Terms and Conditions & Privacy Policy
Last Updated: July 27, 2026
PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS WEBSITE OR PURCHASING ANY PRODUCTS.
These Terms and Conditions (“Terms”) govern your access to and use of the websites, pages, checkout pages, digital products, courses, downloads, services, communities, email communications, and related online properties operated by TakiGPT AI Inc. (“Company,” “we,” “us,” or “our”), including content associated with @taki.gpt and any related TakiGPT AI offers, products, or services.
These Terms are presented in two parts. Part A contains our terms of sale and use. Part B contains our Privacy Policy, which explains how we collect, use, disclose, and protect personal information in compliance with Canadian privacy law (including the Personal Information Protection and Electronic Documents Act (PIPEDA) and Quebec Law 25), Canada’s Anti-Spam Legislation (CASL), the European Union’s General Data Protection Regulation (GDPR) and the UK GDPR, and United States privacy laws (including the CAN-SPAM Act and state privacy laws such as the California Consumer Privacy Act as amended by the CPRA). Part A and Part B together form a single agreement between you and TakiGPT AI Inc.
By accessing this website, using our content, submitting your information, or purchasing from TakiGPT AI Inc., you agree to be bound by these Terms, including the Privacy Policy in Part B. If you do not agree, do not use the website or purchase any products.
For purposes of these Terms, “Site” includes this website, our Stan Store pages, checkout pages, landing pages, product pages, social media-linked pages, email opt-in pages, and any related online platforms we use to sell or deliver our products and services.
PART A: TERMS AND CONDITIONS
1. Ownership and License
You agree that the Site itself, as well as all content, videos, training materials, prompts, workflows, templates, documents, downloads, digital products, services, graphics, recordings, copy, designs, code, software configurations, and other materials made available by TakiGPT AI Inc. or its third-party providers, excluding only the materials you provide, are owned by or licensed to TakiGPT AI Inc. and are protected by copyright, trademark, trade secret, and other intellectual property laws.
Subject to your compliance with these Terms, the Company grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access, view, download, and use the purchased Content solely for your own personal or internal business purposes.
Unless we give you written permission, you may not copy, reproduce, republish, upload, post, share, distribute, resell, sublicense, modify, create derivative works from, publicly display, publicly perform, or commercially exploit any Content.
Any unauthorized use of the Content may result in termination of access and legal action.
2. Intellectual Property and Restrictions
All materials are copyrighted unless otherwise noted and are the property of TakiGPT AI Inc., Taki Wong, or our licensors, suppliers, or service providers.
You may not:
- resell, redistribute, or share purchased digital products;
- upload our paid materials to public websites, file-sharing platforms, AI model training datasets, prompt libraries, communities, or marketplaces;
- claim ownership of our materials, frameworks, workflows, templates, or training content;
- remove copyright, trademark, attribution, or proprietary notices;
- use our Content to create a competing product, course, membership, template pack, prompt pack, coaching program, or training resource;
- use our name, likeness, brand, social handles, trademarks, or proprietary assets without written permission.
You may use the ideas, educational concepts, and strategies you learn from our Content for your own implementation, provided you do not copy, resell, distribute, or misrepresent the Content itself.
3. Eligibility
The Site, Content, and our products are intended for individuals who are at least 18 years of age or the age of majority in their jurisdiction, whichever is greater. By using the Site or making a purchase, you represent that you meet this requirement.
The Site is not directed to children, and we do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us with personal information, contact us at takigptai@gmail.com and we will delete it as required by applicable law.
4. Purchases, Digital Delivery, and Account Access
When you purchase a digital product, course, template, workflow, download, or other digital asset from TakiGPT AI Inc., you are responsible for providing accurate checkout information, including your name, email address, and payment information.
Products may be delivered through Stan Store, email, download links, third-party platforms, course platforms, communities, or other delivery tools.
Payment information. Payment card and banking details are collected and processed directly by the checkout platform and payment processors we use (for example, Stan Store and Stripe). We do not receive, store, or have access to your full payment card number. Payment processing is subject to the applicable processor’s own terms and privacy policy.
