You agree that the Site itself, as well as all content, videos, training materials, products, services and/or other materials, made available on the Site by us or other third parties, as well as the look and feel of all of the foregoing, (collectively referred to as the "Content") are maintained for your personal use and information by The Model Mindset (the "Company") and are the property of the Company and/or its third party providers. You agree that such Company Content shall include all proprietary videos, HTML/CSS, Javascript, graphics, voice, and sound recordings, artwork, photos, documents, and text as well as all other materials included in the Site, excluding only the materials you provide. Subject to your compliance with these Terms of Use, the Company hereby grants you a limited license, which is non-exclusive, non-transferable, and non-sublicensable, to access, view, and use the Site solely for your personal purposes. No Company Content may be copied, reproduced, republished, uploaded, posted, transmitted, distributed, used for public or commercial purposes, or downloaded in any way unless written permission is expressly granted by the Company. Please provide your name and contact information, the nature of your work and how it is being violated, all relevant copyright and/or trademark registration information, the location/URL of the violation, and any other information you believe is relevant.
While the Company uses reasonable efforts to include accurate and up-to-date information in the Site, the Company makes no warranties or representations as to its accuracy. The Company assumes no liability or responsibility for any errors or omissions in the content of the Site.
When you register with the Company and/or this Site, you expressly consent to receive any notices, announcements, agreements, disclosures, reports, documents, communications concerning new products or services, or other records or correspondence from the Company. You consent to receive notices electronically by way of transmitting the notice to you by email.
If you send comments or suggestions about the Site to the Company, including, but not limited to, notes, text, drawings, images, designs or computer programs, such submissions shall become, and shall remain, the sole property of the Company. THE COMPANY DOES NOT WARRANT THAT USE OF THE MATERIALS WILL BE UNINTERRUPTED OR ERROR FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THIS SITE, THE CONTENT, AND/OR THE MATERIALS AVAILABLE ON THIS SITE ARE FREE FROM BUGS OR VIRUSES OR OTHER HARMFUL COMPONENTS. ANY SUCH PROBLEM SHALL BE GOVERNED SOLELY BY THE AGREEMENT BETWEEN YOU AND THAT PROVIDER. THE COMPANY RESERVES THE RIGHT TO DETERMINE, IN ITS SOLE DISCRETION, WHETHER THE COMPANY IS RESPONSIBLE FOR ANY SUCH MALFUNCTION OR DISRUPTION. THE COMPANY ALSO RESERVES THE RIGHT TO LIMIT YOUR USE OF THE SITE AND/OR THE CONTENT OR TO TERMINATE YOUR ACCOUNT SHOULD THE COMPANY DETERMINE THAT YOU HAVE VIOLATED THESE TERMS OF USE, OR THAT YOU HAVE VIOLATED ANY OTHER RULES OR CONDITIONS OF THE COMPANY. You agree that you will pay for all products you purchase through the Company. YOU ARE RESPONSIBLE FOR THE TIMELY PAYMENT OF ALL FEES AND FOR PROVIDING THE COMPANY WITH A VALID PAYMENT METHOD FOR PAYMENT OF ALL FEES. ALL SALES OF PRODUCTS ARE FINAL. Prices for products offered by the Company may change at any time, and the Company does not provide price protection or refunds in the event of a price reduction or promotional offering. If a product becomes unavailable following a transaction but prior to download, your sole remedy is a refund. If technical problems prevent or unreasonably delay delivery of your product, your exclusive and sole remedy is either replacement or refund of the price paid, as determined by the Company.
IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE, RELIANCE OR CONSEQUENTIAL DAMAGES, WHETHER FORESEEABLE OR NOT, INCLUDING, BUT NOT LIMITED TO, DAMAGE OR LOSS OF PROPERTY, EQUIPMENT, INFORMATION OR DATA, LOSS OF PROFITS, REVENUE OR GOODWILL, COST OF CAPITAL, COST OF REPLACEMENT SERVICES, OR CLAIMS FOR SERVICE INTERRUPTIONS OR TRANSMISSION PROBLEMS, OCCASIONED BY ANY DEFECT IN THE SITE, THE CONTENT, AND/OR RELATED MATERIALS, THE INABILITY TO USE SERVICES PROVIDED HEREUNDER OR ANY OTHER CAUSE WHATSOEVER WITH RESPECT THERETO, REGARDLESS OF THEORY OF LIABILITY. THIS LIMITATION WILL APPLY EVEN IF THE COMPANY HAS BEEN ADVISED OR IS AWARE OF THE POSSIBILITY OF SUCH DAMAGES.
