Template B – Joint 50/50

PDF + editable DOCX · Beyond 18 Addendum included

There's a line in your draft decree that says “$0, equal time,” and you can't tell if it's correct or the thing you'll regret in eighteen months when someone runs the actual calculation.

The decree-drafting season is the part most parents underestimate. Temporary orders are loud: hearings, deadlines. The decree is quiet, drafted over email, signed at a kitchen table, and then it governs the next decade of your family's life. This template is for the parent who wants to walk in with something instead of nothing.

What “Joint 50/50” means, in plain language.

Both parents share joint legal custody, meaning both participate in major decisions about education, medical care, and welfare. Physical custody is shared close to equally.

“Close to equally” is doing real work in that sentence. Equal-time schedules vary widely, week-on/week-off, 2-2-3, 5-2-2-5, alternating blocks, and the overnight counts don't have to land on exactly half to be treated as an equal-time arrangement. What this framework addresses is the structure: two full households, symmetric authority, and a schedule both parents read the same way. The specific calendar is yours and your attorney's to set.

Which structure describes your case is a legal question, and not one I can answer. I'm not an attorney. This describes what the framework covers so you can recognize whether it's in the neighborhood, then confirm it with counsel.

Template B – Joint 50/50 is an educational drafting template. It is a starting point to bring to a licensed attorney, not legal advice, not a finished court document, and not a substitute for an attorney. Created by a parent who navigated the family court system, sold by ValuED Sales LLC dba May Divorce Be With You.

The $0 assumption that costs people later

“Equal time means $0 child support” is the most common assumption parents bring to 50/50, and it isn't a safe one. In a number of states, guideline formulas weigh the income difference between parents alongside the time split, which can produce a non-zero number even at exactly equal overnights. Whether your state works that way, and what it produces for your figures, is for your attorney to run. That's why the support section ships with both options drafted side by side, zero support with the worksheet and net support under your state's guidelines. Your attorney runs the math, picks the one that fits, deletes the other.

What's inside

What's inside, court-format, structured for your attorney's review:

•A sixty-day pattern-of-modification trigger, drafted so a persistent real-life schedule drift can prompt a recalculation without a separate motion. Whether that is enforceable is a question for your attorney.

•Symmetric tie-breakers, drafted for equal authority rather than residence-driven authority: major decisions route provider, then Parenting Coordinator, then Court, with no after-the-fact override.

•Plus curbside exchange protocol, complete shared-expense framework, tax allocation (Form 8332), health insurance, travel notice, driver's ed, and document production, at the same level of detail throughout.

•Automatic fee-shifting for concealed finances, as drafted, the non-disclosing party bears the cost of finding it, without a separate showing of willfulness.

•A silence-as-consent rule, no response to a properly formatted request in 48 hours is documented as a yes, so neither parent waits indefinitely.

•A tiered dispute-resolution sequence, five steps before court (notice, cure, Parenting Coordinator, mediation, court), drafted to make court the last resort.

•An expanded right-of-first-refusal provision, with a stated trigger threshold, an advance notice deadline, a response window, a default when nobody answers, and a list of what does not count, including school, regular daycare, activities, and time with relatives while the scheduled parent remains available.

•Attorney Notes, the drafting reasoning behind each provision, so you walk in saying “here's what I built and why” instead of starting from zero.

•Twenty-one hard-won lessons, drawn from observation and what other parents describe. They describe what tends to happen, not legal rules for your case.

Included free, the Beyond 18 Addendum. Most parenting plans end at the child's 18th birthday. Most disputes don't. A companion on the post-majority issues most decrees are silent on: FAFSA filing including the 2024 Simplification Act change, college and trade-school cost-sharing, ACA coverage to 26, tax dependency past 18, disabled-adult-child support with SSI and Medicaid coordination, and adult-child autonomy. Template-agnostic, works alongside any parenting plan, with attorney review.

Which one fits

•Template B, Joint 50/50: overnights within a few per year of each other.

•Template C, Sole Custody: one parent has the clear majority of overnights, with joint legal custody preserved.

•Template A, Split Custody: two or more children, with at least one living primarily with each parent.

•Not sure where you land? The Complete Bundle includes a 60-second decision tree, and your attorney can confirm which structure fits your case. Bought the wrong one? Email within 14 days and we'll exchange it at no cost.

This may fit your situation if

•You're at the decree-drafting stage and want a written framework to bring to your attorney

•You'd rather walk in knowing what you're asking for than start from a blank page

•You want the drafting reasoning, not just the language

What this is not: Legal advice. A finished or court-ready document. A child-support calculation for your case. A guarantee any provision is enforceable in your state. A substitute for an attorney licensed in your state. A guarantee of any outcome.

