Lovely Little Melodies LLC Terms & Conditions of Use

These Terms and Conditions ("Terms") govern your access to and use of all digital materials, curriculum products, songbooks, and courses ("Materials") provided by Lovely Little Melodies LLC. ("LLM," "we," "our," or "us"). By purchasing, accessing, or using any LLM materials, you agree to the following terms.
1. License Grant
Upon purchase, you are granted ONE non-exclusive, non-transferable, limited license to use the materials within your own classroom or educational program.
Definitions:
Non-exclusive: We can license the same materials to others (you're not the only one with access).
Non-transferable: You may not transfer, share, or sell the license to anyone else.
Limited license: Your rights are limited to using the materials as described here (not owning the copyright or IP).
2. Permitted Use
Depending on the license purchased:
Individual License: You may use the materials for personal classroom use only.
School License: You may share the materials internally with up to 15 staff members within a single
school, center, or educational program.
All users must be part of the same organization/site.
Multi-Site License: A separate license must be purchased for each school, campus, or program location.
Sharing materials across multiple sites without appropriate licensing is not permitted.
Printed and digital use is permitted only for your internal program needs.
You may not share, distribute, upload, or republish these materials beyond the terms of your license.
This includes:
Sharing login or download access with others
Uploading materials to public/shared drives or social media
Using materials at additional sites or schools not covered by your license
Republishing or adapting content without written permission
We put so much love, care, and time into creating these materials, and we trust our customers to honor that. If a serious violation of these terms occurs, a standard liquidated damages fee of $5,000 USD (United States Dollar) per violation may be applied to cover the estimated loss and legal costs associated with the breach.
This amount is not intended as a penalty, but as a fair and reasonable estimate of the damage caused by unauthorized use.

3. Prohibited Use
You may not:
Resell, sublicense, or redistribute any portion of the materials
Share the materials externally or upload to public/shared drives (Google Drive, Dropbox, etc.)
Modify or remove LLM branding, copyright information, or logos
Claim authorship or create derivative works for resale
Transfer access to individuals outside your licensed group (e.g., other centers, school districts, or programs)
4. Intellectual Property Rights
All materials are copyrighted and owned solely by Lovely Little Melodies LLC.
This includes:
All original songs, lyrics, arrangements
Curriculum guides and activities
Video and audio content
Digital and printable documents
Your purchase provides a license to use, not ownership of, any intellectual property.
5. Refunds and Access
Due to the digital nature of our products, all sales are final and non-refundable once accessed or downloaded.
If materials are accidentally purchased more than once, please contact us. We will review the issue and respond within 1–3 business days to determine appropriate next steps.
We are not responsible for technical issues arising from user error or platform limitations, but will do our best to assist with access issues.
6. Updates and Revisions
We reserve the right to update or revise these Terms at any time. Continued use of the materials after any changes constitutes acceptance of those changes.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Massachusetts, United States, without regard to conflict of law principles.
8. Privacy Policy
Lovely Little Melodies LLC respects your privacy and complies with applicable international and United States privacy laws, including the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA).
By using our site or purchasing our products, you agree to the collection and use of personal information for the purpose of order processing, customer support, and communication.
We do not sell or share your personal data with third parties, except as required to provide services (e.g., payment processors, email platforms, or user account systems such as those hosted on Stan Store). You have the right to request access, correction, or deletion of your data by contacting us.
Please note that Stan Store and other third-party platforms may use cookies and require the creation of user accounts or passwords for access. While we do not control these platforms directly, we are committed to ensuring your information is handled in accordance with applicable privacy laws.

9. Account Responsibility
Users are responsible for maintaining the confidentiality of their account credentials. We are not liable for any unauthorized access resulting from shared or compromised login information.
10. Payment Processing
All payments are processed securely through third-party providers. Lovely Little Melodies LLC does not store or manage your payment information directly and is not liable for payment processing errors or delays.
11. Delivery of Products
All products are digital and delivered via email, download link, or membership platform (e.g., Stan Store). No physical products are shipped unless expressly stated.
