Terms of Use
Please read these Terms of Use carefully before using this website or purchasing.
By using this website, you signify your consent to these Terms of Use. If you do not agree, please do not use the website.
Your access to and use of this website (the "Site") is operated by Justyna Zoledziejewska (the "Company"), and is subject to the following terms and conditions and all applicable laws. By accessing and browsing the Site, you accept these Terms of Use without limitation or qualification, and acknowledge that any other agreements between you and the Site are superseded and of no force or effect.
1. Content and licence
You agree that the Site itself, as well as all content, videos, training materials, products, services and other materials made available on the Site by us or other third parties (collectively, the "Content"), are maintained for your personal use and information by Justyna Zoledziejewska and are the property of the Company and/or its third-party providers. Subject to your compliance with these Terms of Use, the Company grants you a limited, non-exclusive, non-transferable and non-sublicensable licence to access, view and use the Site solely for your personal purposes.
No Content may be copied, reproduced, republished, uploaded, posted, transmitted, distributed, used for public or commercial purposes, or downloaded in any way unless written permission is expressly granted by the Company. Modification of the Content, or its use for any other purpose, is a violation of the copyright and other proprietary rights of the Company and may be subject to monetary damages and penalties.
All Content, including text, data, graphics, videos, sound files and other materials contained in the Site, is copyrighted unless otherwise noted and is the property of Justyna Zoledziejewska. No such materials may be used except as provided in these Terms of Use.
2. Purchases, pricing and access
Upon purchase you will receive access to course materials via email within 12 hours. Access is granted for 12 months from the date of purchase and is for your personal use only. Access cannot be shared, transferred or resold. Where your purchase includes Q&A access, this is limited to 30 days from the date of purchase. The Company reserves the right to terminate your access should you violate these Terms of Use.
You are responsible for the timely payment of all fees and for providing the Company with a valid payment method. Prices may change at any time; the Company does not provide price protection or refunds in the event of a price reduction or promotional offer.
3. Right of withdrawal (customers in the European Union / EEA)
If you are a consumer based in the European Union or the European Economic Area, you have a statutory right to withdraw from your purchase within 14 days of the purchase date, without giving any reason, in accordance with Directive 2011/83/EU on consumer rights.
However, because the course materials are supplied as digital content not on a physical medium, and access is granted immediately upon purchase, this right of withdrawal ends as soon as performance has begun — provided that: (a) you gave your prior express consent to immediate access, and (b) you acknowledged that you would thereby lose your right of withdrawal. At checkout you will be asked to confirm both of these points before completing your purchase. Once you have done so and received access, you will not be entitled to a refund, except as required by applicable law (for example, where the Content is materially faulty or not as described).
If you have not yet been granted access at the time you wish to withdraw, you may do so within the 14-day period by emailing justyna@lashparadise.co.uk, and any payment already made will be refunded without undue delay.
Nothing in these Terms of Use limits any other mandatory consumer protection you are entitled to under the law of your country of residence, where that law applies to your purchase.
4. Customers outside the European Union / EEA
If you are purchasing from outside the EU/EEA, all sales are final once access to the course materials has been granted, due to the nature of digital products, except where a refund or replacement is required by the mandatory consumer protection law of your country of residence. If technical problems prevent or unreasonably delay delivery of your product, your sole remedy is either replacement or a refund of the price paid, as determined by the Company.
5. No guarantee of results
The Company makes no warranties or representations as to the accuracy of the Site content. Results may vary and success depends on individual effort, practice and application of the course content. The Company does not guarantee that you will earn any specific income as a result of purchasing this course.
6. Data protection
Justyna Zoledziejewska processes your personal data in accordance with the UK GDPR and, where applicable, the EU General Data Protection Regulation (GDPR). Details of what data is collected, why, and how long it is kept, are set out in the Company's Privacy Policy. If you are located in the EU/EEA, you have the right to access, correct, or delete your data, to restrict or object to its processing, to data portability, and to lodge a complaint with your local data protection authority. By using the Site, you signify your acceptance of the Company's Privacy Policy. The Company will not intentionally disclose any personally identifying information about you to third parties, except where required by law.
7. Governing law and disputes
These Terms of Use are governed by and construed in accordance with the laws of England and Wales, and, subject to the paragraph below, you submit to the exclusive jurisdiction of the courts of England and Wales sitting in Leicester, England.
If you are a consumer resident in the European Union or the European Economic Area, this choice of law does not deprive you of the protection afforded by any mandatory provisions of the law of your country of residence, and you may also be entitled to bring proceedings before the courts of your own country in accordance with applicable EU rules on jurisdiction.
If any provision of this agreement is found to be unlawful or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions. These Terms of Use may be revised from time to time and you are bound by any such revisions.