If your purchase includes calls with the Company, you are responsible for scheduling them. All bookings are non-refundable. If you have to cancel your call, please email hello@themodelmindset.net with the subject "CALL CANCELLATION- [date & time of your call]" no less than 24 hours before your call. If you do not show up to your call or reschedule within 24 hours, you forfeit your call.
You agree to indemnify and hold the Company and each of its directors, officers employees, and agents, harmless from any and all liabilities, claims, damages and expenses, including reasonable attorney's fees, arising out of or relating to (i) your breach of this Agreement, (ii) any violation by you of law or the rights of any third party, (iii) any materials, information, works and/or other content of whatever nature or media that you post or share on or through the Site, (iv) your use of the Site or any services that the Company may provide via the Site, and (v) your conduct in connection with the Site or the services or with other users of the Site or the services. The Company reserves the right to assume the exclusive defense of any claim for which we are entitled to indemnification under this Section. In such an event, you shall provide the Company with such cooperation as is reasonably requested by the Company.
The provisions of these Terms of Use are for the benefit of the Company, its subsidiaries, affiliates and its third party content providers and licensors, and each shall have the right to assert and enforce such provisions directly or on its own behalf.
This agreement shall be governed by and construed in accordance with the laws of the State of Florida, without giving effect to any principles of conflicts of law. You further submit to the exclusive jurisdiction of the state and federal courts sitting in Orange County, Florida. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.

Acceptance of the Terms & Conditions
These Terms & Conditions are entered into by and between you (“you” or “User”) and the owner, doing business as The Model Mindset (“Company,” “we,” or “us”). These Terms, together with our Privacy Policy and Earnings Disclaimer, govern your access to and use of our website and all programs, courses, coaching services, digital materials, and related offerings.
By accessing our website or purchasing any offering, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not access or use our services.
By purchasing, you confirm that you are legally capable of entering into a binding contract under applicable law.
Electronic Agreement
By clicking “Purchase,” “Enroll,” “Book,” “Sign Up,” or any similar confirmation button at checkout, you enter into a legally binding agreement with The Model Mindset for the specific offering selected. Your electronic acceptance has the same legal effect as a handwritten signature.
Certain offerings may require you to sign an additional participation agreement before access is granted. If applicable, you agree to sign the required agreement through DocuSign or another approved e-signature platform. Any signed agreement will be incorporated into and become part of these Terms.
Order of Documents
If any signed program agreement conflicts with these Terms, the signed agreement controls for that specific offering.
Scope and Applicability
Access to each offering, including program duration, live session schedules, replay availability, and community access periods, is limited to the time frame and structure represented on the applicable sales page or otherwise communicated to you at the time of purchase.
Applicability to Specific Offerings
These Terms apply to all offerings provided by The Model Mindset, including but not limited to digital downloads, online courses, The Model Mindset Method, memberships, group programs, masterclasses, 1:1 coaching sessions, audits, and scheduled calls. Certain offerings may include additional product-specific terms that apply only to that purchase. If a signed participation agreement is required, that agreement supplements these Terms.
Changes to the Terms
We may update these Terms at our discretion. Changes become effective when posted. Your continued use of our website or services constitutes acceptance of those changes.
Age Requirement
You must be at least 18 years old to purchase or enroll in any offering. By purchasing, you confirm that you meet this requirement.
Access & Account Security
We reserve the right to modify, suspend, or discontinue any portion of our website or services without notice. We are not liable if any part becomes unavailable.
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. We may disable access if misuse is suspected.
Nature of Services & No Agency Representation
The Model Mindset provides modeling education and mentorship. We are not a licensed talent agency, modeling agency, or management company. Participation does not create a representation, employment, or fiduciary relationship.
We do not procure modeling work, negotiate contracts, or act on your behalf with agencies, brands, photographers, or third parties.
No Guaranteed Results
Modeling outcomes depend on market conditions, agency demand, timing, and individual effort. We do not guarantee agency representation, contracts, bookings, social media growth, or income. Testimonials reflect individual experiences and are not assurances of similar results.
Coaching Boundaries
The Model Mindset provides education, mentorship, modeling guidance, and mindset coaching. We do not provide therapy, psychological counseling, medical treatment, nutritional treatment, or mental health services.
If you are experiencing mental health challenges, body image distress, eating disorders, trauma, or emotional crisis, you are encouraged to seek support from a licensed medical or mental health professional. Participation in our programs does not create a therapist-client or medical provider relationship.
Seats and Scope
One purchase grants access to one individual unless otherwise stated in writing. Sharing login credentials or providing access to additional individuals, teams, clients, agencies, or classrooms is prohibited.
