These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“you,” “your,” or “Customer”) and Plentiful Mom (“Plentiful Mom,” “Company,” “we,” “us,” or “our”) governing your access to and use of the Plentiful Mom website, online storefront, digital products, content, materials, and services (collectively, the “Site” and “Services”).
By accessing, browsing, or using the Site, purchasing or downloading any Product, or otherwise engaging with the Services, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms. If you do not agree to these Terms, you must not access or use the Site or purchase any Product.
These Terms apply to all visitors, users, customers, and other persons who access or use the Site.
1. USE OF THE SITE
The Site is made available for lawful purposes and for your personal use and legitimate business-related activities.
By using the Site, you agree that you will not:

Plentiful Mom reserves the right to restrict, suspend, or terminate access to the Site or any Product or Service if, in our sole discretion, we determine that you have violated these Terms or engaged in conduct that may harm Plentiful Mom, the Site, or other users.
2. PRODUCTS AND SERVICES
Plentiful Mom offers digital products, educational resources, templates, guides, workbooks, frameworks, and other materials that may be made available for purchase through the Site (collectively, “Products”).
The specific description, price, format, and contents of each Product will be presented at or before the time of purchase.
Plentiful Mom reserves the right to modify, update, discontinue, replace, or otherwise change any Product or Service at any time without prior notice.
Nothing contained on the Site constitutes a guarantee that any particular Product or Service will be suitable for your individual needs or circumstances.
3. DIGITAL PRODUCT LICENSE
Unless otherwise expressly stated in writing, all Products are licensed to you and are not sold to you as a transfer of ownership of the underlying intellectual property.
Upon successful purchase, Plentiful Mom grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the purchased Product for your own personal use and/or use within your own individual business.
This license is conditioned upon your continued compliance with these Terms.
You may not transfer, assign, sublicense, sell, or otherwise convey your license or access rights to another person or entity.
4. PROHIBITED USE OF PRODUCTS
You may not, without Plentiful Mom's prior written permission:
Resell, redistribute, sublicense, rent, lease, lend, gift, or otherwise transfer a Product;
Share your purchased Product or access credentials with another person;
Upload or distribute a Product through a website, file-sharing service, social media platform, membership site, community, or other distribution channel;
Repackage, rebrand, reskin, or otherwise present a Product as your own;
Use a Product or substantial portions thereof to create a competing product;
Reproduce or substantially replicate the Product's content, structure, frameworks, worksheets, templates, designs, or instructional materials;
Incorporate the Product into another course, program, membership, bundle, subscription, service, or commercial offering;
Claim authorship or ownership of Plentiful Mom's content or intellectual property; or
Use any Product for purposes inconsistent with the license granted under these Terms.
No master resell rights (“MRR”), private label rights (“PLR”), resale rights, or other redistribution rights are granted unless expressly stated in writing by Plentiful Mom.
5. PERMITTED APPLICATION OF INFORMATION
Nothing in these Terms is intended to prevent you from applying general knowledge, concepts, strategies, principles, or skills learned through a Product to your own personal life, business, work, or creative activities.
You are expressly permitted to use the knowledge and strategies you acquire through a Product to develop, operate, market, and grow your own business.
The restrictions contained in these Terms apply to the unauthorized copying, reproduction, distribution, commercialization, or exploitation of Plentiful Mom's proprietary materials and intellectual property and do not prohibit you from independently applying general knowledge gained from the Product.
6. INTELLECTUAL PROPERTY
All materials contained on or made available through the Site, including without limitation text, written content, educational materials, worksheets, templates, graphics, photographs, illustrations, videos, audio, logos, trademarks, trade names, branding, designs, layouts, frameworks, processes, systems, and other materials (collectively, “Content”) are owned by Plentiful Mom or are used by Plentiful Mom pursuant to applicable rights or licenses.
The Site and all Content are protected by applicable copyright, trademark, intellectual property, and other laws.
Except for the limited license expressly granted to you under these Terms, no right, title, or interest in any Content is transferred to you.
All rights not expressly granted are reserved by Plentiful Mom.
Unauthorized use of the Site or Content may violate applicable intellectual property laws and may subject the violating party to civil or other legal remedies.
7. TRADEMARKS AND BRANDING
The Plentiful Mom name, logos, trademarks, service marks, trade dress, branding, and other identifying materials are the property of Plentiful Mom or are used with permission.
You may not use Plentiful Mom's trademarks, branding, logos, trade names, or other proprietary identifying materials without our prior written consent.
Nothing contained on the Site or in these Terms shall be construed as granting, by implication or otherwise, any license or right to use any trademark, service mark, trade name, or other proprietary material belonging to Plentiful Mom or any third party.
8. PURCHASES, PAYMENT, AND TAXES
By placing an order through the Site, you represent and warrant that the information provided in connection with the transaction is accurate, complete, and current.
You agree to pay all charges associated with your purchase at the price displayed at the time the transaction is completed.
Applicable taxes, including sales or other transaction-based taxes, may be added to purchases where required by applicable law. The amount of any applicable tax will be calculated at checkout based on the information available at the time of purchase.
Plentiful Mom reserves the right to change Product pricing at any time. Price changes will not affect purchases that have already been completed.
Unless otherwise required by applicable law, Plentiful Mom does not provide price adjustments, price protection, or refunds based solely on subsequent price reductions, discounts, sales, or promotional offers.
Payment processing may be facilitated through third-party payment processors or platforms. Your use of such services may also be subject to the applicable terms and policies of those providers.
9. DIGITAL DELIVERY AND ACCESS
Digital Products are generally delivered electronically following successful completion of a transaction.
You are responsible for providing a valid email address and other information necessary to receive and access your purchase.
You are also responsible for maintaining the equipment, software, internet connection, and other resources necessary to access digital Products.
If a technical issue prevents or materially interferes with your ability to access a Product you have purchased, Plentiful Mom will make reasonable efforts to assist with resolving the issue.
10. ALL SALES FINAL; NO REFUNDS
Due to the digital nature of the Products and the ability to access or download Products immediately following purchase, all sales are final and non-refundable, except where otherwise required by applicable law.
Plentiful Mom does not offer refunds for change of mind, lack of use, failure to implement the material, failure to achieve desired results, or failure to review the Product prior to purchase.
If a technical problem prevents you from receiving or accessing a Product after purchase, your sole remedy, at Plentiful Mom's discretion and subject to applicable law, may be replacement access or a refund of the purchase price.
Nothing in these Terms is intended to waive or limit any consumer rights that cannot legally be waived or limited.
11. EDUCATIONAL PURPOSE; NO GUARANTEE OF RESULTS
All Products and Content provided by Plentiful Mom are intended for educational and informational purposes only.
Plentiful Mom makes no representations, warranties, or guarantees regarding any particular outcome, result, income level, business growth, financial performance, audience growth, productivity, or other benefit that may result from the use or application of any Product.
Any examples, case studies, testimonials, statements of potential results, or references to outcomes are illustrative only and do not constitute a guarantee or representation that you will achieve the same or similar results.
Your results depend upon numerous factors, including your individual circumstances, experience, knowledge, skills, effort, implementation, resources, business model, market conditions, and other factors outside Plentiful Mom's control.
You assume full responsibility for your decisions and the results arising from your use of any Product or information provided by Plentiful Mom.

