NANCY AKPAKWU – TERMS & CONDITIONS
PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE MAKING A PURCHASE.
By purchasing a product or service from Nancy Akpakwu ("the Company", "we", "us" or "our"), you confirm that you have read, understood and agreed to these Terms and Conditions.
These Terms apply to our live masterclasses, recorded classes, coaching programmes, consultations, digital products, educational resources, communities and other products or services.
Nothing in these Terms affects any statutory rights that you are legally entitled to as a consumer.
1. EDUCATIONAL PURPOSES ONLY
All information provided through our masterclasses, coaching, consultations, videos, communities, emails, digital products, live events, recorded classes and educational materials is provided for educational and informational purposes only.
Nothing provided by Nancy Akpakwu constitutes personalised financial advice, investment advice, tax advice, legal advice or a personal recommendation to buy, sell or hold any particular investment, security, cryptocurrency, ETF, REIT, stock or other financial product.
Any examples of investments, portfolios, allocations, platforms or strategies are provided for educational purposes.
You are responsible for conducting your own research and making your own financial and investment decisions. Where appropriate, you should seek advice from a suitably qualified and authorised professional.
2. INVESTMENT RISK AND NO GUARANTEE OF RESULTS
Investing involves risk. The value of investments can rise as well as fall, and you may receive back less than you invest.
The Company does not guarantee any investment return, financial outcome, income level, profit, portfolio performance or other specific result.
Any past performance, investment results, testimonials, case studies or personal results shared by Nancy Akpakwu or members of our communities are provided for illustrative and educational purposes only and are not guarantees of future performance.
Your results will depend on factors including your personal circumstances, decisions, investment choices, market conditions, risk tolerance, consistency and implementation.
3. DIGITAL PRODUCTS
Digital products may include, but are not limited to:
• Recorded masterclasses
• Video training
• PDFs and guides
• Templates
• Educational resources
• Digital downloads
• Online course materials
• Recordings
• Community access products
Where digital content is supplied immediately following purchase, you are requesting that supply of the digital content begins immediately.
Where required by applicable law, you will be asked to expressly consent to immediate supply and acknowledge that beginning the supply of digital content may result in the loss of your statutory right to cancel.
Once digital content has been supplied or access has begun, refunds will not normally be provided simply because you change your mind, subject always to your statutory consumer rights.
You remain entitled to any remedies that cannot lawfully be excluded under applicable consumer law.
4. DELIVERY AND PROOF OF ACCESS
A product or service will be treated as delivered when the Company has supplied or made the purchased product, service or access information available using the email address, account or other contact information provided by the customer at checkout.
For LIVE ONLINE CLASSES, MASTERCLASSES AND EVENTS, delivery may include sending or making available:
• A purchase confirmation
• Zoom or other meeting link
• Joining instructions
• Event details
• Class materials
• Relevant access information
For RECORDED CLASSES AND DIGITAL PRODUCTS, delivery may include:
• Providing an access link
• Providing access to a recording
• Providing a download
• Providing a PDF
• Providing access to an online portal
• Providing other digital materials purchased by the customer
For COACHING AND CONSULTATIONS, delivery occurs when the agreed session is provided or made available at the agreed date and time.
Customers are responsible for providing an accurate email address and contact information at checkout.
Customers are also responsible for checking their inbox, spam/junk folders and any other communication channel through which their purchase may reasonably be delivered.
If access details have not been received, customers should contact the Company promptly so that the information can be resent or access restored.
A customer's failure to:
• Open an email
• Click an access link
• Download supplied materials
• Join a community
• Watch a recording
• Attend a scheduled class
• Attend a booked consultation or coaching session
does not, by itself, mean that the purchased product or service was not supplied where the Company has made the relevant product, service or access available as agreed.
5. LIVE MASTERCLASSES, WORKSHOPS AND EVENTS
When purchasing a place at a live masterclass, workshop, webinar or training event, you are purchasing access to an event scheduled for a particular date and/or time.
You are responsible for attending the event at the advertised time and ensuring that you have suitable internet access, equipment and software to participate.
Failure to attend a scheduled live event does not, by itself, mean that the service was not provided.
Where the Company has provided the relevant joining information and made the event available as advertised, refunds will not normally be provided because a customer:
• Forgot to attend
• Was unavailable
• Joined late
• Experienced personal scheduling conflicts
• Chose not to attend
• Failed to check their email or joining instructions
This is subject to any statutory rights that apply.
Where available, the Company may choose to provide a recording, transfer, alternative date or other accommodation. Unless expressly included in the product description, this is not guaranteed.
The Company reserves the right to reasonably reschedule or postpone an event where necessary. Customers will be informed of any material changes.
6. COACHING, CONSULTATIONS AND ONE-TO-ONE SERVICES
Coaching sessions, consultations, strategy sessions and one-to-one appointments are reserved specifically for the purchasing customer.
If you need to reschedule an appointment, you should provide at least 48 hours' notice.
Where less than 48 hours' notice is provided, or where a customer fails to attend an agreed appointment, the session may be treated as used and may not be rescheduled or refunded, subject to applicable consumer law and the circumstances of the cancellation.
Purchasing coaching does not guarantee any particular financial, investment, business or personal outcome.
The Company's obligation is to provide the agreed educational or coaching service with reasonable care and skill.
7. COMMUNITY ACCESS
Some purchases may include access to a WhatsApp group, membership community, private group or other community.
Where community access is described as a bonus accompanying another purchased service, that bonus does not alter the nature of the main product purchased.
