PLEASE READ THESE TERMS & CONDITIONS CAREFULLY BEFORE PURCHASING OR DOWNLOADING ANY PRODUCT FROM PINK ELEPHANT DESIGN STUDIO.
By purchasing, downloading, accessing, or using any digital product from Pink Elephant Design Studio, you agree to these Terms & Conditions. If you do not agree with these terms, please do not purchase or download our products.
1. ABOUT PINK ELEPHANT DESIGN STUDIO
Pink Elephant Design Studio ("Company," "we," "us," or "our") provides digital artwork, graphic designs, downloadable files, and other creative digital products.
Products are currently sold through our Stan Store and may include high-resolution digital designs intended for use with DTF printing, UV DTF printing, sublimation, and other compatible printing and crafting methods.
Unless specifically stated otherwise in an individual product listing, purchases are for digital files only. No physical product will be shipped.
2. DIGITAL PRODUCT DELIVERY
Digital products are delivered electronically through our sales platform or through another electronic delivery method specified at the time of purchase.
Customers are responsible for providing an accurate email address and maintaining access to the device, software, printer, or printing service necessary to use purchased files.
Pink Elephant Design Studio is not responsible for a customer's inability to use a file because of incompatible software, equipment, printing methods, or lack of technical knowledge.
If you experience a genuine problem accessing or downloading a purchased file, contact us at felice.marie@icloud.com.
3. DIGITAL SALES ARE FINAL
Due to the nature of downloadable digital products, ALL DIGITAL PRODUCT SALES ARE FINAL.
Once a digital file has been purchased or delivered, we generally do not offer returns, exchanges, cancellations, or refunds.
If you receive an incorrect file, a corrupted file, or experience a verified technical problem with the file itself, please contact us at felice.marie@icloud.com so we can attempt to correct the issue.
Nothing in this policy limits any rights or remedies that cannot legally be excluded under applicable law.
4. LICENSE TO USE OUR DESIGNS
Unless an individual product listing states otherwise, purchasing a digital design from Pink Elephant Design Studio gives the purchaser a limited, non-exclusive, non-transferable license to use the design.
The purchaser may use the design to create finished physical products for personal use or for sale, including items such as:
Purchasing a file does not transfer ownership or copyright of the original digital artwork to the purchaser.
5. WHAT YOU MAY NOT DO WITH OUR DIGITAL FILES
Unless Pink Elephant Design Studio provides express written permission, purchasers may not:
Resell the original digital file.
Redistribute or share the digital file with another person or business.
Give the digital file away for free.
Upload the digital file to Facebook groups, Google Drive folders, Dropbox folders, crafting groups, membership sites, or other file-sharing services for others to access.
Sell the digital design on Etsy, Creative Market, Design Bundles, Stan Store, Shopify, TikTok Shop, or another digital marketplace.
Include the digital file in another digital bundle or design collection.
Claim the artwork as their own original digital design.
Copy, reproduce, or redistribute the file for the purpose of competing with Pink Elephant Design Studio.
Transfer, sublicense, or assign their license to another individual or business.
The license is granted to the original purchaser only.
6. PHYSICAL PRODUCTS FOR SALE
Unless a product listing specifically states otherwise, customers may use purchased Pink Elephant Design Studio designs to create finished physical products for personal use or resale.
This means you may purchase a design and use it to create a shirt, hoodie, tumbler, mug, tote bag, journal, decal, or similar physical item that you sell to your customers.
You are selling the finished physical product, not the Pink Elephant Design Studio digital artwork itself.
7. PRINTING AND COLOR VARIATIONS
Pink Elephant Design Studio provides digital artwork intended for use with compatible printing methods.
We cannot guarantee that colors will appear exactly the same on every monitor, printer, substrate, transfer, garment, tumbler, mug, or other finished product.
Final results can vary based on your printer, ink, transfer material, color settings, heat press settings, substrate, equipment, software, and production process.
Customers are responsible for confirming that a file is suitable for their intended printing method before production.
