What This Actually Costs, The Money Side of a Family Law Case

Retainers, fee agreements, and eight ways people pay for this. 46 pages. PDF + editable DOCX

Somebody quoted you a retainer and your stomach dropped. Or nobody quoted you anything, and the silence is worse, so you've been building the number yourself out of forum posts and worst-case arithmetic at two in the morning. Either way you're stuck at the same place: you don't know what this costs, you don't know where the money would come from, and you've quietly concluded that people who get through this must have something you don't.

What actually determines the bill, in plain language.

Three things, and none of them is the number you're afraid of.

A retainer is generally a deposit, not a price. It's held in a trust account, billed against as work is done, topped up when it runs low, and the unearned portion generally comes back at the end. It tells you what a firm wants to hold before starting. It does not tell you what your case costs.

Costs attach to stages, and most cases never reach the expensive ones. Filing, service, temporary orders, discovery, settlement effort, and only rarely a trial. Published sources describe roughly 95% of contested divorces settling before trial. Trial-preparation costs are only incurred by cases that prepare for trial.

In an hourly arrangement, hours are the cost. Some of what generates hours is outside your control. A meaningful portion isn't, and that portion is where an actual strategy lives.

Which means the real questions aren't "how much is this." They're: what do I need to begin, what paths exist besides writing a five-figure check, and what am I signing when I sign a fee agreement.

This can't tell you what your case will cost or what you qualify for — courts, programs, and plan administrators decide that, applying their own rules to your facts. Every dollar figure inside is a published national range included for scale, never a quote. I'm not an attorney. This is built to get you into a consultation already knowing what to ask.

What This Actually Costs is an educational guide. It's a starting point to bring to a licensed attorney, not legal advice, not a finished court document, and not a substitute for one. Created by a parent who navigated the family court system; published by ValuED Sales LLC dba May Divorce Be With You.

What's inside

46 pages, eleven parts, delivered as a PDF and an editable Word document:

  • Part 1 — The belief that stops people. Why the imagined structure of the cost stops more people than the cost does. What a retainer actually is. Why "I have no income" is a named, anticipated category rather than a dead end.

  • Part 2 — The vocabulary. Every term you'll hear, in five reference tables. Retainer, trust account, evergreen clause, billing increment, limited scope, fee waiver, interim fees, guardian ad litem, QDRO, discovery, modest means panel, and the rest.

  • Part 3 — The full cost inventory. Every line item that can appear, from court costs to neutrals to process costs — with published national ranges — plus the eight costs nobody budgets for and no fee schedule mentions.

  • Part 4 — Eight paths people actually use. Full representation · limited scope and unbundled services · mediation · legal aid, clinics, and self-help centers · employer legal plans · fee waivers · court-addressed fees between parties · payment arrangements with a firm. Each with who it tends to fit, the honest trade-off, and the catch. Plus all eight side by side.

  • Part 5 — Reading the fee agreement before you sign it. The rate range that isn't what it looks like. Rate escalation clauses. Billing increments and how the difference compounds. What "non-refundable" should make you ask. Replenishment clauses. Scope. Withdrawal. Ends in a twelve-item checklist to take into the room.

  • Part 6 — Advocate for yourself. What to look for on every invoice. What to do when your attorney doesn't appear, the firm sends a substitute, and the issue doesn't get addressed — and the bill arrives for all of it. How to raise it in writing so it gets answered. The escalation ladder. Bar fee arbitration programs, which almost nobody knows exist. Why a fee dispute and a conduct complaint are different doors.

  • Part 7 — What actually drives the bill. What adds hours, what reduces them, and why being organized is itself a cost strategy.

  • Part 8 — The honest conversation about settling. What the published numbers show about when cases settle and what the timing costs — followed by the counterweight, which is that the cheapest agreement to reach is a vague one, and vague terms get paid for later.

  • Part 9 — The money consult. The questions in order, grouped so you get comparable answers across two or three attorneys, with a scoring sheet for comparing what you heard.

  • Part 10 — If you're worried about money access. Preparation and documentation for a financially dependent spouse, with one firm rule at the top about what not to do.

  • Part 11 — Five worksheets. Household monthly baseline · what I need to begin · resources I've checked · running cost tracker · path decision worksheet. Plus a consolidated list of questions to take to your attorney, and a note on where every number came from.

Here's what it deliberately doesn't contain: drafting language, any state's law, any statement of what you qualify for, and any prediction of what your case will cost. Those absences are explained inside, and they're why the guide stays accurate when a court changes a fee or a legislature changes a rule. What you get instead is the vocabulary, the questions, and the map.