⚠ Read Before Purchase

This is an educational publication, not legal advice. The author is not an attorney. Purchase does not create an attorney-client relationship, and no information shared with the seller is protected by attorney-client privilege. Materials were drafted with reference to Utah law. Statutory citations and procedural references will not match other states' law without modification. An attorney licensed in your state must review and approve every provision before use, including in Utah.

Do not use this product as your starting point if any of the following applies to your case: domestic violence; active protective order; substance abuse affecting parenting; CPS or DCFS involvement; abuse allegations (substantiated or not); active mental health crisis; international parental abduction risk; significant special needs; complex finances or hidden-asset concerns; or active parental alienation. In any of those situations, go directly to a licensed family law attorney.

This may not be the right starting point right now if any of these describe you: you're afraid of what the other parent will do if they learn you're preparing; there has been physical violence or a threat of it; there have been threats to take or harm the children, or you; the other parent monitors your phone, location, accounts, or movements; there's a current or recent protective order in either direction; or there's active substance abuse, severe untreated mental illness, or suicidal ideation in the home. Some of the preparation described here can increase danger in a relationship that's already dangerous. If even one applies, work with someone trained in safety planning first. A domestic violence advocate can help sequence things for your situation. National Domestic Violence Hotline: 1-800-799-7233 (text START to 88788), 24/7, free, confidential. In immediate danger: 911, always.

Refunds. All sales are final. These are instant digital downloads, delivered immediately on purchase, so we do not offer refunds. Two exceptions: if a file fails to download or arrives corrupted, email sruff@valuedsales.com and we will re-deliver or refund. And if you bought the wrong custody structure, email within 14 days and we will exchange it at no cost.

Limitation of liability. To the maximum extent permitted by law, ValuED Sales LLC's liability for any claim arising from this product is limited to the amount you paid for it.

Privacy. Your email and payment information are processed through Stan and Stripe to deliver the file and may be used for occasional related updates. Unsubscribe anytime. See Privacy Policy.

A.T.

I purchased the 50/50 parenting plan and brought it to my lawyer. She went through it with me and we used a lot of it in our agreement. I would have been lost without it. Thank you for sharing what you learned.

Terms & Conditions

PLEASE READ THESE TERMS OF SERVICE CAREFULLY BEFORE USING THIS WEBSITE OR PURCHASING ANY PRODUCT.

These Terms of Service (“Terms”) govern your access to and use of the storefront, web pages, and digital products operated by ValuED Sales LLC, a limited liability company doing business as May Divorce Be With You (“the Company,” “we,” “us,” or “our”), including all products offered through our Stan storefront and any related pages (collectively, the “Site”).

By accessing or browsing the Site, or by purchasing, downloading, or using any product offered through the Site, you accept these Terms without limitation or qualification, and you acknowledge that any conflicting prior agreement between you and the Company is superseded. If you do not agree to these Terms, do not use the Site and do not purchase any product.

Plain-language summary (not a substitute for the full Terms): We sell educational, self-help legal-information products. They are not legal advice, we are not your lawyers, and they do not replace a licensed attorney. Please read Section 1 carefully — it is the most important part of this document.

1. Educational Purpose; Not Legal Advice

This Section is the most important part of these Terms. By purchasing or using any product offered through the Site, you acknowledge and agree to each of the following:

1.1  The products are educational information, not legal advice.

Every product sold or distributed through the Site — including templates, drafting bundles, addenda, workbooks, checklists, playbooks, courses, and accompanying materials — is general educational and informational content. No product is legal advice, and no product is a legal service. The products are intended to help you become a more informed, prepared participant in your own family law process. They are not a substitute for advice from a licensed attorney who knows the facts of your specific situation.

1.2  We are not attorneys, and no attorney-client relationship is created.

The author of the products and the Company are not attorneys and do not practice law. Purchasing a product, downloading it, reading it, using it, contacting the Company, or receiving any response from the Company does not create an attorney-client relationship between you and the Company or the author. Because no attorney-client relationship exists, no information you share with the Company is protected by attorney-client privilege or any comparable confidentiality protection.

1.3  We do not advise on, or customize products for, your specific situation.

The Company sells the same standardized products to all buyers. The Company does not customize, complete, or tailor any product for an individual buyer’s case; does not select among options, provisions, or strategies for a buyer; does not review, edit, or comment on a buyer’s draft documents, filings, or proposed agreements; and does not advise any buyer on what the buyer should do, file, sign, produce, or withhold in the buyer’s matter. Requests for any of the foregoing will be declined, and you will be directed to consult a licensed attorney. Where a product contains blank fields, bracketed placeholders, or optional language, those are for you to complete or decide — with the help of your own licensed attorney — based on your own circumstances.

