Please read these Terms & Conditions carefully before purchasing or accessing any product, program, course, coaching service, call, event, digital resource, or other offering provided by New Earth Center LLC (“Company,” “we,” “us,” or “our”).
By purchasing from, accessing, or participating in any New Earth Center LLC offering, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
1. ALL SALES ARE FINAL — NO REFUNDS
ALL PURCHASES ARE FINAL AND NON-REFUNDABLE.
Due to the nature of our digital products, educational materials, coaching, calls, programs, events, and intellectual property, New Earth Center LLC does not offer refunds, returns, credits, or exchanges after purchase, except where required by applicable law.
This policy applies whether or not you:
Complete or participate in the program or service;
Access, download, or use the materials;
Attend a scheduled call or event;
Experience the results you anticipated;
Change your mind or circumstances; or
Decide the offering is no longer appropriate for you.
By completing your purchase, you acknowledge and agree to this no-refund policy.
2. PAYMENT RESPONSIBILITY
You agree to pay the full purchase price associated with any product, program, service, or payment plan you select.
Choosing a payment plan does not convert your purchase into a subscription or allow you to cancel the remaining payments. A payment plan is an agreement to pay the total purchase price in installments.
Unless otherwise required by law or agreed to by New Earth Center LLC in writing, all remaining payments remain due according to the payment schedule you selected.
Failure to make required payments may result in suspension or termination of access to programs, materials, communities, calls, or other services.
3. INTELLECTUAL PROPERTY
All content provided by New Earth Center LLC is proprietary intellectual property owned by New Earth Center LLC or used by the Company with appropriate permission.
This includes, without limitation:
Courses and programs;
Videos and audio recordings;
Workbooks and worksheets;
Coaching materials;
Exercises and processes;
Frameworks, methods, systems, models, and terminology;
Hypnotherapy or guided audio content;
Trainings and presentations;
Written materials;
Graphics and designs;
Downloads and digital resources;
Live and recorded calls;
Community content; and
Any other educational or proprietary materials provided by New Earth Center LLC.
Your purchase provides you with a limited, personal, non-exclusive, non-transferable license to use these materials for your own personal development and education.
Purchasing access does not transfer ownership or intellectual property rights to you.
4. NO COPYING, SHARING, TEACHING OR RESALE
Unless you receive prior written permission from New Earth Center LLC, you may not:
Copy or reproduce our materials;
Share your login or program access with another person;
Upload or distribute our materials online;
Sell or resell our content;
Republish our content;
Modify and sell our materials as your own;
Use our materials to create your own course, coaching program, certification, workbook, training, or product;
Teach our proprietary frameworks or processes as your own methodology;
Distribute recordings, worksheets, PDFs, downloads, or other materials to clients or third parties; or
Use New Earth Center LLC intellectual property for commercial purposes.
You may apply what you personally learn through our programs to your own life and work. However, you may not reproduce, repackage, teach, license, distribute, or commercially exploit New Earth Center LLC's proprietary content or methodologies without written authorization.
Unauthorized use may result in immediate termination of access and may constitute copyright or intellectual-property infringement.
5. PRIVACY & CONFIDENTIALITY
New Earth Center LLC respects the privacy of its clients and customers.
Personal information and personal experiences you voluntarily share with New Earth Center LLC through coaching, Q&A calls, forms, programs, private communications, or other services will be treated as private and confidential and will not intentionally be sold, publicly disclosed, or shared for marketing purposes without your permission.
We may disclose information when reasonably necessary to operate our business through service providers that support functions such as payments, scheduling, email, hosting, or technology, or when disclosure is required by law, court order, legal process, or reasonably necessary to protect the rights or safety of the Company or others.
We use reasonable safeguards to protect information; however, no electronic platform, website, email system, video-conferencing platform, or other technology can be guaranteed to be completely secure.
6. GROUP PROGRAM CONFIDENTIALITY
Some New Earth Center LLC offerings may include group calls, retreats, communities, workshops, or other shared experiences.