You are responsible for maintaining access to the email address used at checkout. We are not responsible for missed product delivery due to incorrect email addresses, spam filters, inbox restrictions, or failure to follow access instructions.
We may refuse, cancel, or revoke access to any order where we reasonably believe there has been fraud, abuse, unauthorized sharing, chargeback misuse, violation of these Terms, or other misuse of our products or services.
5. Refund Policy
Due to the digital nature of the products and services sold by TakiGPT AI Inc., including proprietary intellectual property, prompts, workflows, code, templates, training materials, and other digital assets that may be accessible immediately upon purchase, all sales are final unless otherwise stated in writing or required by applicable law.
No refunds will be issued for reasons including, but not limited to:
- change of mind;
- inability to implement the material;
- lack of technical knowledge;
- failure to use the product;
- failure to read the product description before purchase;
- incompatibility with your tools, software, systems, goals, or business model;
- duplicate purchases caused by customer error;
- dissatisfaction based on personal expectations not expressly promised in the offer.
By purchasing, you acknowledge and agree that once you receive access to the Content, you cannot return or revoke access to the proprietary digital materials in the same way physical goods can be returned.
EEA and UK consumers. If you are a consumer in the European Economic Area or the United Kingdom, you may have a statutory 14-day right of withdrawal for online purchases. For digital content that is not supplied on a tangible medium, this right is lost once supply begins, provided you gave prior express consent to immediate supply and acknowledged that you would lose the right of withdrawal. Where our checkout requests it, your purchase includes that express consent and acknowledgment, and delivery begins immediately. If that consent and acknowledgment were not obtained from you, your statutory withdrawal rights remain unaffected.
This policy does not limit any non-waivable rights you may have under applicable consumer protection laws, including the Ontario Consumer Protection Act, 2002, where it applies.
6. No Guarantees, No Earnings Claims, and No Professional Advice
TakiGPT AI Inc. provides educational content, digital tools, templates, prompts, workflows, and strategic resources. We do not guarantee that you will achieve any particular outcome, income, business result, productivity increase, audience growth, client acquisition, or financial result.
Your results depend on many factors outside our control, including your skill, effort, consistency, implementation, market conditions, business model, audience, offer, pricing, communication, technology stack, and decision-making.
Any examples, case studies, demonstrations, testimonials, or references to results are illustrative only and do not guarantee that you will achieve the same or similar results.
Our Content is provided for general educational and informational purposes only. It does not constitute legal, financial, tax, accounting, investment, or other professional advice, and it should not be relied on as a substitute for advice from a qualified professional who knows your specific situation.
7. User Responsibilities
You agree to use the Site and Content lawfully and responsibly.
You agree not to:
- use the Site or Content for unlawful, fraudulent, misleading, harmful, or abusive purposes;
- interfere with the security or operation of the Site;
- attempt to gain unauthorized access to any systems, accounts, products, or materials;
- share your access credentials with others;
- scrape, copy, harvest, or systematically extract data or Content;
- use our Content to violate the rights of others;
- misrepresent your affiliation with TakiGPT AI Inc.;
- use our products or services in a way that violates applicable laws, platform terms, or third-party rights.
We reserve the right to suspend or terminate your access if we believe you have violated these Terms.
8. Third-Party Links, Platforms, and AI Tools
The Site, emails, products, or Content may contain links to third-party websites, tools, platforms, or resources. These are provided for convenience only.
We do not control and are not responsible for third-party websites, terms, privacy policies, content, security, availability, or practices. Your use of third-party platforms is at your own risk and may be governed by their own terms and policies.
Our Content may reference or teach the use of third-party AI tools, software, and platforms (for example, AI assistants, automation tools, and model providers). We are not affiliated with those providers unless expressly stated, we do not control their features, pricing, availability, or output, and those tools may change or be discontinued at any time. Your use of any third-party AI tool is governed by that provider’s own terms, and you are responsible for how you use AI-generated output in your business.
9. Changes to Products, Services, and Content
We may update, modify, discontinue, replace, or remove any part of the Site, Content, products, services, pricing, offers, or availability at any time without notice.
We are not obligated to continue offering any specific product, service, feature, training, platform, community, or resource.