Delivery and Technical Requirements
Digital products and course materials are delivered electronically through email, download link, or online platform access. You are responsible for maintaining compatible devices, software, and reliable internet access. We are not responsible for technical limitations on your end.
Scheduling, Cancellations & No-Shows
Certain offerings may include scheduled calls, coaching sessions, audits, or appointments.
You are responsible for attending sessions at the scheduled time. If you need to reschedule, you must provide at least 24 hours’ notice unless otherwise stated in writing.
Failure to attend a scheduled session, arriving more than 10 minutes late, or failing to provide required preparation materials may result in forfeiture of that session without refund.
If a session is forfeited due to no-show or late arrival, we are not obligated to reschedule or provide additional access.
We reserve the right to reschedule sessions due to emergencies, technical issues, or circumstances beyond our control.
Scope of 1:1 Sessions
All 1:1 calls, audits, and booked sessions provide educational guidance and strategic feedback only. Ongoing support, additional reviews, or continued access are not included unless explicitly stated in your purchase.
Payments, Financing & No Refund Policy
All purchases are final and non-refundable. By completing your purchase, you expressly acknowledge and agree to this no-refund policy.
We may offer the option to use third-party financing providers or buy-now-pay-later services, such as Klarna, Affirm, or Afterpay, to facilitate payment. By selecting a third-party financing option, you acknowledge and agree that your financing agreement exists solely between you and the financing provider. We are not a party to that agreement and do not control approval decisions, interest rates, repayment terms, fees, or credit reporting practices.
You are fully responsible for all payments, interest, late fees, penalties, and obligations required under your financing provider’s terms. We are not responsible for missed payments, declined charges, credit impacts, or disputes arising from your financing arrangement.
All purchases remain subject to our no-refund policy regardless of financing approval or payment method.
Failure to complete any required payment, whether through a payment plan or third-party financing provider, may result in suspension or permanent termination of access to programs, materials, or services at our discretion, without refund, and without releasing you from your remaining payment obligations.
Price Changes
We reserve the right to modify pricing, payment plans, bonuses, program structure, or offer components at any time without notice. The price in effect at the time of your purchase will apply to your transaction only.
Confidentiality of Pricing and Offers
Pricing, payment terms, bonuses, discounts, and private offers shared on sales calls, in direct messages, or through private communications are confidential. You agree not to publicly share, distribute, post, or disclose such information without written permission.
Acceleration of Balance
If you default on a payment plan and fail to cure the default within a reasonable period, we may accelerate the remaining balance and require immediate payment of all outstanding amounts.
No Chargebacks
You agree to contact us first to resolve billing issues. Initiating a chargeback while retaining access to materials constitutes a breach of these Terms. We reserve the right to provide proof of access and pursue recovery of unpaid balances.
Intellectual Property
All original content created and provided by The Model Mindset, and our offerings, including course videos, coaching materials, guides, voice recordings, downloads, branding, text, graphics, logos, designs, and proprietary frameworks, is owned by us or our licensors and is protected by copyright and trademark laws. Nothing in these Terms transfers ownership to you.
You may not copy, reproduce, adapt, repurpose, distribute, or use our content in whole or in part for the creation of competing products, services, programs, or materials without written permission. Any attempt to present our intellectual property as your own constitutes plagiarism and a material breach of these Terms. We reserve the right to terminate access and pursue legal remedies.
Some content shown in our programs, marketing, or website may include images, videos, screenshots, social media posts, or other media created by third parties, including content creators, influencers, models, photographers, agencies, brands, or production companies. Such content remains the property of its respective owners and is displayed for educational, illustrative, commentary, or example purposes. We do not claim ownership of third-party content. You may not copy, reproduce, distribute, modify, publish, or otherwise use any third-party content for any purpose.
Unauthorized use of our content or third-party content may result in termination of access, legal action, and reporting to the applicable rights holders.
We reserve all rights not expressly granted.
Community Conduct
You agree to conduct yourself respectfully in any coaching session or community space. Harassment, discrimination, defamation, or misuse of materials may result in removal without refund.
Non-Disparagement & Internal Resolution
You agree not to publish or communicate any false, misleading, or defamatory statements about The Model Mindset, its owner, programs, services, or representatives.
If you have concerns, complaints, or disputes regarding any offering, you agree to contact us directly at hello@themodelmindset.net and allow a reasonable opportunity to resolve the matter before initiating public claims, chargebacks, or third-party disputes.
Nothing in this section restricts your right to share truthful experiences or to report unlawful conduct to appropriate authorities.