Participants agree to respect the privacy of other participants.
You may discuss your own experiences and insights, but you may not disclose another participant's personal story, identity, private information, screenshots, recordings, messages, or experiences without their permission.
New Earth Center LLC will make reasonable efforts to maintain confidentiality within group environments but cannot guarantee the conduct of other participants.
7. RECORDINGS
Certain calls, classes, workshops, or programs may be recorded for participant access or educational purposes.
When a session will be recorded, participants will be informed as appropriate.
Recordings containing identifiable participant contributions will not be publicly used for marketing or promotional purposes without appropriate permission.
8. COACHING, EDUCATIONAL & SPIRITUAL CONTENT
New Earth Center LLC provides educational, coaching, personal-development, relationship, spiritual, and/or transformational services.
Our services are not a substitute for licensed medical, psychological, psychiatric, legal, financial, or other professional services.
Nothing provided by New Earth Center LLC should be interpreted as diagnosis, treatment, medical advice, legal advice, financial advice, or a guarantee regarding any particular relationship, spiritual belief, business outcome, financial result, or life outcome.
You remain responsible for your own decisions, actions, relationships, health, finances, and well-being.
9. NO GUARANTEE OF RESULTS
New Earth Center LLC does not guarantee specific personal, relationship, spiritual, business, financial, or other results.
Testimonials and examples represent individual experiences and should not be interpreted as promises or guarantees that you will experience the same outcome.
Your results depend on numerous factors, including your circumstances, decisions, participation, implementation, and actions.
10. CALLS & APPOINTMENTS
If your purchase includes a private call or appointment, you are responsible for scheduling and attending that session according to the instructions provided.
Unless otherwise stated for a specific offering, cancellations or requests to reschedule should be made at least 48 hours before the scheduled appointment.
Missed appointments and cancellations made with less than 48 hours' notice may be forfeited and are non-refundable.
11. THIRD-PARTY PLATFORMS
New Earth Center LLC may use third-party platforms and service providers for payments, scheduling, email, video conferencing, course delivery, website hosting, community access, and other business operations.
We are not responsible for outages, errors, interruptions, policies, or technical issues caused by third-party providers.
12. LIMITATION OF LIABILITY
To the fullest extent permitted by law, New Earth Center LLC and its owners, employees, contractors, representatives, and affiliates will not be liable for indirect, incidental, special, punitive, or consequential damages arising from your purchase, participation in, or use of our products, services, programs, website, or content.
You voluntarily assume responsibility for your participation and for the decisions and actions you take based upon the information provided.
13. TERMINATION OF ACCESS
New Earth Center LLC reserves the right to suspend or terminate a participant's access to an offering when reasonably necessary due to:
Nonpayment;
Intellectual-property infringement;
Unauthorized sharing or resale of materials;
Harassment or abusive conduct;
Violation of another participant's privacy;
Disruption of a group or community environment; or
Material violation of these Terms & Conditions.
Termination for violation of these Terms does not entitle the participant to a refund.
14. GOVERNING LAW
These Terms & Conditions shall be governed by and interpreted according to the laws of the State of Utah, without regard to conflict-of-law principles.
To the extent permitted by law, disputes arising from these Terms or services provided by New Earth Center LLC shall be subject to the jurisdiction of the appropriate courts located in Utah.
15. CHANGES TO THESE TERMS
New Earth Center LLC may update these Terms & Conditions periodically.
The version in effect at the time of your purchase will govern that purchase unless otherwise required by law.
16. AGREEMENT
By purchasing, accessing, or participating in a New Earth Center LLC product, program, service, call, event, or digital offering, you confirm that you have read, understood, and agreed to these Terms & Conditions.
By completing your purchase, you specifically acknowledge that ALL SALES ARE FINAL AND NON-REFUNDABLE and that all New Earth Center LLC content and intellectual property are protected from unauthorized copying, distribution, teaching, reproduction, or resale.