10. Termination of Access
We may suspend or terminate your access to the Site, Content, products, services, communities, or accounts if we believe you have violated these Terms, misused our Content, engaged in fraudulent activity, abused our support or refund processes, shared access without permission, or acted in a way that harms TakiGPT AI Inc., our users, our business, or our intellectual property.
Termination does not limit any other rights or remedies available to us.
11. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Site, Content, digital products, and services are provided on an “as is” and “as available” basis, without warranties, conditions, or representations of any kind, whether express, implied, statutory, or otherwise, including any implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, or non-infringement.
We do not warrant that the Site or Content will be uninterrupted, timely, secure, error-free, or free of viruses or other harmful components, or that any defects will be corrected.
Some jurisdictions do not allow the exclusion of certain warranties or conditions, so some of the above exclusions may not apply to you. Nothing in this section limits any non-waivable statutory rights you may have, including under the Ontario Consumer Protection Act, 2002, where it applies.
12. Limitation of Liability
To the fullest extent permitted by law, TakiGPT AI Inc., Taki Wong, and our affiliates, contractors, service providers, officers, employees, representatives, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or other similar damages arising from or related to your use of, or inability to use, the Site, Content, products, services, emails, third-party platforms, or any materials purchased or accessed through us.
This includes, without limitation, damages for lost profits, lost revenue, lost business opportunities, lost data, business interruption, loss of goodwill, or reliance on any information provided by us.
Liability cap. In no event shall TakiGPT AI Inc. be held liable for damages exceeding the amount paid for the digital products or services giving rise to the claim. If you have not paid any amount to TakiGPT AI Inc., our total aggregate liability shall not exceed CAD $100.
Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
13. Indemnification
Users agree to indemnify, defend, and hold TakiGPT AI Inc. harmless against any claims that arise from the use of any digital products or services.
Without limiting the foregoing, you agree to indemnify, defend, and hold harmless TakiGPT AI Inc., Taki Wong, and our affiliates, contractors, service providers, officers, employees, representatives, and agents from and against any claims, liabilities, damages, losses, costs, expenses, and fees, including reasonable legal fees, arising out of or related to:
- your use of the Site, Content, digital products, or services;
- your violation of these Terms;
- your misuse of our products or services;
- your violation of applicable laws;
- your infringement of intellectual property, privacy, publicity, or other rights;
- your unauthorized sharing, resale, copying, or distribution of our Content.
14. Governing Law and Dispute Resolution
This agreement is governed by the laws of Ontario, Canada, and disputes shall be resolved in Canada.
Specifically, these Terms shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Subject to any rights you may have under applicable consumer protection laws, any dispute arising out of or relating to these Terms, the Site, or any product or service purchased from TakiGPT AI Inc. shall be resolved exclusively in the courts located in Ontario, Canada, and you consent to the jurisdiction of those courts.
15. Amendments to These Terms
We reserve the right to update or revise these Terms, including the Privacy Policy in Part B, at any time. The updated version will be posted on the Site or made available through the relevant platform, and the “Last Updated” date at the top of these Terms will be revised.
Where required by law, we will provide notice of material changes before they take effect. By continuing to use the Site, access Content, or purchase products after changes are posted, you agree to be bound by the revised Terms.
16. General Provisions
Entire agreement. These Terms, together with any product-specific terms presented at checkout, constitute the entire agreement between you and TakiGPT AI Inc. regarding the Site and our products and services.
Severability. If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect.
No waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
Assignment. You may not assign or transfer these Terms or any purchased license without our written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.
Survival. Sections that by their nature should survive termination (including ownership, restrictions, disclaimers, limitation of liability, indemnification, and governing law) survive any termination of these Terms or your access.
Electronic acceptance. You agree that clicking to purchase, checking a box, submitting a form, or otherwise using the Site constitutes a valid electronic acceptance of these Terms.
PART B: PRIVACY POLICY
This Part B is the Privacy Policy of TakiGPT AI Inc. It explains what personal information we collect, why we collect it, how we use and share it, how long we keep it, and the rights you have over it. By agreeing to these Terms, you also agree to this Privacy Policy. The current version of this Privacy Policy may also be posted at https://www.takigpt.com/privacy/.