1.4  Consult a licensed attorney.

Family law differs from state to state and changes over time. You should consult an attorney licensed in your state about your specific circumstances before relying on any product, before signing or filing any document, and before making any decision in your family law matter. Only a licensed attorney who knows the facts of your case can tell you what the law requires of you and what choices are appropriate for you.

1.5  Some situations require a licensed attorney now.

Some situations are not appropriate for self-help educational materials and call for professional legal representation right away. These include, without limitation: domestic violence; an active or contemplated protective order; substance abuse affecting parenting; involvement by Child Protective Services or the Division of Child and Family Services; allegations of abuse, whether substantiated or not; an active mental health crisis; risk of international child abduction; significant special-needs considerations; complex finances or concerns about hidden or dissipated assets; or active parental alienation. If any of these applies to you, your need for a licensed family law attorney is urgent. Our products may help you find and prepare to work with an attorney faster, but they are never a substitute for representation and never a reason to delay obtaining it. If you are in immediate danger, contact local emergency services or a domestic violence hotline.

1.6  Jurisdiction of the source material.

The author’s personal experience is with the Utah family court system, and some products use Utah examples. Nothing in any product should be assumed to state the law of your state. The attorney you consult — licensed in your jurisdiction — is your authority for what the law actually is.

1.7  No guarantee of outcomes.

The Company makes no representation, warranty, or guarantee regarding the outcome of any legal matter. No product can guarantee any result in any case. Outcomes in family law depend on facts, jurisdiction, the decision-maker, opposing parties, and many factors outside the Company’s knowledge or control. Any marketing statement should be read consistently with this Section: the products are educational tools, not a promise of any particular result.

2. Intellectual Property and License to Use Products

The Site and all content made available through it — including all text, questions, drafting notes, structural organization, graphics, images, documents, and other materials (collectively, the “Content”) — are the original work of the author and the property of the Company or its licensors, and are protected by United States and international copyright and other intellectual property law. The Company respects the intellectual property rights of others and asks the same in return.

Paid products. When you purchase a paid product, the Company grants you a limited, non-exclusive, non-transferable, non-sublicensable license to use that product for your own personal family law matter, including making copies for your own licensed attorney and your own court filings as needed for that matter. This license does not transfer ownership of the underlying work.

Free products. Certain products are offered at no charge as free educational guides. You may keep and print a free guide for personal use and may share the complete, unaltered file, free of charge, with others for non-commercial purposes. Sharing a free guide in full is permitted and encouraged.

Prohibited uses (all products). Regardless of whether a product was paid or free, you may not: sell a product or charge any fee for access to it (other than the Company’s own sale of a paid product); republish, excerpt, or repackage any portion of a product in another blog post, social media post, course, book, podcast, video, or other product, whether free or paid; create derivative works for resale or public distribution; present a product, in whole or in part, as your own work, or remove the author’s attribution; modify a product and redistribute the altered version; strip or alter any copyright notice, license language, or disclaimer; or use any product, in whole or in part, to train any artificial intelligence model or machine learning system.

Unauthorized reproduction or distribution of a product is a violation of copyright law and these Terms. The Company reserves the right to pursue all available legal and equitable remedies. To report a suspected infringement, or for licensing and permission inquiries, contact sruff@valuedsales.com with the relevant details.

3. Purchases, Delivery, and Refunds

Payment. Purchases are processed through our third-party payment processor (Stripe). You agree to provide a valid payment method and to pay all fees for products you purchase. Prices may change at any time. The Company does not provide price protection or retroactive adjustments for a later price reduction or promotional offer.

Delivery. Paid products are digital and are delivered electronically, typically as an immediate download upon completion of purchase. Free guides are delivered electronically. If a technical problem prevents or unreasonably delays delivery of a product you have paid for, your exclusive remedy is replacement of the file or a refund of the price paid, as the Company determines.

Refunds. Free products involve no charge, so no refund applies to them. For paid digital products, the Company offers a refund within fourteen (14) days of purchase upon request, provided the product file has not been downloaded. Because the products are instantly downloadable digital goods, once a product file has been downloaded the sale is final and no refund is available. To request a refund, contact sruff@valuedsales.com within the refund window.