This may fit your situation if

  • The money is the reason you haven't started

  • You've been quoted a retainer and don't know what you're actually being asked for

  • You're about to sign a fee agreement, or you signed one and never read it closely

  • Something has already gone sideways with a firm and you don't know whether you're allowed to say so

  • You want to walk into a consultation with the money questions already organized

What this is not: Legal advice. Financial advice. A quote, estimate, or prediction for your case. A statement of what you qualify for. A recommendation of any path, any attorney, or any fee arrangement. A substitute for an attorney licensed in your state.

⚠ Read Before Purchase

This is an educational publication, not legal advice. The author is not an attorney. Purchase does not create an attorney-client relationship, and no information shared with the seller is protected by attorney-client privilege. This guide contains no statutory content — it does not reproduce, summarize, cite, or characterize any state's statutes, rules, forms, or defaults, and it does not describe what any state, court, or program requires, permits, or provides. Eligibility for legal aid, fee waivers, clinic programs, employer legal plans, and court-addressed fees is determined by the organization, the plan administrator, or the court applying its own rules to your specific facts — never by a published guide. Every dollar figure inside is a published national range included for scale, never a quote. Costs vary enormously by state, county, and market, and court fees and program thresholds change. An attorney licensed in your state is the source for what applies to you.

Do not use this product as your planning framework if any of the following applies to your case: domestic violence; active protective order; substance abuse affecting parenting; CPS or DCFS involvement; abuse allegations (substantiated or not); active mental health crisis; international parental abduction risk; significant special needs; complex finances or hidden-asset concerns; or active parental alienation. In any of those situations, cost planning is not the first problem to solve — go directly to a licensed family law attorney.

This may not be the right starting point right now if any of these describe you: you're afraid of what the other parent will do if they learn you're preparing; there has been physical violence or a threat of it; there have been threats to take or harm the children, or you; the other parent monitors your phone, location, accounts, or movements; there's a current or recent protective order in either direction; or there's active substance abuse, severe untreated mental illness, or suicidal ideation in the home. If someone controls your access to money as a way of controlling you, that is a recognized pattern and it is not a budgeting problem. A domestic violence advocate can help sequence things for your situation. National Domestic Violence Hotline: 1-800-799-7233 (text START to 88788), 24/7, free, confidential. In immediate danger: 911, always.

Terms & Conditions

PLEASE READ THESE TERMS OF SERVICE CAREFULLY BEFORE USING THIS WEBSITE OR PURCHASING ANY PRODUCT.

These Terms of Service (“Terms”) govern your access to and use of the storefront, web pages, and digital products operated by ValuED Sales LLC, a limited liability company doing business as May Divorce Be With You (“the Company,” “we,” “us,” or “our”), including all products offered through our Stan storefront and any related pages (collectively, the “Site”).

By accessing or browsing the Site, or by purchasing, downloading, or using any product offered through the Site, you accept these Terms without limitation or qualification, and you acknowledge that any conflicting prior agreement between you and the Company is superseded. If you do not agree to these Terms, do not use the Site and do not purchase any product.

Plain-language summary (not a substitute for the full Terms): We sell educational, self-help legal-information products. They are not legal advice, we are not your lawyers, and they do not replace a licensed attorney. Please read Section 1 carefully — it is the most important part of this document.

1. Educational Purpose; Not Legal Advice

This Section is the most important part of these Terms. By purchasing or using any product offered through the Site, you acknowledge and agree to each of the following:

1.1  The products are educational information, not legal advice.

Every product sold or distributed through the Site — including templates, drafting bundles, addenda, workbooks, checklists, playbooks, courses, and accompanying materials — is general educational and informational content. No product is legal advice, and no product is a legal service. The products are intended to help you become a more informed, prepared participant in your own family law process. They are not a substitute for advice from a licensed attorney who knows the facts of your specific situation.

1.2  We are not attorneys, and no attorney-client relationship is created.

The author of the products and the Company are not attorneys and do not practice law. Purchasing a product, downloading it, reading it, using it, contacting the Company, or receiving any response from the Company does not create an attorney-client relationship between you and the Company or the author. Because no attorney-client relationship exists, no information you share with the Company is protected by attorney-client privilege or any comparable confidentiality protection.

1.3  We do not advise on, or customize products for, your specific situation.

The Company sells the same standardized products to all buyers. The Company does not customize, complete, or tailor any product for an individual buyer’s case; does not select among options, provisions, or strategies for a buyer; does not review, edit, or comment on a buyer’s draft documents, filings, or proposed agreements; and does not advise any buyer on what the buyer should do, file, sign, produce, or withhold in the buyer’s matter. Requests for any of the foregoing will be declined, and you will be directed to consult a licensed attorney. Where a product contains blank fields, bracketed placeholders, or optional language, those are for you to complete or decide — with the help of your own licensed attorney — based on your own circumstances.

