Terms and Conditions

These Terms and Conditions govern purchases made from HOM GROUP, operated by Nick Hom, who creates content and provides services under the public facing name Sensei Nick. References to “HOM GROUP,” “we,” “us,” or “our” in these Terms refer to HOM GROUP and its services.
By purchasing, accessing, or using any product or service offered through this store, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
1. Products and Services
HOM GROUP may offer products and services including, but not limited to:
• One on one calls
• Fitness coaching
• Training and nutrition education
• Digital guides and ebooks
• Educational materials
• Courses and other digital content
• Consulting, coaching, accountability, and strategy services
• Other related products and services
The specific scope, duration, pricing, and included features of each offering will be described on the applicable product, booking, application, or checkout page.
2. One on One Calls
One on one calls with Nick Hom, publicly known as Sensei Nick, are intended for general coaching, education, strategy, accountability, discussion, problem solving, and personal perspective.
These calls are not medical care, psychological treatment, therapy, legal advice, financial advice, or another licensed professional service.
Calls must be scheduled through the booking system provided after purchase.
If you need to reschedule a call, you must provide at least 24 hours notice.
Requests made less than 24 hours before the scheduled call may result in forfeiture of the session.
Failure to attend a scheduled call without notice will result in forfeiture of the session.
If you arrive late, the session may still end at the originally scheduled time.
If HOM GROUP must cancel or reschedule a call and a mutually acceptable replacement time cannot be arranged, you will be eligible for a refund for that session.
3. Health and Fitness Disclaimer
Nick Hom, publicly known as Sensei Nick, is not acting as a physician, therapist, psychologist, registered dietitian, or other licensed healthcare professional through products or services offered by HOM GROUP.
Information provided through calls, fitness coaching, training programs, nutrition discussions, digital products, videos, written materials, or other content is intended for general educational and informational purposes.
Nothing provided by HOM GROUP should be interpreted as medical diagnosis, medical treatment, mental health treatment, or a substitute for individualized care from a qualified licensed professional.
You are responsible for determining whether any exercise, nutrition practice, supplement, lifestyle change, or other recommendation is appropriate for your individual circumstances.
You should consult an appropriate licensed healthcare professional before making significant changes that may affect your health, particularly if you have a medical condition, use medication, are pregnant, have a history of injury, or otherwise have circumstances that warrant individualized professional guidance.
If a topic arises that falls outside the reasonable scope of HOM GROUP’s services, we may recommend that you speak with an appropriately qualified professional.
4. Fitness Coaching
Fitness coaching may include individualized training guidance, nutrition education, accountability, check ins, program adjustments, habit development, and related services as described during enrollment.
Fitness coaching does not guarantee any particular physical, performance, health, or aesthetic result.
Results vary based on factors including adherence, effort, consistency, genetics, lifestyle, health, circumstances, and factors outside the control of HOM GROUP.
Fitness coaching clients may be required to complete an application, onboarding process, questionnaire, waiver, or additional agreement.
If a separate coaching agreement conflicts with these general Terms and Conditions, the more specific coaching agreement will control with respect to that coaching service.
5. Refund Policy
One on one calls
Purchases are generally nonrefundable once a call has been booked, except when HOM GROUP cancels the session and a mutually acceptable replacement time cannot be arranged, or where a refund is otherwise required by applicable law.
Digital products
Digital products are generally nonrefundable once access has been provided, the product has been delivered, or the file has been downloaded.
Exceptions may be made for duplicate purchases, technical failures that prevent delivery, or circumstances where a refund is required by applicable law.
Fitness coaching
Refunds relating to ongoing fitness coaching will be governed by the terms presented during enrollment or in any applicable coaching agreement.
HOM GROUP reserves the right to issue refunds, credits, or exceptions at its discretion where appropriate and where permitted by law.
6. No Guarantee of Results
HOM GROUP does not guarantee any specific result from a call, coaching service, digital product, training program, nutrition strategy, educational material, or other offering.
Testimonials, examples, personal experiences, transformations, case studies, social media posts, or other results discussed by HOM GROUP do not guarantee that you will experience the same or similar outcome.