Consistency note (delete before publishing): The refund terms above must match the refund language shown on each product page and in each post-purchase email. As drafted, this Section reflects a 14-day, pre-download refund window on paid products. If you decide on a different policy (for example, all sales final, or a different window), update this Section and every product description so they agree.

4. Acceptable Use and Account Conduct

You agree to use the Site and the products only for lawful, personal, non-commercial purposes consistent with these Terms. You agree not to misuse the Site, attempt to gain unauthorized access to it, interfere with its operation, or use it to infringe the rights of others. The Company may, in its sole discretion, limit or terminate access to the Site or to any product, or refuse a sale, if it determines that a user has violated these Terms.

Submissions. If you send the Company comments, suggestions, or other feedback about the Site or the products, you agree the Company may use that feedback without restriction and without obligation or compensation to you. Please do not send the Company confidential information or details of your legal matter; as stated in Section 1, no information you send is privileged or confidential.

5. Privacy and Communications

The Company collects limited personal information necessary to process orders and deliver products, such as your name and email address. The Company will not intentionally disclose personally identifying information about you to third parties except as needed to process your order through its payment and delivery providers, or where the Company in good faith believes disclosure is required to comply with the law or to enforce these Terms. Payment card details are handled by Stripe and are not collected or stored by the Company.

By registering or purchasing, you consent to receive communications from the Company relating to your order electronically, by email. Marketing emails are separate: you will only receive marketing communications consistent with applicable law and the preferences you select, and you may unsubscribe at any time. If the Company maintains a separate Privacy Policy, that policy is incorporated into these Terms by reference.

6. Third-Party Services

The Site relies on third-party services, including the Stan storefront platform and the Stripe payment processor, and may link to other third-party websites. The Company is not responsible for the performance, availability, content, or practices of any third-party service or website. Your use of a third-party service is governed solely by the agreement between you and that third party. A problem caused by a third-party service is governed by your agreement with that provider, not by these Terms.

7. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

THE COMPANY DOES NOT WARRANT THAT THE PRODUCTS OR CONTENT ARE ACCURATE, COMPLETE, CURRENT, OR SUITABLE FOR ANY PARTICULAR USER’S CIRCUMSTANCES, OR THAT THEIR USE WILL MEET ANY USER’S EXPECTATIONS OR PRODUCE ANY PARTICULAR RESULT. AS STATED IN SECTION 1, THE PRODUCTS ARE EDUCATIONAL INFORMATION, ARE NOT LEGAL ADVICE, AND ARE NOT A SUBSTITUTE FOR A LICENSED ATTORNEY. THE COMPANY DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE OR THAT FILES WILL BE FREE OF HARMFUL COMPONENTS. YOU USE THE SITE AND THE PRODUCTS AT YOUR OWN RISK.

Some jurisdictions do not allow the exclusion of certain implied warranties, so some of the above exclusions may not apply to you.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY, OR ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, RELIANCE, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SITE, THE PRODUCTS, OR THESE TERMS, WHETHER OR NOT FORESEEABLE AND REGARDLESS OF THE THEORY OF LIABILITY, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF THE COMPANY FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE, A PRODUCT, OR THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM. WHERE A CLAIM RELATES TO A FREE PRODUCT FOR WHICH YOU PAID NOTHING, THE COMPANY’S TOTAL LIABILITY SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you. Nothing in these Terms limits any liability that cannot be limited under applicable law.

9. Indemnification

You agree to indemnify and hold harmless the Company and its members, managers, officers, employees, and agents from any claims, liabilities, damages, and expenses, including reasonable attorneys’ fees, arising out of or relating to your breach of these Terms, your violation of any law or of the rights of any third party, or your use of the Site or any product. The Company may assume the exclusive defense of any matter subject to indemnification, in which case you agree to cooperate reasonably with the Company.

10. Governing Law and Venue

These Terms are governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in the State of Utah for the resolution of any dispute arising out of or relating to these Terms, the Site, or any product.

Note (delete before publishing): The source template specified Florida / Orange County, which does not match a Utah LLC. This Section has been corrected to Utah. Confirm with your attorney that Utah is the venue you want, and whether you wish to name a specific county.

11. Changes, Severability, and General Terms

The Company may revise these Terms from time to time by updating this posting, and the revised Terms apply from the date posted. Your continued use of the Site or purchase of a product after a revision constitutes acceptance of the revised Terms. If any provision of these Terms is held unlawful, void, or unenforceable, that provision is severable and does not affect the validity of the remaining provisions. The provisions of these Terms are for the benefit of the Company and its licensors, each of whom may enforce them. These Terms are the entire agreement between you and the Company regarding the Site and the products, and supersede any prior understanding on that subject.