1.4  Consult a licensed attorney.

Family law differs from state to state and changes over time. You should consult an attorney licensed in your state about your specific circumstances before relying on any product, before signing or filing any document, and before making any decision in your family law matter. Only a licensed attorney who knows the facts of your case can tell you what the law requires of you and what choices are appropriate for you.

1.5  Some situations require a licensed attorney now.

Some situations are not appropriate for self-help educational materials and call for professional legal representation right away. These include, without limitation: domestic violence; an active or contemplated protective order; substance abuse affecting parenting; involvement by Child Protective Services or the Division of Child and Family Services; allegations of abuse, whether substantiated or not; an active mental health crisis; risk of international child abduction; significant special-needs considerations; complex finances or concerns about hidden or dissipated assets; or active parental alienation. If any of these applies to you, your need for a licensed family law attorney is urgent. Our products may help you find and prepare to work with an attorney faster, but they are never a substitute for representation and never a reason to delay obtaining it. If you are in immediate danger, contact local emergency services or a domestic violence hotline.

1.6  Jurisdiction of the source material.

The author’s personal experience is with the Utah family court system, and some products use Utah examples. Nothing in any product should be assumed to state the law of your state. The attorney you consult — licensed in your jurisdiction — is your authority for what the law actually is.

1.7  No guarantee of outcomes.

The Company makes no representation, warranty, or guarantee regarding the outcome of any legal matter. No product can guarantee any result in any case. Outcomes in family law depend on facts, jurisdiction, the decision-maker, opposing parties, and many factors outside the Company’s knowledge or control. Any marketing statement should be read consistently with this Section: the products are educational tools, not a promise of any particular result.

2. Intellectual Property and License to Use Products

The Site and all content made available through it — including all text, questions, drafting notes, structural organization, graphics, images, documents, and other materials (collectively, the “Content”) — are the original work of the author and the property of the Company or its licensors, and are protected by United States and international copyright and other intellectual property law. The Company respects the intellectual property rights of others and asks the same in return.

Paid products. When you purchase a paid product, the Company grants you a limited, non-exclusive, non-transferable, non-sublicensable license to use that product for your own personal family law matter, including making copies for your own licensed attorney and your own court filings as needed for that matter. This license does not transfer ownership of the underlying work.

Free products. Certain products are offered at no charge as free educational guides. You may keep and print a free guide for personal use and may share the complete, unaltered file, free of charge, with others for non-commercial purposes. Sharing a free guide in full is permitted and encouraged.

Prohibited uses (all products). Regardless of whether a product was paid or free, you may not: sell a product or charge any fee for access to it (other than the Company’s own sale of a paid product); republish, excerpt, or repackage any portion of a product in another blog post, social media post, course, book, podcast, video, or other product, whether free or paid; create derivative works for resale or public distribution; present a product, in whole or in part, as your own work, or remove the author’s attribution; modify a product and redistribute the altered version; strip or alter any copyright notice, license language, or disclaimer; or use any product, in whole or in part, to train any artificial intelligence model or machine learning system.

Unauthorized reproduction or distribution of a product is a violation of copyright law and these Terms. The Company reserves the right to pursue all available legal and equitable remedies. To report a suspected infringement, or for licensing and permission inquiries, contact sruff@valuedsales.com with the relevant details.

3. Purchases, Delivery, and Refunds

Payment. Purchases are processed through our third-party payment processor (Stripe). You agree to provide a valid payment method and to pay all fees for products you purchase. Prices may change at any time. The Company does not provide price protection or retroactive adjustments for a later price reduction or promotional offer.

Delivery. Paid products are digital and are delivered electronically, typically as an immediate download upon completion of purchase. Free guides are delivered electronically. If a technical problem prevents or unreasonably delays delivery of a product you have paid for, your exclusive remedy is replacement of the file or a refund of the price paid, as the Company determines.

Refunds. Free products involve no charge, so no refund applies to them. For paid digital products, the Company offers a refund within fourteen (14) days of purchase upon request, provided the product file has not been downloaded. Because the products are instantly downloadable digital goods, once a product file has been downloaded the sale is final and no refund is available. To request a refund, contact sruff@valuedsales.com within the refund window.