Your results depend on numerous factors outside our control.
You remain responsible for your own choices, actions, implementation, effort, consistency, and results.
7. Personal Responsibility
By purchasing or using a HOM GROUP product or service, you acknowledge that you remain responsible for your own decisions and actions.
Any opinions, recommendations, observations, strategies, frameworks, or educational information provided by HOM GROUP are offered for your consideration.
You are responsible for deciding whether and how you use that information.
Participation in calls, fitness coaching, training activities, nutrition practices, digital programs, or other services is voluntary.
8. Intellectual Property
Unless otherwise stated, all original materials provided by HOM GROUP or Sensei Nick are owned by HOM GROUP or used with permission.
This includes, but is not limited to:
• Written guides
• Fitness programs
• Training materials
• Nutrition materials
• Videos
• Audio
• Graphics
• Worksheets
• Frameworks
• Educational materials
• Course content
• Documents
• Digital downloads
• Written content
Your purchase grants you a limited, personal, nonexclusive, and nontransferable license for your own personal use.
You may not reproduce, resell, redistribute, publish, upload, share, sublicense, commercially exploit, or otherwise distribute purchased materials without prior written permission from HOM GROUP.
Purchasing a product does not transfer ownership of the underlying intellectual property.
9. Third Party Platforms
HOM GROUP may rely on third party platforms and service providers including Stan, Stripe, Google Calendar, Google Meet, email providers, payment processors, hosting providers, and other technology services.
HOM GROUP is not responsible for outages, interruptions, errors, data loss, or service failures caused by third party providers outside our reasonable control.
If a third party technical issue prevents delivery of a purchased product or service, HOM GROUP will make reasonable efforts to provide an alternative method of delivery or otherwise resolve the issue.
10. Payments
Payment is due at the time of purchase unless otherwise stated.
You agree to provide accurate billing and payment information and authorize the applicable payment processor to charge the amount displayed at checkout.
You are responsible for any applicable taxes, fees, or other charges assessed in connection with your purchase.
Prices may change at any time.
A future price change does not create a right to a refund, credit, or price adjustment for a prior purchase.
11. Marketing Communications
Transactional communications relating to purchases, bookings, scheduling, product delivery, account information, and customer support may be sent as necessary in connection with your purchase.
Promotional or marketing communications will be sent where consent has been provided or where otherwise permitted by applicable law.
You may unsubscribe from marketing communications using the applicable unsubscribe method provided with those communications.
12. Privacy
Personal information provided during checkout, booking, applications, onboarding, or communications with HOM GROUP may be used for purposes including:
• Processing purchases
• Delivering products and services
• Scheduling
• Customer support
• Business administration
• Communicating about your purchase or service
• Maintaining relevant customer records
Payment information is processed through third party payment processors and is not directly stored by HOM GROUP except to the extent information is made available through those services.
13. Acceptable Conduct
HOM GROUP reserves the right to refuse, suspend, or discontinue service when a customer engages in abusive, threatening, harassing, fraudulent, unlawful, or otherwise seriously inappropriate conduct.
If service is terminated because of serious misconduct by the customer, HOM GROUP may decline to provide a refund to the extent permitted by applicable law.
14. Limitation of Liability
To the maximum extent permitted by applicable law, HOM GROUP and Nick Hom will not be liable for indirect, incidental, special, punitive, consequential, or similar damages arising from the use of, or inability to use, any product or service.
To the maximum extent permitted by applicable law, HOM GROUP’s total liability relating to a particular purchase will not exceed the amount actually paid by the customer for the product or service giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
15. Governing Law
These Terms and Conditions are governed by the laws of the State of California, without regard to conflict of law principles.
Any dispute arising from these Terms or from a purchase of HOM GROUP products or services will be handled in an appropriate court located in California, unless applicable law requires otherwise.
16. Changes to These Terms
HOM GROUP may update these Terms and Conditions from time to time.
The version in effect at the time of purchase will generally govern that purchase unless a change is required by law or otherwise agreed upon.
17. Severability
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, the remaining provisions will remain valid and enforceable to the fullest extent permitted by law.