17. Our Privacy Commitment and Legal Compliance
TakiGPT AI Inc. designs its data handling practices to comply with the privacy and electronic marketing laws that apply to our business and our customers, including:
- Canada: the Personal Information Protection and Electronic Documents Act (PIPEDA), applicable provincial private-sector privacy laws (including Quebec’s Act respecting the protection of personal information in the private sector, as amended by Law 25, and the Alberta and British Columbia Personal Information Protection Acts where they apply), and Canada’s Anti-Spam Legislation (CASL);
- European Union / United Kingdom: the General Data Protection Regulation (GDPR), the UK GDPR and Data Protection Act 2018, and the Swiss Federal Act on Data Protection, for individuals located in those regions;
- United States: the CAN-SPAM Act for commercial email, and applicable state comprehensive privacy laws, including the California Consumer Privacy Act as amended by the California Privacy Rights Act (CCPA/CPRA) and the comprehensive privacy laws of states such as Virginia, Colorado, Connecticut, Texas, Oregon, Montana, Utah, Florida, Delaware, Iowa, Nebraska, New Hampshire, New Jersey, Tennessee, Minnesota, Maryland, Indiana, Kentucky, and Rhode Island, where they apply.
In practice, this means we: identify the purposes for collecting personal information at or before the time of collection; collect only what we need for those purposes; obtain consent where required and honor withdrawals of consent; use express opt-in consent for marketing messages where required by CASL and other laws; give you access to, correction of, and deletion of your personal information as described below; protect personal information with reasonable safeguards; limit how long we keep it; and hold our service providers to comparable standards by contract.
We do not use personal information for a new purpose without your consent unless the use is required or permitted by law, and we never sell personal information in exchange for money.
18. Personal Information We Collect
Personal information we may collect includes:
- name;
- email address;
- phone number, if provided;
- billing and payment-related information (excluding full payment card numbers, which are handled by our payment processors);
- product purchase history;
- checkout responses;
- consent and communication preferences;
- customer support messages;
- social media profile information if you interact with us through social platforms;
- technical information such as IP address, browser type, device information, usage data, cookies, email open/click data, and analytics data where applicable.
We may collect personal information directly from you, through our Site, through Stan Store, through payment processors, through email marketing providers, through analytics tools, through social media platforms, and through other third-party tools used to operate our business.
19. How and Why We Use Personal Information
We collect and process personal information for purposes including: operating the Site; processing purchases; delivering digital products; providing customer support; managing customer relationships; sending transactional communications; sending marketing communications where permitted; improving our products and services; maintaining business records; preventing fraud; and complying with legal obligations.
We use personal information only for legitimate business purposes, contractual purposes, consent-based purposes, legal compliance, and other purposes permitted by applicable privacy laws. Where our processing is based on your consent, you may withdraw that consent at any time, subject to legal or contractual restrictions and reasonable notice.
Depending on your location, our lawful bases for processing include:
- performance of a contract, such as processing your order and delivering purchased products;
- consent, such as when you opt in to receive marketing emails;
- legitimate interests, such as improving our products, preventing fraud, managing our business, and communicating with customers, provided those interests are not overridden by your rights;
- legal obligations, such as tax, accounting, consumer protection, and compliance requirements.
20. Service Providers and Third-Party Platforms
Service providers acting on our behalf. Some third parties process personal information on our behalf and on our instructions, such as email marketing platforms, course or content hosting platforms, analytics providers, customer support or CRM tools, and cloud storage and hosting providers. When we transfer personal information to a service provider for processing, we remain responsible for that information, and we use contractual or other means to require a comparable level of protection while it is being processed, including limits on use, confidentiality obligations, and security safeguards.
Independent platforms. Other platforms collect and process your information for their own purposes under their own terms and privacy policies. These include Stan Store when you purchase through it, payment processors such as Stripe, social media platforms, and advertising platforms such as Meta, Google, or TikTok. When you purchase through Stan Store or another third-party platform, your information is also processed under that platform’s own terms and privacy policy, and we encourage you to review them. We are not responsible for the independent practices of platforms that do not process personal information on our behalf.
