CLIENT SERVICES AGREEMENT & TERMS AND CONDITIONS
These Terms and Conditions (“Agreement”) govern purchases of services from 60 Minutes Breakthrough Coaching, LLC, 1811 Kapalua Drive, Oxnard, CA 93036, USA (“Company”).
By clicking “I Agree,” submitting payment, completing checkout, or otherwise enrolling in or purchasing a service from Company, you (“Client”) acknowledge that you have read, understood, and agreed to these Terms and Conditions.
1. SERVICES
Company provides business coaching, business intelligence, consulting, educational services, intuitive/psychic business insights, and energetic work.
This Agreement applies to the following services (“Services”), as applicable to Client's purchase:
Psychic Business Scan
A personalized audio business scan providing intuitive and strategic insights relating to Client's business, money, clients, opportunities, and potential revenue channels, together with a full-body energetic clearing based on Client's stated income goal and a list of what was cleared.
Wealth Activation Session
A private 70-minute session incorporating energetic work and business intelligence related to Client's wealth goals, business, decisions, opportunities, and next steps. After booking, Company will contact Client with the first available session times.
One-Month Private Intensive
One month of private energetic and business strategy work, including four private live sessions and two days of private Telegram support per week. After booking, Company and Client will establish the start date and schedule the sessions.
The specific Service purchased, current price, and any additional deliverables stated on the applicable checkout or sales page at the time of purchase form part of this Agreement.
Company may use intuitive, spiritual, energetic, psychic, strategic, and business-development methodologies within its Services. Client understands that these methodologies are provided as coaching, consulting, educational, spiritual and/or personal-development services and are not guarantees of particular outcomes.
2. FEES AND PAYMENT
Client agrees to pay the price displayed at checkout for the Service selected.
Unless Company expressly offers a payment plan at checkout, payment is due in full at the time of purchase.
If Client purchases through an authorized payment plan, Client remains responsible for all payments according to the payment schedule accepted at checkout.
3. REFUNDS AND CANCELLATION
Because Company reserves time, capacity and/or begins preparing personalized work upon purchase, all sales are final and payments are non-refundable, except where a refund is required by applicable law.
For Services purchased through a payment plan, cancellation or non-participation does not cancel Client's remaining payment obligations, except where otherwise required by applicable law.
Failure to participate in, use, schedule, or complete a purchased Service does not entitle Client to a refund.
4. SCHEDULING AND RESCHEDULING
For scheduled private sessions, Client may request to reschedule by providing at least 24 hours' notice.
A session cancelled or rescheduled with less than 24 hours' notice may be forfeited, except in an emergency or where Company agrees otherwise.
If Company needs to reschedule a session, Company will provide as much notice as reasonably possible and will arrange a replacement session.
Client is responsible for scheduling and using all sessions and support included within the applicable Service period.
5. CLIENT RESPONSIBILITY AND NO GUARANTEE OF RESULTS
Client understands and agrees that Client is responsible for Client's own decisions, actions, implementation, business activities, financial decisions, and results.
Examples of results achieved by previous clients, testimonials, revenue figures, income examples, or descriptions of potential outcomes are provided for illustrative purposes only and do not constitute a promise or guarantee that Client will achieve the same or similar results.
Company does not guarantee any particular financial result, including increased revenue, specific income amounts, premium-client acquisition, sales, business growth, or any particular timeframe for results.
Any references in Company marketing to potential revenue increases, income goals, wealth timelines, business opportunities, or other outcomes describe possibilities and the focus of the work rather than guaranteed results.
6. NATURE OF ENERGETIC, INTUITIVE AND PSYCHIC SERVICES
Client understands that some Services may include energetic work, intuitive or psychic insights, spiritual concepts, Source-based guidance, energetic clearing, or similar methodologies.
These services are subjective in nature and are provided as part of Company's coaching, consulting, spiritual and personal-development work.
Client retains complete responsibility for deciding whether and how to act upon any insight, guidance, strategy, recommendation, or information received through the Services.
7. NOT MEDICAL, MENTAL-HEALTH, LEGAL, TAX OR FINANCIAL ADVICE
Company does not provide medical treatment, psychotherapy, mental-health treatment, legal advice, accounting advice, tax advice, or regulated financial or investment advice.