Members are expected to behave respectfully and professionally.
The Company reserves the right to suspend or remove members who:
• Harass or abuse other members
• Solicit members without permission
• Share inappropriate or unlawful content
• Disrupt the community
• Share paid materials with non-paying individuals
• Reproduce or distribute Company content
• Engage in fraudulent activity
• Seriously or repeatedly violate community rules
Removal for a serious or repeated breach of these rules does not automatically entitle a member to a refund for products or services that have already been supplied, subject to applicable consumer law.
8. INTELLECTUAL PROPERTY
Unless otherwise stated, all course materials, masterclasses, recordings, presentations, PDFs, worksheets, videos, documents, training materials, community content, strategies and educational resources supplied by the Company remain the intellectual property of Nancy Akpakwu or the relevant rights holder.
Your purchase provides you with a personal, non-transferable right to use the materials for your own learning.
Unless you have received prior written permission, you must not:
• Copy
• Reproduce
• Screen-record
• Record
• Share
• Upload
• Distribute
• Resell
• Transfer
• Republish
• Publicly display
any paid Company content.
You must not share your access links, recordings, course materials or paid resources with individuals who have not purchased the relevant product.
Unauthorised distribution may result in suspension or termination of access and, where appropriate, further action to protect the Company's intellectual property rights.
9. REFUNDS AND CANCELLATIONS
Except where otherwise stated for a particular product or service, refunds are not normally provided after the relevant digital product has been supplied, a live service has been performed, or a customer has received or used the purchased service.
A refund will not normally be provided solely because a customer:
• Changes their mind after accessing digital content
• Does not use materials that have been supplied
• Fails to attend a scheduled live class
• Fails to attend a booked appointment
• Does not implement the education provided
• Does not achieve their desired investment or financial result
However, nothing in these Terms excludes, restricts or replaces any statutory right, cancellation right or remedy that the customer is legally entitled to under applicable consumer law.
Where the law gives a customer a right to a refund, cancellation, repeat performance, price reduction or other remedy, these Terms do not remove that right.
10. PAYMENT DISPUTES AND CHARGEBACKS
If you believe that a product or service has not been supplied as described, please contact the Company first so that we have an opportunity to investigate and resolve the matter.
If a payment dispute or chargeback is initiated, the Company reserves the right to contest the dispute and provide relevant evidence to the payment processor, card issuer, bank or other financial institution.
Evidence may include, where applicable:
• Order and purchase records
• Confirmation of acceptance of these Terms
• Payment records
• Confirmation emails
• Email delivery records
• Digital access records
• Download records
• Login or activity records
• Zoom attendance records
• Coaching or consultation attendance records
• Messages and correspondence
• Community participation records
• Records showing that links, materials or services were supplied
Where the evidence demonstrates that the purchased product or service was supplied or made available as agreed, the Company may rely upon that evidence when responding to a claim that a product or service was not received.
Initiating a payment dispute does not automatically cancel these Terms or establish that a product or service was not supplied.
Nothing in this section prevents a customer from exercising any legal right to dispute a transaction or pursue a remedy available under applicable law.
11. CUSTOMER RESPONSIBILITY
You are responsible for ensuring that the information supplied when making a purchase is accurate.
This includes your:
• Name
• Email address
• Contact information
• Booking information
If you enter an incorrect email address or other contact information and therefore do not initially receive your access information, please contact the Company so that reasonable steps can be taken to verify your purchase and restore or resend access.
You are responsible for maintaining access to the email account used when purchasing and for checking communications relating to your purchase.
12. THIRD-PARTY PLATFORMS
Our education may refer to or use third-party services or platforms, including brokerage platforms, investment platforms, payment providers, Zoom, WhatsApp and other technology providers.
The Company does not control these third-party businesses and is not responsible for their independent decisions, availability, fees, technical issues, account restrictions, investment offerings or terms and conditions.
References to a particular platform for educational purposes should not be interpreted as a guarantee or endorsement that the platform will be suitable for every customer.
You are responsible for reviewing the terms and suitability of any third-party service you choose to use.
13. LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
Subject to applicable law, the Company is not responsible for investment losses, market movements or financial outcomes resulting from investment decisions made independently by customers after receiving educational information.
Customers remain responsible for their own investment decisions.
Nothing in these Terms excludes the Company's obligation to provide services with the standard of care required by applicable law or excludes any other liability or consumer remedy that cannot legally be excluded.
14. CHANGES TO PRODUCTS, SERVICES AND THESE TERMS
The Company may update these Terms from time to time to reflect changes to our products, services, business practices or applicable requirements.
The Terms applicable to a purchase will generally be those presented to the customer at the time the relevant purchase is made.
Any material change to a purchased service will be handled reasonably and in accordance with applicable consumer rights.
15. ACCEPTANCE OF TERMS
By completing your purchase and accepting these Terms and Conditions at checkout, you confirm that:
• You have had the opportunity to read these Terms before purchasing.
• You understand the nature of the product or service you are purchasing.
• You understand that investing involves risk and that no investment returns or financial results are guaranteed.
• You understand the delivery and access provisions described above.
• You agree to comply with the intellectual property and community provisions where applicable.
• You understand that your statutory consumer rights are not excluded by these Terms.
Where you specifically request immediate access to digital content, any additional consent and acknowledgement required by applicable consumer law will also apply.
16. CONTACT AND COMPLAINTS
If you experience an issue accessing a product or believe that a product or service has not been supplied as described, please contact us promptly so that we can investigate and attempt to resolve the matter.