Consistency note (delete before publishing): The refund terms above must match the refund language shown on each product page and in each post-purchase email. As drafted, this Section reflects a 14-day, pre-download refund window on paid products. If you decide on a different policy (for example, all sales final, or a different window), update this Section and every product description so they agree.

4. Acceptable Use and Account Conduct

You agree to use the Site and the products only for lawful, personal, non-commercial purposes consistent with these Terms. You agree not to misuse the Site, attempt to gain unauthorized access to it, interfere with its operation, or use it to infringe the rights of others. The Company may, in its sole discretion, limit or terminate access to the Site or to any product, or refuse a sale, if it determines that a user has violated these Terms.

Submissions. If you send the Company comments, suggestions, or other feedback about the Site or the products, you agree the Company may use that feedback without restriction and without obligation or compensation to you. Please do not send the Company confidential information or details of your legal matter; as stated in Section 1, no information you send is privileged or confidential.

5. Privacy and Communications

The Company collects limited personal information necessary to process orders and deliver products, such as your name and email address. The Company will not intentionally disclose personally identifying information about you to third parties except as needed to process your order through its payment and delivery providers, or where the Company in good faith believes disclosure is required to comply with the law or to enforce these Terms. Payment card details are handled by Stripe and are not collected or stored by the Company.

By registering or purchasing, you consent to receive communications from the Company relating to your order electronically, by email. Marketing emails are separate: you will only receive marketing communications consistent with applicable law and the preferences you select, and you may unsubscribe at any time. If the Company maintains a separate Privacy Policy, that policy is incorporated into these Terms by reference.

6. Third-Party Services

The Site relies on third-party services, including the Stan storefront platform and the Stripe payment processor, and may link to other third-party websites. The Company is not responsible for the performance, availability, content, or practices of any third-party service or website. Your use of a third-party service is governed solely by the agreement between you and that third party. A problem caused by a third-party service is governed by your agreement with that provider, not by these Terms.

7. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

THE COMPANY DOES NOT WARRANT THAT THE PRODUCTS OR CONTENT ARE ACCURATE, COMPLETE, CURRENT, OR SUITABLE FOR ANY PARTICULAR USER’S CIRCUMSTANCES, OR THAT THEIR USE WILL MEET ANY USER’S EXPECTATIONS OR PRODUCE ANY PARTICULAR RESULT. AS STATED IN SECTION 1, THE PRODUCTS ARE EDUCATIONAL INFORMATION, ARE NOT LEGAL ADVICE, AND ARE NOT A SUBSTITUTE FOR A LICENSED ATTORNEY. THE COMPANY DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE OR THAT FILES WILL BE FREE OF HARMFUL COMPONENTS. YOU USE THE SITE AND THE PRODUCTS AT YOUR OWN RISK.

Some jurisdictions do not allow the exclusion of certain implied warranties, so some of the above exclusions may not apply to you.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY, OR ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, RELIANCE, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SITE, THE PRODUCTS, OR THESE TERMS, WHETHER OR NOT FORESEEABLE AND REGARDLESS OF THE THEORY OF LIABILITY, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF THE COMPANY FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE, A PRODUCT, OR THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM. WHERE A CLAIM RELATES TO A FREE PRODUCT FOR WHICH YOU PAID NOTHING, THE COMPANY’S TOTAL LIABILITY SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you. Nothing in these Terms limits any liability that cannot be limited under applicable law.

9. Indemnification

You agree to indemnify and hold harmless the Company and its members, managers, officers, employees, and agents from any claims, liabilities, damages, and expenses, including reasonable attorneys’ fees, arising out of or relating to your breach of these Terms, your violation of any law or of the rights of any third party, or your use of the Site or any product. The Company may assume the exclusive defense of any matter subject to indemnification, in which case you agree to cooperate reasonably with the Company.

10. Governing Law and Venue

These Terms are governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in the State of Utah for the resolution of any dispute arising out of or relating to these Terms, the Site, or any product.

Note (delete before publishing): The source template specified Florida / Orange County, which does not match a Utah LLC. This Section has been corrected to Utah. Confirm with your attorney that Utah is the venue you want, and whether you wish to name a specific county.

11. Changes, Severability, and General Terms

The Company may revise these Terms from time to time by updating this posting, and the revised Terms apply from the date posted. Your continued use of the Site or purchase of a product after a revision constitutes acceptance of the revised Terms. If any provision of these Terms is held unlawful, void, or unenforceable, that provision is severable and does not affect the validity of the remaining provisions. The provisions of these Terms are for the benefit of the Company and its licensors, each of whom may enforce them. These Terms are the entire agreement between you and the Company regarding the Site and the products, and supersede any prior understanding on that subject.