21. Your Canadian Privacy Rights (PIPEDA and Quebec Law 25)
Our handling of personal information is governed by PIPEDA and applicable provincial privacy laws, including Quebec’s Act respecting the protection of personal information in the private sector (as amended by Law 25) where they apply.
Subject to limited exceptions under applicable law, you have the right to:
- access the personal information we hold about you and be informed of how it is used and to whom it has been disclosed;
- request correction of inaccurate or incomplete information;
- request deletion of your personal information as described in Section 26 (Data Deletion Requests);
- withdraw your consent to our collection, use, or disclosure of your personal information, subject to legal or contractual restrictions and reasonable notice;
- question or complain about our compliance with applicable privacy laws.
Quebec residents may have additional rights under Law 25, including rights to deletion or de-indexing in certain circumstances and the right to receive computerized personal information you provided to us in a structured, commonly used technological format.
Person in charge of the protection of personal information (Privacy Officer): Taki Wong, takigptai@gmail.com. We respond to requests within the time required by applicable law and may need to verify your identity before responding.
If you are not satisfied with our response, you may file a complaint with the Office of the Privacy Commissioner of Canada or, for Quebec residents, the Commission d’accès à l’information du Québec.
22. Your European Privacy Rights (GDPR and UK GDPR)
If you are located in the European Economic Area, the United Kingdom, Switzerland, or another region with similar privacy rights, you have additional rights under applicable data protection laws.
For purposes of applicable data protection laws, TakiGPT AI Inc. is generally the controller of personal information we collect directly from you for our own business purposes, including customer management, product delivery, and marketing. Our lawful bases for processing are described in Section 19.
You may have the right to:
- access the personal information we hold about you;
- request correction of inaccurate information;
- request deletion of your personal information (“right to be forgotten”), which we honor as described in Section 26;
- request restriction of processing;
- object to certain processing, including direct marketing;
- request portability of your personal information;
- withdraw consent at any time where processing is based on consent;
- lodge a complaint with a data protection authority in your country.
Withdrawing consent does not affect the lawfulness of processing based on consent before withdrawal.
To exercise your rights, contact us at takigptai@gmail.com. We may need to verify your identity before responding. We may also retain certain information where required or permitted by law, including for legal, accounting, tax, fraud prevention, security, dispute resolution, and suppression-list purposes.
23. Your United States Privacy Rights
If you are a resident of a U.S. state with a comprehensive privacy law, including California (CCPA/CPRA), Virginia, Colorado, Connecticut, Texas, Oregon, Montana, Utah, Florida, Delaware, Iowa, Nebraska, New Hampshire, New Jersey, Tennessee, Minnesota, Maryland, Indiana, Kentucky, or Rhode Island, you may have some or all of the following rights, subject to the terms and thresholds of your state’s law:
- the right to know and access the personal information we have collected about you;
- the right to correct inaccurate personal information;
- the right to delete personal information, which we honor as described in Section 26;
- the right to receive a portable copy of your personal information;
- the right to opt out of the “sale” or “sharing” of personal information, targeted advertising, and certain profiling;
- the right to limit the use of sensitive personal information, where applicable;
- the right to non-discrimination for exercising your privacy rights;
- the right to appeal a refusal of a privacy request, where your state provides one.
Sale and sharing. We do not sell personal information in exchange for money. Like most online businesses, our use of advertising cookies, pixels, and hashed custom audiences (Section 28) may be considered “sharing” or “targeted advertising” under some state laws. You may opt out at any time by emailing takigptai@gmail.com with the subject line “Opt Out,” by unsubscribing from marketing, or by managing cookies as described in Section 27. Where required by law, we honor opt-out preference signals such as the Global Privacy Control (GPC) for users whose browsers send them.
Many state privacy laws technically apply only to businesses that exceed certain revenue or data-volume thresholds. Whether or not a given law applies to TakiGPT AI Inc., our practice is to honor verified access, correction, deletion, and opt-out requests from U.S. residents.
To exercise any of these rights, or to submit a request through an authorized agent, contact takigptai@gmail.com. We will verify your identity, respond within the time required by your state’s law (generally 45 days, with extension where permitted), and will not discriminate against you for exercising your rights. If we decline a request, you may appeal by replying to our response, and we will inform you of the outcome and, where applicable, your right to contact your state attorney general.