No Unlawful or Harmful Use
You agree not to use our website, programs, or offerings to violate any law, infringe intellectual property rights, harass or harm others, transmit malware, attempt unauthorized access, or interfere with the operation or security of our platforms or services.
Third-Party Platforms, Industry Risk & Independent Responsibility
Our programs may reference, integrate with, or involve third-party platforms and services, including course hosting platforms, questionnaire forms, social media networks, video conferencing tools, booking systems, email or SMS communication services, and payment processors. These providers operate under their own terms and privacy policies. We are not responsible for outages, technical failures, policy changes, account suspensions, algorithm changes, service interruptions, or platform decisions. You are responsible for maintaining the necessary internet access, devices, and software required to use our offerings.
Participation in the modeling industry involves independent decisions and third-party relationships, including agencies, scouts, photographers, production professionals, brands, clients, casting platforms, and other industry participants. We do not control and are not responsible for their decisions, conduct, contract terms, payment practices, acceptance or rejection, nonpayment, misrepresentation, fraudulent activity, scams, misconduct, unsafe environments, travel risks, or any physical, emotional, reputational, or financial harm arising from third-party interactions.
You acknowledge that you are acting as an independent individual in managing your modeling career. You are responsible for evaluating opportunities, reviewing and signing contracts, seeking independent legal or financial advice, negotiating terms, communicating with third parties, and managing your professional commitments.
The Model Mindset is not liable for agreements you enter into, decisions you make, or outcomes resulting from third-party relationships.
Recordings & Marketing Use
Coaching calls, group sessions, and sales calls may be recorded for quality and documentation purposes. By participating, you acknowledge and consent to being recorded. We may use recordings, excerpts, screenshots, chat comments, or testimonials for training, quality control, promotional, educational, or marketing purposes. If you prefer not to be identified by name, you must notify us in writing prior to participation. You grant us a nonexclusive, worldwide, royalty-free license to use such recordings for these purposes.
Limitation of Liability
To the fullest extent permitted by law, The Model Mindset shall not be liable for indirect, incidental, or consequential damages, including lost modeling income, lost opportunities, emotional distress, or reputational harm. Our total liability shall not exceed the amount you paid for the specific program giving rise to the claim.
Termination
We may suspend or terminate access to any offering for misconduct, breach of these Terms, nonpayment, or misuse of materials. Termination does not release you from any outstanding payment obligations.
Force Majeure
We are not liable for any delay, interruption, or failure to perform resulting from causes beyond our reasonable control, including but not limited to natural disasters, government actions, war, terrorism, labor disputes, internet or platform outages, power failures, or other unforeseen events. In such circumstances, we may modify, suspend, or reschedule services as reasonably necessary.
Severability
If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall be severed and the remaining provisions shall remain in full force and effect.
Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Florida. Any disputes shall be resolved in Florida courts unless we elect to require binding arbitration. You waive the right to participate in any class or collective action.
Notices
Email is the required method for official communication. Notices to us must be sent to hello@themodelmindset.net. We will send notices to the email address associated with your purchase.
Privacy & Data
We collect and process personal data in accordance with our Privacy Policy. By purchasing or participating in our offerings, you consent to this processing.

We are not attorneys, financial advisors, medical providers, therapists, or licensed talent agents. No Guaranteed Results
Modeling outcomes are not predictable. We do not guarantee agency representation, modeling contracts, photoshoots, bookings, brand partnerships, social media growth, or income. We provide modeling education and mentorship designed to support your growth, but your results depend on you. Examples, testimonials and client stories are shared to show what is possible, not what is guaranteed. Results vary based on individual effort, professionalism, timing, location, agency demand, and industry conditions.
Support Guarantee
For select programs, including Agency-Ready (formerly The Model Mindset Method) and Private Mentorship (formerly the 1:1 Coaching Bundle), we offer a Support Guarantee.
“Support Guarantee” refers to the opportunity to receive additional guidance and support beyond your initial program term if your positioning and materials are not yet where they need to be, provided you have completed all assigned work and actively participated in the program.
If you complete all assigned work within your program and actively participate in the support provided, and your positioning and materials are not yet where they need to be by the end of your program term, you may be eligible to receive additional weeks of continued guidance at no additional cost.
The length of this extension varies by program: up to eight (8) additional weeks for Agency Ready and up to twelve (12) additional weeks for Private Coaching.
This extension is intended to support your continued growth and development. It does not guarantee agency representation, contracts, bookings, income, or any specific outcomes or results.
Eligibility for this extension is determined at our sole discretion based on your participation, completion of required work, and adherence to program guidelines.