Nothing provided through the Services should be used as a substitute for services from an appropriately licensed professional.
Client is responsible for seeking appropriate professional assistance when needed.
8. INTELLECTUAL PROPERTY
All original materials, methodologies, recordings, documents, transmissions, exercises, frameworks, written materials, audio materials, and other content supplied by Company remain Company's intellectual property unless expressly stated otherwise.
Client receives a limited, personal, non-transferable license to use materials provided as part of the purchased Service for Client's individual use.
Client may not copy, reproduce, sell, distribute, publish, teach, sublicense, share, commercially exploit, or otherwise disseminate Company's proprietary materials without Company's prior written consent.
Nothing in this Agreement transfers ownership of Company's intellectual property to Client.
9. CONFIDENTIALITY
Company will keep confidential non-public information disclosed by Client concerning Client's personal affairs, business, finances, clients, strategies, or other confidential matters and will not intentionally disclose such information to third parties except:
with Client's permission;
where reasonably necessary to provide the Services;
where required by law; or
where necessary to protect Company's legal rights.
Client likewise agrees to respect the confidentiality of proprietary or confidential information Company provides during the Services.
10. CLIENT RESULTS AND TESTIMONIALS
Company may refer anonymously to Client results, business wins, or general outcomes for educational or marketing purposes, provided that Company does not disclose Client's name, identifying information, confidential business information, or other information reasonably capable of identifying Client without Client's permission.
Company will obtain Client's permission before using Client's name, photograph, identifiable testimonial, screenshots containing identifying information, or other personally identifying material for promotional purposes.
11. PROGRAM AND COMMUNICATION RULES
Client agrees to communicate respectfully and to use Company's communication channels and support access within the scope of the Service purchased.
Access to Telegram support, private sessions, or other forms of access applies only during the period and according to the frequency included with the Service purchased.
Company may establish reasonable boundaries regarding communication, scheduling, response times, and use of support channels.
Material or repeated violation of these boundaries may result in termination of Client's access to the Service. Any refund or remaining payment obligation following termination will be determined according to this Agreement and applicable law.
12. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Company will not be liable for indirect, incidental, special, consequential, or punitive damages arising from Client's participation in or use of the Services.
Client acknowledges that business, financial, personal and strategic decisions involve inherent risks and remains responsible for Client's decisions and actions.
Nothing in this Agreement excludes or limits liability that cannot lawfully be excluded or limited.
13. INDEMNIFICATION
To the extent permitted by applicable law, Client agrees to indemnify and hold Company and its owners, officers, employees, contractors, affiliates, and successors harmless from third-party claims, liabilities, losses, or expenses arising directly from Client's unlawful conduct, misuse of Company's materials, or material breach of this Agreement.
14. CONTROLLING AGREEMENT
If there is a conflict between this Agreement and Company's general marketing materials, this Agreement controls regarding legal terms, limitations, refund rights, intellectual property, dispute resolution, and the parties' respective responsibilities.
The applicable checkout or sales page controls regarding the specific Service purchased, price, duration, and included deliverables unless expressly stated otherwise in this Agreement.
15. GOVERNING LAW AND DISPUTE RESOLUTION
This Agreement shall be governed by the laws of the State of California, without regard to its conflict-of-law principles.
Before initiating formal proceedings, the parties agree to make a good-faith effort to resolve any dispute directly.
Any arbitration provision or other dispute-resolution provision used by Company must be interpreted and applied consistently with applicable federal and California law.
16. SEVERABILITY
If any provision of this Agreement is determined to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in effect.
17. CHANGES TO THESE TERMS
The terms applicable to Client's purchase are the terms accepted by Client at the time of purchase.
Company may update these Terms for future purchases, but a later update will not retroactively alter the material terms governing a completed purchase unless Client expressly agrees to the change.
18. ENTIRE AGREEMENT
This Agreement, together with the applicable checkout page and any written terms expressly incorporated into it, constitutes the agreement between Company and Client regarding the purchased Service and supersedes prior discussions or representations concerning that Service.
Any modification applicable to an existing purchase must be agreed to in writing by both parties.