24. International Data Transfers
TakiGPT AI Inc. is operated from Canada, and our service providers may process or store personal information in Canada, the United States, or other countries.
If you are located outside Canada, your personal information may be transferred to and processed in countries that may not provide the same level of data protection as your home jurisdiction. While personal information is in another jurisdiction, it may be subject to the laws of that jurisdiction and may be accessible to its courts, law enforcement, and national security authorities.
Where required, we use appropriate safeguards for international transfers of personal information, such as contractual protections (including standard contractual clauses for transfers of EEA/UK personal data), adequacy mechanisms (Canada benefits from an EU adequacy decision for PIPEDA-covered processing), or other lawful transfer mechanisms. For questions about our use of service providers located outside your jurisdiction, contact our Privacy Officer at takigptai@gmail.com.
25. Data Retention
We retain personal information only for as long as reasonably necessary for the purposes for which it was collected, including to provide products and services, manage customer relationships, comply with legal obligations, resolve disputes, enforce agreements, maintain security, prevent fraud, and maintain marketing suppression records.
Consent records may be retained for as long as necessary to demonstrate compliance with applicable email marketing, privacy, and anti-spam laws.
When personal information is no longer required for these purposes, we securely delete, destroy, de-identify, or anonymize it.
26. Data Deletion Requests (30-Day Deletion Policy)
If requested, any user data will be erased within 30 days, except when retention is required by law.
To request deletion of your personal information, email takigptai@gmail.com with the subject line “Data Deletion Request” from the email address associated with your records, or provide enough information for us to verify your identity. Once your request is verified, we will erase your personal information from our active systems within 30 days and direct our service providers to do the same.
Limited exceptions apply where retention is required or permitted by law, including:
- records we must keep for tax, accounting, and other legal or regulatory obligations (for example, transaction records required by Canadian tax law);
- information needed to complete a transaction you have requested, deliver a product you purchased, or manage an active dispute, refund, or chargeback;
- information needed to detect and prevent fraud, enforce our agreements, or establish, exercise, or defend legal claims;
- minimal suppression-list records (such as your email address) that CASL, CAN-SPAM, and similar laws require us to keep so we do not contact you again after you unsubscribe;
- residual copies in secure backups, which are deleted or overwritten on our regular backup cycles and are not used for any other purpose in the meantime.
Where an exception applies, we delete the remaining information as soon as the legal requirement or permitted purpose expires. This deletion policy applies to all users regardless of location and operates alongside your rights under PIPEDA, Quebec Law 25, the GDPR and UK GDPR, and U.S. state privacy laws.
27. Cookies, Tracking, and Analytics
We may use cookies, pixels, analytics tools, advertising tools, and similar technologies to operate the Site, understand user behavior, improve our products, measure marketing performance, personalize content, and support advertising.
These tools may collect information such as device information, browser type, IP address, page views, clicks, referring URLs, email opens, email clicks, and other usage information.
Where required by law, we will request consent for non-essential cookies or tracking technologies. You can manage cookies through your browser settings or other tools provided by applicable platforms, and where required by law we honor browser-based opt-out preference signals such as the Global Privacy Control.
28. Advertising and Custom Audiences
Where permitted by applicable law and by platform terms, we may use contact information you have provided, such as your email address, in hashed (coded) form to create custom or lookalike audiences on advertising platforms such as Meta, Google, or TikTok. We use customer data with these advertising tools only where we have provided appropriate notice and hold any consent required by applicable law and the platform’s terms.
You may opt out of custom audience use at any time by contacting us at takigptai@gmail.com or by unsubscribing from marketing communications. If you opt out, we will exclude your information from audience lists we control and remove it as required by applicable law and platform terms.
29. Security and Breach Notification
We use reasonable administrative, technical, and organizational safeguards to protect personal information, appropriate to its sensitivity. However, no website, platform, email system, payment system, or internet transmission is completely secure.