Plentiful Mom is not acting as your attorney, accountant, financial advisor, therapist, or other licensed professional.

PLENTIFUL MOM DOES NOT WARRANT THAT THE SITE OR PRODUCTS WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.
PLENTIFUL MOM DOES NOT WARRANT THAT ANY DEFECTS OR ERRORS WILL BE CORRECTED OR THAT THE SITE OR PRODUCTS WILL MEET YOUR PARTICULAR REQUIREMENTS OR EXPECTATIONS.
SOME JURISDICTIONS MAY NOT PERMIT THE EXCLUSION OF CERTAIN WARRANTIES. IN SUCH JURISDICTIONS, CERTAIN OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
18. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PLENTIFUL MOM AND ITS OWNERS, MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE, PRODUCTS, SERVICES, OR CONTENT.
THIS INCLUDES, WITHOUT LIMITATION, LOSS OF PROFITS, REVENUE, BUSINESS OPPORTUNITIES, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, WHETHER OR NOT PLENTIFUL MOM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLENTIFUL MOM'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO YOUR PURCHASE OR USE OF A PRODUCT SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID TO PLENTIFUL MOM FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.
NOTHING IN THESE TERMS SHALL EXCLUDE OR LIMIT LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.
19. INDEMNIFICATION
To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Plentiful Mom and its owners, officers, employees, contractors, agents, affiliates, licensors, and service providers from and against any claims, liabilities, damages, losses, judgments, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to:
(a) your breach or violation of these Terms;
(b) your violation of any applicable law or regulation;
(c) your infringement or violation of any third-party rights;
(d) your unauthorized use, reproduction, distribution, or commercialization of any Product or Content; or
(e) your misuse of the Site, Products, or Services.
20. TERMINATION AND SUSPENSION
Plentiful Mom reserves the right, in its sole discretion and to the extent permitted by law, to suspend, restrict, or terminate your access to the Site, Products, Services, or related materials if you violate these Terms or otherwise engage in conduct that Plentiful Mom reasonably determines to be harmful, unlawful, abusive, or inconsistent with the intended use of the Site.
Termination of access does not relieve you of obligations incurred prior to termination.
Provisions relating to intellectual property, disclaimers, limitations of liability, indemnification, governing law, and any other provisions that by their nature should survive termination shall survive termination.
21. COPYRIGHT INFRINGEMENT
Plentiful Mom respects the intellectual property rights of others.
If you believe that material available through the Site infringes your copyright or other intellectual property rights, you may contact Plentiful Mom through the contact information provided in Section 27. Please provide sufficient information describing the alleged infringement and identifying the relevant material.
22. MODIFICATIONS TO THESE TERMS
Plentiful Mom reserves the right to modify, amend, supplement, or replace these Terms at any time.
Any revised Terms will become effective when posted to the Site unless otherwise stated.
Your continued use of the Site or Products following the effective date of revised Terms constitutes your acceptance of the revised Terms, to the extent permitted by applicable law.
You are responsible for periodically reviewing the current Terms.
23. SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision shall be enforced to the maximum extent permitted by applicable law, and the remaining provisions shall remain in full force and effect.
24. NO WAIVER
No failure or delay by Plentiful Mom in exercising any right, power, or remedy under these Terms shall constitute a waiver of that right, power, or remedy.
A waiver of any provision or breach shall not constitute a waiver of any subsequent provision or breach.
25. GOVERNING LAW AND VENUE
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-law principles, except to the extent otherwise required by applicable law.
To the extent permitted by law, any legal action or proceeding arising out of or relating to these Terms, the Site, Products, or Services shall be brought in the applicable state or federal courts located within Fort Bend County, Texas, and you consent to the jurisdiction and venue of such courts.
26. ENTIRE AGREEMENT
These Terms, together with the applicable Privacy Policy, Product-specific terms, purchase terms, and any other written agreements expressly incorporated by reference, constitute the entire agreement between you and Plentiful Mom concerning your use of the Site and purchase and use of Products.
If a Product is accompanied by additional or product-specific terms, those terms shall supplement these Terms and, in the event of a direct conflict, shall control solely with respect to that Product.