8. INTELLECTUAL PROPERTY
All original Pink Elephant Design Studio artwork, graphics, digital files, product images, mockups, written materials, branding, and other original creative content remain the intellectual property of Pink Elephant Design Studio or the applicable rights holder.
Purchasing a product grants you permission to use that product according to the license provided. It does not transfer copyright or ownership of the underlying artwork.
Unauthorized reproduction, distribution, resale, or sharing of our digital products may result in termination of your license and may subject the responsible party to additional remedies available under applicable law.

9. PRODUCT LISTINGS AND DESCRIPTIONS
We make reasonable efforts to accurately display and describe our products.
Mockups are intended to demonstrate how a digital design may look when applied to a finished product. Unless specifically stated otherwise, mockup items shown in product photographs are not included with the purchase.
Customers should read the complete product description before purchasing.
10. PRICING
Prices are listed at the time of purchase and may be changed at any time without prior notice.
Pink Elephant Design Studio may occasionally offer sales, promotional pricing, discount codes, bundles, or special offers.
A customer who purchased a product before a sale or price reduction is generally not entitled to a refund or credit for the difference.
11. PAYMENT PROCESSING AND THIRD-PARTY SERVICES
Purchases may be processed through Stan Store and its associated third-party payment processors.
Pink Elephant Design Studio is not responsible for interruptions, outages, technical failures, payment-processing errors, or other problems caused solely by third-party platforms or service providers.
Issues involving a third-party provider may also be subject to that provider's own terms and policies.
12. CUSTOMER ACCOUNTS AND INFORMATION
Customers are responsible for providing accurate information when completing a purchase.
We use customer information as reasonably necessary to process transactions, deliver products, provide customer service, maintain business records, and comply with applicable legal requirements.
We do not intentionally disclose personally identifying customer information except as necessary to operate our business, process transactions, provide requested services, comply with law, or protect our legal rights.
13. PROHIBITED USE
You may not use Pink Elephant Design Studio products or services in a manner that violates applicable law, infringes the rights of another person or business, or violates these Terms & Conditions.
We reserve the right to refuse service, restrict access, or revoke a license where we reasonably determine that a customer has materially violated these Terms & Conditions, subject to applicable law.
14. DISCLAIMER
Digital products are provided on an "as is" and "as available" basis to the extent permitted by law.
Pink Elephant Design Studio does not guarantee that every design will work with every printer, software application, cutting machine, printing process, transfer method, substrate, or production setup.
Customers are responsible for understanding their own equipment and production process.
We recommend testing your production settings before producing large quantities of finished products.
15. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Pink Elephant Design Studio shall not be liable for indirect, incidental, special, punitive, or consequential damages resulting from the purchase, download, use, printing, modification, or inability to use a digital product.
Pink Elephant Design Studio is not responsible for damage to printers, heat presses, cutting machines, garments, tumblers, mugs, substrates, transfer materials, or other equipment or materials resulting from improper production settings or use.
Nothing in these Terms & Conditions excludes liability that cannot legally be excluded or limited.
16. INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold Pink Elephant Design Studio harmless from claims, damages, liabilities, and reasonable expenses arising from your material violation of these Terms & Conditions, unlawful use of our products, or infringement of a third party's rights resulting from your use of our products.
17. GOVERNING LAW
These Terms & Conditions shall be governed by and interpreted according to the laws of the State of New Jersey, without regard to its conflict-of-law principles.
Any dispute shall be handled in accordance with applicable New Jersey and federal law and any applicable requirements concerning jurisdiction and venue.
If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in effect to the extent permitted by law.
18. CHANGES TO THESE TERMS
Pink Elephant Design Studio reserves the right to update or modify these Terms & Conditions from time to time.
Changes will apply prospectively from the effective date of the updated terms unless applicable law requires otherwise.
Customers should review the current Terms & Conditions before making a purchase.

IMPORTANT DIGITAL PRODUCT NOTICE
All products are digital downloads unless the product listing specifically states otherwise. No physical item will be shipped.
Digital sales are final, subject to applicable law.
You may create and sell finished physical products using eligible purchased designs. You may not resell, share, distribute, give away, or upload the original digital files for others to use.
