwendyrobinson@gmail.com. We will investigate and provide file replacement or access restoration only if the failure originated from our systems or Stan Store's delivery infrastructure. S&W Marketing LLC does not provide refunds for technical issues occurring on the user's end (e.g., poor internet connection, device incompatibility, or lost login credentials).
Payment Responsibility: You are responsible for the timely payment of all fees and for providing S&W Marketing LLC with a valid payment method.
Price Protection: Prices for products and services may change at any time. S&W Marketing LLC does not provide price protection or partial refunds in the event of a subsequent price change, sale, or promotional offer.
VIDEO & PHONE CALLS, CONSULTS, AND SCHEDULING
Scheduling: If a product includes live calls or consultations, you are responsible for scheduling them via the provided Tidycal booking link.
Strict No-Refund Policy: All coaching and consultation bookings are non-refundable. By purchasing a session, you are booking a dedicated block of Wendy's time that cannot be resold once reserved.
Rescheduling Policy: You are permitted one (1) reschedule per purchase. You MUST cancel or reschedule using the Tidycal booking link provided in your confirmation email at least one (1) hour before your scheduled start time.
Communications: Reschedule requests made via social media DM, text, or any method other than the Tidycal link or a direct reply to iamwendyrobinson@gmail.com or wendy@iamwendyrobinson.com will not be honored.
The 10-Minute Rule: Wendy will wait a maximum of ten (10) minutes for you to join the Google Meet room or answer the phone call. Any time missed due to your late arrival is deducted from your total session time. If you have not arrived/answered within 10 minutes, the call is considered a "No-Show."
No-Shows: Being "stood up" is not a reschedule. If you are a No-Show, your session and fee are forfeited. No exceptions
Phone Call Protocol: If you choose a phone consultation, Wendy will call from (425) 405-5454. You are responsible for ensuring this number is not blocked or silenced by your device settings. If Wendy calls and it goes to voicemail, this counts as an attempted contact within the 10-minute rule.
Wendy's Commitment: If Wendy is more than 5 minutes late or needs to reschedule, this will not count against your one allowed reschedule, and the full time will be honored at a later date.
Call or Video Recording: Video calls are recorded, and you will receive a downloadable copy. By booking a video call, you consent to recording. Phone calls are not recorded.
Emergency Rebooking: In extraordinary circumstances such as natural disasters, serious medical emergencies, or accidents that prevent you from attending your scheduled call, Wendy may, at her sole discretion, allow an additional rebooking beyond the standard one-time reschedule. This is a courtesy, not an entitlement, and is evaluated on a case-by-case basis. Emergency rebooking is solely at Wendy's discretion and is not guaranteed. Wendy is not liable for inability to conduct calls due to circumstances beyond reasonable control, including but not limited to illness, natural disasters, internet outages, or other emergencies
30-Day Mastery Retainer
All time is tracked and counted against your five-hour balance. This includes scheduled calls, phone calls, text exchanges, and any work completed on your behalf between sessions, including but not limited to copy review, prompt building, tech setup, content editing and anything else we agree on in writing.
Your 30-day window begins on your date of purchase. Unused time does not roll over under any circumstances.
No-shows on planned calls count against your time balance.
No refunds are issued unless you email me at iamwendyrobinson@gmail.com within 24 hours of purchase, at the sole discretion of Wendy Robinson and are not guaranteed.
This offer is available only to existing clients. Work is limited to the building, launching, and marketing of your digital product or course. Work outside of this scope is not included.
If you wish to continue after your 30 days, you may repurchase at the current rate listed.
AFFILIATE DISCLOSURE
Some links, product recommendations, and partnerships promoted by S&W Marketing LLC may include affiliate relationships where S&W Marketing LLC earns a commission at no additional cost to you. All affiliate relationships are disclosed in accordance with FTC guidelines. Recommendations are based on genuine use and belief in the product or service's value.
INDEMNIFICATION
You agree to indemnify and hold harmless S&W Marketing LLC, Wendy Robinson, and each of their members and agents from any and all liabilities, claims, damages, and expenses, including reasonable attorney fees, arising out of your breach of these Terms of Use or your use of the Site, products, or services.
DISPUTE RESOLUTION AND ARBITRATION
Mandatory Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms of Use, your purchase, or use of products or services shall be resolved through binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. Arbitration shall take place in the State of Texas.
Class Action Waiver: You agree to resolve disputes on an individual basis only. You waive any right to participate in a class action lawsuit or class-wide arbitration.
Small Claims Exception: Either party may bring an individual action in small claims court as an alternative to arbitration.
GOVERNING LAW AND JURISDICTION
These Terms of Use shall be governed by and construed in accordance with the laws of the State of Texas, United States. You agree to submit to the exclusive jurisdiction of the state and federal courts located in the State of Texas for any dispute arising out of or relating to these Terms of Use, except as provided in the Dispute Resolution section above.
AGE REQUIREMENT
You must be at least 18 years old to purchase products or services from S&W Marketing LLC. By making a purchase, you represent and warrant that you are of legal age in your jurisdiction.
ACCOUNT TERMINATION AND RIGHT TO REFUSE SERVICE
S&W Marketing LLC reserves the right to refuse service, cancel accounts, revoke product access, or remove access to content at its sole discretion, including but not limited to violations of these Terms, disruptive behavior, or fraudulent activity.
MODIFICATION OF TERMS
S&W Marketing LLC reserves the right to modify these Terms and Conditions at any time. Updated Terms will be posted on the Site and Stan Store. Continued use of the Site, Stan Store, or services after changes are posted constitutes your acceptance of the modified Terms.
SEVERABILITY
If any provision of these Terms of Use is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
ENTIRE AGREEMENT
These Terms of Use constitute the entire agreement between you and S&W Marketing LLC regarding the Site and Content. S&W Marketing LLC may revise these Terms of Use at any time by updating this page. By continuing to use the Site after changes are posted, you agree to be bound by the updated Terms of Use.