If a breach of security safeguards involving your personal information creates a real risk of significant harm, or where notification is otherwise required by law (including PIPEDA’s breach reporting rules, Quebec Law 25, the GDPR’s 72-hour authority notification requirement, and U.S. state breach notification laws), we will notify affected individuals and the appropriate regulators as required by applicable law.
You are responsible for keeping your account credentials, email account, and devices secure.
30. Children’s Privacy
The Site and our products are not directed to children, and we do not knowingly collect personal information from anyone under 18 (or the age of majority in their jurisdiction). If we learn that we have collected personal information from a minor, we will delete it as required by applicable law. Parents or guardians who believe a minor has provided us personal information may contact takigptai@gmail.com.
31. Transactional Communications
By purchasing a product, creating an account, submitting a form, or otherwise interacting with TakiGPT AI Inc., you agree that we may send you transactional, administrative, and service-related communications.
These may include:
- purchase confirmations;
- receipts;
- product delivery emails;
- login or access instructions;
- customer support replies;
- password or account messages;
- policy updates;
- product access updates;
- billing or payment-related notices;
- security notices;
- legally required notices.
Transactional communications are not marketing emails. You may not be able to opt out of transactional communications that are necessary to complete your purchase, deliver your product, manage your account, provide support, or comply with legal obligations.
32. Email Marketing Consent
We will only send you marketing emails, newsletters, promotional messages, product updates, launch notices, event invitations, educational campaigns, or similar commercial electronic messages where we have a lawful basis to do so, including your express consent where required by law.
Marketing consent is optional. You do not have to consent to marketing emails to purchase a product, and we will not make a purchase conditional on marketing consent.
Where express consent is requested, we will request it separately from these Terms and separately from the purchase itself. Consent may be requested through an unchecked checkbox, a clear opt-in form, a required Yes/No consent question with no pre-selected answer, or another affirmative action. Each consent request identifies who is seeking consent, states the purposes, and confirms that you can withdraw consent at any time.
By opting in to receive marketing emails from TakiGPT AI Inc., you consent to receive emails from:
TakiGPT AI Inc. Owner/Operator: Taki Wong Email: takigptai@gmail.com Business Mailing Address: 2920 Major Mackenzie Dr. E, P.O. Box 7008, Markham, ON, L6C 0J1, Canada (Woodbine Post Office) Website/Social: @taki.gpt
Marketing emails may include information about AI education, digital products, templates, prompts, workflows, courses, events, newsletters, offers, discounts, product launches, business resources, content updates, and related products or services. Our email lists are managed through email marketing platforms that act as our service providers under contract.
You may withdraw your consent or unsubscribe at any time by clicking the unsubscribe link in our emails or contacting us at takigptai@gmail.com. Every marketing email includes an unsubscribe mechanism that works at no cost to you, requires no login or fee, and remains valid for at least 60 days after the message is sent. We give effect to unsubscribe requests without delay, and in any event within 10 business days.
After you unsubscribe, we retain the limited information necessary to maintain a suppression list, comply with legal obligations, and ensure we do not send you further marketing messages.
33. SMS/Text Message Marketing
We will not send promotional SMS or text messages unless you separately consent to receive them or unless otherwise permitted by applicable law.
Email marketing consent does not automatically include SMS/text marketing consent. SMS/text consent must be requested separately.
If you opt in to SMS/text marketing, message frequency may vary. Message and data rates may apply. You may unsubscribe from promotional text messages by following the instructions provided in the message, such as replying “STOP,” or by contacting us at takigptai@gmail.com. SMS opt-out requests are processed without delay, and in any event within 10 business days.
34. Anti-Spam Compliance (CASL, CAN-SPAM, and Similar Laws)
Canadian recipients. For recipients in Canada, we comply with Canada’s Anti-Spam Legislation (CASL). For commercial electronic messages, we will:
- obtain express consent or rely on implied consent or another lawful basis where CASL permits;
- identify TakiGPT AI Inc. and, where applicable, any person or business on whose behalf the message is sent;
- provide our valid contact information, including a mailing address and an email address, phone number, or web address;
- include a clear unsubscribe mechanism in every message that can be readily performed at no cost and that remains valid for at least 60 days after the message is sent;
- give effect to unsubscribe requests without delay, and no later than 10 business days after they are sent;
